A Resolution waiving certain special event fees and authorizing the City

Chamber South has submitted a Special Event Application to hold its 45 th Annual
Arts Festival on November 5 and 6, 2016 on 72 nd Street (Sunset Drive) from
South Dixie Highway to sih Avenue (Red Road).
For the past 44 years, Chamber South has held their Art Festival in the City of
South Miami. The Art Festival showcases approximately 130 artists from around
the nation. This event generates approximately 50,000 attendees who stimulate
South Miami's economy through various purchases during the event from local
merchants and restaurants.
Chamber South has routinely requested an extension of time on the payment of
these services to allow time to receive grant funding for this event. According to
Chamber South, full payment is anticipated to be made to the City by July 31,
2017.
The applicant has submitted the necessary notification/petition form signed by
businesses that will be affected by the requested street closure. Upon approval
of this event the applicant must provide the City with the required Certificate of
Liability Insurance that complies with the City's standard insurance
requirements, including naming the City of South Miami as an additional insured
prior to the event.
The applicant has paid the $500 refundable security deposit, $100 administrative
fee and $60 application fee totaling $660.
The applicant is responsible for all services rendered by the City as follows:

17 WHEREAS, the applicant is requesting a waiver for the stage and parks personnel in the amount of
18 $666.72, street closure and MOT fee in the amount of $837.50 and the cost of 64 parking meters in the
19 amount of $3,200 ($25 per meter x 64 total parking meters x 2 days) totaling $4,704.22; and

21 WHEREAS, the applicant will pay for the following services: Police ($9,380), Public Works
22 ($6,342.10), Banner Fees ($600), totaling $16,322.10; and

24 WHEREAS, the applicant has submitted the necessary notification/petition form signed by
25 businesses that will be affected by the requested street closure; and
26
27 WHEREAS, Chamber South has routinely requested an extension of time on the payment of these
28 services to allow time to receive grant funding for this event, which typically takes approximately eight
29 months from the dare ofthe event (July 31,2017).

32 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF
33 SOUTH MIAMI, FLORIDA:

35 Section 1. The City Manager is hereby authorized to permit Chamber South to hold its 45th Annual
36 South Miami Art Festival on November 5 and 6, 2016.

38 Section 2. Upon approval of this event the applicant must provide the City with the required

NOW, THEREFORE, in consideration of the matters reCited above, the. mutual covenants set forth herein, and other good
consideration the receipt and sufficiency of which is hereby acknowledged, the Patties hereby agree as follows:
1. The above recitals are true and correct.
2. Applicant agrees to indemnify, defend and hold the City, its officers, affiliates, employees, successors and assigns,
harmless from and against any and.all such claims, suits, actions, damages, or causes of action arising as a result of
the Special Event, or of the condition of the site on which the Special Event is held including any personal injury or
loss of life, or damage to or loss of property, and from and against any costs, attorney's fees, expenses or liabilities
incurred in and about the defense or settlement of any claims, and the investigation thereof.
3. Permits for Special Events must be on event site at all times.

5. Traffic shall be maintained in accordance with Florida Department of Transportation (FDOT), Miami~Dade County

6. Event areas shall be restored to equal or better condition than they were before the event started.
7. . Ifall restoration work is not performed within 30 days of work completion, the City of South
Miami Public Works Department may restore the event area and charge the applicant for the cost of restoration
plus a minimum of 15% for administrative fee and any additional incidental fees.
8. Applicant must pay all fees prior to.the start oftheil' event(s).
9. AppliCahts that receive approval for their event more than thirty (30) days in advance shall notify the City of South
Miami Special Event/Marketing Coordinator at least forty~eight (48) hours prior to start of their event.
10. Any d,amage to private property shall be restored to its original condition or better and as accepted by the Owner.

A police officer for employment that is indigenpus to their law enforcement· authority commonly referred to as "Extra~D~JyJl
employment. The following policies and procedures must conform in order to schedule a police officer for employment on a
temporary or infrequent basis:
>-The South Miami Police Department shall be the final authority in determining the minimum number of officers required to police a
particular event. If more than three officers are hired, a supervisor must also be hired. The City Manager Office and South Miami
Police Department will determine the supervisor to officer ratio for larger events.
>-The Applicant will be required to compensate the assigned officer for a minimum of three (3) hours even if the event is of a shorter
duration. Currently the rate for Extra-Duty Police Officer is $40 per hour & $50 per hour for Supervising Officer, plus a $3.00 charge for
radio usage for each officer. .
>-The AppHcant must compensate the officer(s) for their services at least one (1) day prior to the start of the scheduled event that the
officer(s) Will be assigned to. No monetary payment will be accepted. No payment by exchange of goods or services is acceptable.
>-If, during a scheduled event, the Applicant determines that helshe needs to extend the time an officer(s) works at the aSSignment, the
Applicant shall compensate officer(s) for a full hour worked if the Officer(s) works for more than 20 minutes andlor less 59 minutes
beyond the regularly scheduled time of the event.
>-Applicant must notify of a cancellation request of an Off-Duty Police Officer forty-eight (48) hours prior to the scheduled date of service.
Failure to do so will require the Applicant to compensate the aSSigned officer for a minimum of three (3) hours.

Sorry for the delay. The breakdown is as follows:
1 Commander; 8 hours each day = 16 hours at $50.00
1 Supervisor for entire event = 42 hours at $50.00
4 officers per shift (with exceptions for a 6 hour blk)= 162 hours at $40.00
Total cost estimate=

This is a cost estimate for 1 Sgt and 4 officers per shift with the exception of a 4 hour block where we will be down to 3
officers and a 2 hour blQ.ck (at the beginning) with 1 officer. The commanders will work the 8 hour shift each day during
