BACKGROUND: Located in the Medium Lot Single-Family Residential "RS-3" zoning district, the applicant is proposing to expand their existing one-story residential structure in order to accommodate a new master bedroom and kitchen area on the property. Because of the placement of the structure and the surrounding trees on the property, the applicant has requested a variance of both the front and side interior setback requirement in order to accomplish this goal. Subject Property located 7400 SW 64 Court REQUEST: Mr. Ramon Lastra, owner of the subject property, is requesting approval through Variance Approvals, Section 20-S.9(G)(1) of the Land Development Code (LDC) of two variances: (1) to ,. 1 PB-16-02S -Variance Application -Front Yard & Interior Side Setback 7400 SW 64 Court October 18, 2016 Page 2 of 4 reduce the minimum front setback for the RS-3 zoning district from 25 feet to 18'-2"; and (2) to reduce the minimum side interior setback from 7'-6" to 5 feet. ANALYSIS: Pursuant to Section 20-5.9 of the LDC, a variance for yard setbacks can be reviewed and permitted by the City Commission at a public hearing, after a recommendation by the Planning Board. When reviewing the project, the following items are noted about the project: JKT • As indicated on the attached Location Sketch, the subject property is a corner lot property with a one-story single family residence that was constructed in the early 1950's as well as a one-story accessory structure at the rear of the property. The ilL" shaped single family residence is positioned in such a way that it is angled, allowing for the front entrance to be viewed from the intersection of SW 64th Court and SW 74th Street • As indicated on the attached Existing Landscape/Demo Floor Plan, sheet A-l, there are approximately eighteen (18) shade trees on the property that surround the single family residence. • In order to preserve the existing tree canopy on the site, the owner has elected to work around the constraint by designing the proposed addition so that it is located at the front of the residence. By accomplishing this, the proposed Site Plan, sheet S-l, shows that approximately 114 square feet will encroach into the front setback area and approximately 8 square feet will encroach into the side interior setback area. These encroachments are for the proposed master bedroom only. The owner is also proposing to expand the kitchen area by approximately 76 square feet; the kitchen expansion does not encroach into any of the required setback areas. Finally, the owner is proposing to renovate the existing wooden deck that is adjacent to the street so that it is in compliance with Section 20-3.6{B){7) of the LDC which allows wooden decks to project into required setbacks and extend up to five (5) feet from property lines. The wooden deck on the south side of the house is five (5) feet from the property line and therefore complies with the Code. • Pursuant to the attached Location Sketch, the property is approximately 11,500 square feet, which exceeds the minimum lot size requirement of 10,000 square feet for the RS-3 zoning district, per Section 20-3.5{E) of the LDC. • The table below details the proposed coverages for the project and their compliance with the RS-3 Dimensional Requirements outlined in Section 20-3.5{E) of the LDC. (30%) 2,631 S.F. (23%) Impervious Coverage 4,600 S.F. (40%) 4,568 S.F. (39%) • The table below details the proposed setbacks for the project and their compliance with the RS-3 Dimensional Requirements outlined in Section 20-3.5(E) of the LDC. Minimum Required Proposed Front Setback 25'-0" 18'-2" Rear Setback 25'-0" 54'-0" Side Street Setback 15'-0" 15'-0". Side Interior Setback 7'-6" 5'-0" Cumulative Side Yard Setback 16'-4" 20'-0" As indicated in the table above, the project will not meet the minimum front or side interior setback requirement for the RS-3 zoning district. Because of that, the applicant is requesting a front setback variance of approximately 6'-10" and a side interior setback variance of 2'-6". Pursuant to Section 20-5.9(H) of the Land Development Code, all variance decisions shall be based on an affirmative finding as to each of the following criterion: JKT 1. The variance is necessary to relieve particular extraordinary conditions relating to a specific property; Due to the positioning of the single family residence onthe property, the areas available on the side of the structure are limited without encroachment into the required setback areas. In order for the proposed addition to be placed at the rear of the property, the interior room layout of the bungalow styled structure would need to be reconfigured in order to accommodate the addition. Furthermore several specimen trees are located throughout the site. Their extensive root systems further limit the potential locations where the addition could be proposed without removing the trees. 2. Denial of the variance would result in hardship to the owner. Hardship results if the restriction of the zoning ordinance, when applied to a particular property, becomes arbitrary, confiscatory or unduly oppressive because of conditions of the property that distinguish it from other properties under similar zoning restrictions; Application of the setback requirements might require a reconfiguration ofthe interior spaces within the single family structure and removal of several specimen trees. However, smaller additions could be constructed in the proposed locations and still comply with the setback requirements. The extraordinary conditions and circumstances do not result from the actions of the applicant; Because the residence was built in the early 1950's, the positioning ofthe residence was not the result of the actions of the owner. 4. The requested variance is the minimum variance necess~ry to make possible the reasonable use of the land, building or structure; Even though the positioning of the house and the location of two specimen trees make expansion challenging, the house can be expanded in such a way that the setback requirements are satisfied. Thus, the requested variances are not the minimum necessary to make possible the reasonable use of the land, building or structure. 5. That the approval of the variance will be consistent with the general intent and purpose of the Land Development Code, and will not be injurious to the neighborhood or otherwise detrimental to the public welfare. Because the owner is proposing to preserve the existing tree canopy on the property, a majority of the proposed addition will be shielded from view of the adjacent right-of- way. Furthermore, the applicant has provided letters of support from nearby residents which have been attached. Other than the Front and Side Interior Setback, the proposed project is in compliance with the dimensional requirements for the RS-3 zoning district. Therefore, the approval of the variance would not be injurious to the neighborhood or detrimental to the public welfare. Additionally, the variance is consistent with the general intent and purpose of the Land'Development Code. PLANNING BOARD RECOMMENDATION: The Planning Board reviewed the application at a Public Hearing on September 13, 2016 and unanimously recommended approval RECOMMENDATION: It is recommended that the City Commission deny the variance application. We are both architects and renovated the 1951 Bungalow house when we purchased it 11 years ago. Having outgrown the house a bit, we are now in need of expanding and our proposed plan will require a Variance from the City of South Miami. Our variance application proposes a one story addition at the front of the house. In an effort to maintain the integrity of the original house and the mature trees surrounding it, our areas for expansion are limited. Because the original house was set at an angle to the property lines, three corners of the addition will have a slight encroachment on the front and side setbacks of our property. The addition is intended to be sensitive to the character of the neighborhood and appropriate for the scale of the existing house. We reside at this address and are requesting a variance to the Front and Interior Side setbacks required for our property to allow for the addition of a master bedroom to the front of the home. The site and existing home have a number of conditions which restrict the locations for a functional addition and require our request for a variance to accommodate the addition. We are considering this addition in lieu of rebuilding the home in an effort to maintain the single story bungalow style and character of the home and maintain the heavily landscaped nature of the surrounding neighborhood. The existing home, built in 1951, is set on an angle on the site relative to the property lines. This positioning of the home limits the available areas on the side of building for the addition without encroachment on the required setbacks. The property is a corner lot requiring an additionally deep setback distances on the street side of the property further limiting the location of the addition. The interior room layout of the home is programmed such that an addition to the rear of the home would require the replacement of the existing bedroom(s) to allow access to the rear of the home. These limitations created by the existing structure limit the ability to add to the existing home without encroaching on the required setbacks. In addition, the property has a significant number of specimen sized trees (greater than 2' in diameter trunks and / or mature growth structures / trees) throughout the site. The location of these trees and their extensive root systems further limit the potential locations where the addition could be proposed without removal of long growth landscape. As the home sits on an angle to the property lines, the proposed encroachment on the front andside setbacks are the corners of the proposed addition, not the entire side encroaching on the setback. The front setback is requested to be reduced from 25'-0" to 18'-2/1, allowing for a full depth parking area in front ofthe addition. The interior side setback is proposed to be reduced from the required 7'-6/1 minimum setback to 5'-0/1. The total aggregate side setbacks.(interior and street side combined) of not less than 20% of the total lot width (16'-4") will remain per code at 19'-9/1 inclusive of the proposed reduced interior side setback. Our variance application proposes a one story addition at the front of the house. In an effort to maintain the integrity of the original house and the mature trees surrounding it, our areas for expansion are limited.
