REQUEST: At this time, the applicant is requesting that approximately 2,640 square feet of unimproved Right- of-Way (ROW) be abandoned. Please note that at this time the applicant's request does not include any other portion of the unimproved ROW. This request is consistent with Florida Statutes 336.09 which states that the following: JKT 1. The commissioners, with respect to property under their control may in their own discretion, and of their own motion, or upon the request of any agency of the state, or of the federal government, or upon petition of any person or persons, are hereby authorized and empowered to: a. Vacate, abandon, discontinue and close any existing public or private street, alleyway, road, highway, or other place used for travel, or any portion thereof, other than a state or federal highway, and to renounce and disclaim any right of the county and the public in and to any land in connection therewith; b. Renounce and disclaim any right of the county and the public in and to any land, or interest therein, acquired by purchase, gift, devise, dedication or prescription for street, alleyway, road or highway purposes, other than lands acquired for state and federal highway; and c. Renounce and disclaim any right of the county and the public in and to land, other than land constituting, or acquired for, a state or federal highway, delineated on any recorded map or plat as a street, alleyway, road or highway. 2. The commissioners, upon such motion, request, or petition, may adopt a resolution declaring that at a definite time and place a public hearing will be held to consider the advisability of exercising the authority granted in this section. At this time, the applicant has submitted a petition bearing signatures of approval from three (3) of the four (4) adjacent and abutting properties. After conducting a field inspection, it was found that the subject site, which is located in the RS -3 zoning district, is unimproved and contains both public utilities and a Specimen Live Oak tree. A second Specimen Live Oak tree is outside of the parameters of the applicant's request. On the south side of the ROW, the neighboring property (8201 SW 62 Avenue) installed a wooden fence that encroaches on the southern side of the ROW (please see photograph below). Subject Location Upon researching how the owner was allowed to construct a fence in the ROW, an inter-office memorandum dated August 12, 1994 between William F. Hampton, City Manager and Dean L. Mimms, Director of Building, Zoning and Community Development was found. In the memorandum, Mr. Mimms explains that the owner of 8201 SW 62 Avenue would be permitted to construct a fence twenty-five (25) feet forward of its location, i.e., to the center line of theoretical SW 82 Street. However, should the ROW one day be needed for public purposes, the provisions listed in the warranty deed for the subject property would be implemented. Upon announcement to the public of the application, the City has received input from residents in the area both supporting and opposing the request (please see attached correspondence). The City Public Works Department has reviewed the request and notes that there are public utilities running through the ROW including a water main, and additional utility improvements are planned for the ROW. If the City Commission agrees to abandon the ROW, it should be conditioned on the property owner(s) dedicating a fifteen (15) foot easement to accommodate the utilities. Further, there is an existing fire hydrant located in the ROW. If the ROW is vacated, it should also be conditioned on the property owner(s) relocating the hydrant, at their expense, to a site selected by the City Manager or his designee. PLANNING BOARD RECOMMENDATION: The Planning Board reviewed the application at a Public Hearing on August 9, 2016. A motion to recommend approval with conditions regarding the dedication of an easement and the relocation of the fire hydrant resulted in a tie vote; a majority vote of the members present is required to pass a matter. RECOMMENDATION: Staff recommends that the City Commission approve the request for abandonment of ROW, subject to the following conditions: (1) the property owner(s) that are adjacent to the subject property shall execute a covenant running with the land, the form of which must be approved in writing by the City Attorney, and which shall (a) dedicate an easement, the location of which shall be approved in writing by the City's Public Works Department, of fifteen (15) feet to accommodate public utilities, their maintenance and/or repair and any future improvements and (b) agree to preserve the specimen Live Oak tree and to not damage, abuse or remove it unless it is determined by the City to be a danger to the community; and (2) the property owner(s) shall relocate the fire hydrant, at their expense, to a site selected by the City Manager or his designee. The covenant running with the land shall provide that any violation of the covenant concerning the tree shall cause the ownership of that portion of the property that is abandoned and on which the trunk of the tree is rooted to instantly and automatically be conveyed or to revert to the City and the responsible owner(s) to incur any appropriate fines. Severability. If any section, clause, sentence, or phrase of this ordinance is for 11 any reason held invalid or unconstitutional by a court of competent jurisdiction, this holding 12 shall not affect the validity of the remaining portions of this ordinance. 13 14 Section 3. Effective Date.
