Tompkins, AICP, Planning Director zjItJ August 16, 2016 FROM: Agenda Item NO.:i3 DATE: SUBJECT: A Resolution approving a special use approval to permit a general restaurant at 6620 SW 57 Avenue. BACKGROUND: Located in the Planned Unit Development -Mixed Use (PUD-M) zoning district, the applicant is proposing to open a new general restaurant use on the ground floor of the existing mixed use building. This proposed use is consistent with the Red Road Commons Development Agreement that was amended on November 17, 2009 via Ordinance #29-09-2021, which allowed restaurant, office and retail uses on the ground floor of the building. However, pursuant to the Permitted Use Schedule, Section 20-3 .3(D) of the Land Development Code (LDC), a Special Use permit is required for the operation of a General Restaurant. Subject Property located at 6620 SW 57 Avenue REQUEST: Apoke, Inc., the applicant, is requesting approval to operate a General Restaurant out of a tenant space located at Red Road Commons, 6620 SW 57 Avenue via the Special Use approval process outlined in Section 20 -5.8 of the Land Development Code. Special Use Approval-6620 SW 57 Avenue August 16, 2016 Page 2 of 4 ANALYSIS: Pursuant to the Special Use Conditions, Section 20-3.4 of the LDC, a Special Use may be approved and permitted by the City Commission at a public hearing, after a recommendation by the Planning Board provided that such use complies with the general requirements, special requirements, and any other conditions that the City Commission may consider appropriate and necessary. When reviewing the project, the following items are noted: • The proposed tenant space, which is located at the northern end ofthe building, is currently vacant. • The attached Square Footage & Parking Space letter dated May 25, 2016 indicates that the tenant space is approximately 1,063 square feet and will be designated four (4) parking spaces in the existing parking garage on site. • The applicant is proposing to operate as a General Restaurant use. As shown on the attached Existing & New Work Plan, sheet A-1, the applicant is proposing to renovate the tenant space in order to accommodate a restaurant on the ground floor of the building. Additionally, the general character of the surrounding area is a mix of residential, office, commercial-retail, restaurant and industrial uses, on the northwest side of US-1 (South Dixie Highway) and SW 57th Avenue (Red Road), with the City of Coral Gables and the University of Miami to the east of SW 57th Avenue. Most of the restaurant development in the City has been along US-1 and in the downtown South Miami (Hometown Overlay) area. This proposal would provide additional choices for the residents living at Red Road Commons and in the surrounding area. PARKING SPACE ANALYSIS As per Ordinance #29-09-2021, the extent of retail, office, and restaurant uses shall not exceed, and be limited by, the capacity of provided parking. The Development shall comply with the parking requirements in the Land Development Code, Section 20-4.4(B) for all retail, office and restaurant uses. Pursuant to the information provided, the minimum amount of parking spaces required for the proposed general restaurant is as follows: General Restaurant Parking Space Requirement 1,063 S-,..-F, 1 Parking Space 1 x 100 S-,..-F, = 10.63 ~ 11 Parking Spaces Special Use Approval-6620 SW 57 Avenue August 16, 2016 Page 3 of 4 Based on the calculation listed above, the proposed general restaurant will be required to provide a minimum of eleven (11) parking spaces. Pursuant to Ordinance #29-09-2021, a total of sixty-seven (67) parking spaces were allocated for retail/office/restaurant uses in the building. Beyond Nails Nail Care/Beauty 2,276 1 space/ 8 or Barbershop 300 S.F. Based on the chart above, fifty-nine (59) total parking spaces will be utilized by the retail tenants in the building. This total includes the proposed general restaurant as well. This leaves eight (8) remaining parking spaces for future retail tenants. Even though the applicant was assigned four (4) parking spaces for their use, there is a sufficient amount of parking spaces available, allowing the Red Road Commons project to remain in compliance with the retail parking space provisions that are outlined in Ordinance #29-09-2021. After review of the project, the proposed general restaurant use complies with both the general and special requirements listed in both Section 20-3.4(A) and Section 20-3.4(B)(4)(b) of the LDC, respectively, in that the use: • Is compatible and complementary to the existing uses within the surrounding areas; • The establishment shall provide only inside or patio service on private property; Public streets, rights-of-way, sidewalks and required setbacks may not be used for patio or street-side services of any kind; • No services of a drive-in or of a fast food nature shall be permitted; and Furthermore, the requested special use does not conflict with the Comprehensive Plan and complies with the LDC requirements set forth in Section 20-5.8(B)(1) of the LDC in that the use: a) Will not adversely affect the health or safety of persons residing or working in the vicinity of the proposed use, b) Will not be detrimental to the public welfare or property or improvements in the neighborhood; and, Special Use Approval-6620 SW 57 Avenue August 16, 2016 Page 4 of 4 c) Complies with all other applicable Code provisions. Last, if the Special Use is, in the future, determined by the Director of Planning to be adversely affecting the health or safety of persons residing or working in the vicinity of the proposed use, to be detrimental to the public welfare or property or improvements in the neighborhood, or to be not in compliance with other applicable Code provisions, the Special Use approval may be modified or revoked by the City Commission upon notification and public hearing. PLANNING BOARD ACTION: After the public hearing held for the item at the Planning Board's July 21, 2016 meeting, the Board recommended approval PB-16-015 with a vote of 6 to O. Please note that the applicant handed out an information packet during the hearing that explained the business model for the restaurant. It is attached as Exhibit "A." STAFF RECOMMENDATION: It is recommended that the City Commission approve the Special Use Permit application. This approval is subject to the following terms and conditions as well as all applicable City ordinances, codes, rules and regulations: 1. Adhere to the Special Conditions applicable in Section 20-3.4(B)(4)(b) General Restaurant and Section 20-5.8 Special Use Approval of the Land Development Code, 2.
