ORDINANCE NO.
2 An Ordinance of the City of South Miami ( "City "), located in Miami -Dade
3 County, Florida, approving a proposed budget for the City for the fiscal year
4 commencing October 1, 2016, through September 30, 2017, which amount may
5 be amended at the first or second reading of this Ordinance, and approving
6 and enacting the final budget on second reading.
7 WHEREAS, the City Manager has submitted a proposed Capital and Operating Budget
8 together with a budget message and supporting schedule in accordance with the provisions of
9 the City's Charter; and
10 WHEREAS, the positions flowchart included within each Department budget
11 enumerates all authorized budgeted employee positions for appointment by the City Manager.
12 All personnel filling said authorized positions shall be paid pursuant to the City's Budget,
13 Personnel Policies and /or collective bargaining agreements; and
14 WHEREAS, pursuant to Chapter 200, Florida Statutes, the Mayor and City Commission
15 are required to adopt a tentative budget, and, thereafter, a final budget for the City prior to the
16 commencement of each fiscal year.
17 NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE
18 CITY OF SOUTH MIAMI, FLORIDA THAT:
19 Section 1. The foregoing recitals are hereby ratified and confirmed as being true
20 and correct and are made a part hereof by reference as if set forth herein.

22 Section 2. The Budget for the fiscal year, as submitted by the City Manager and as
23 filed in the City Clerk's Office, in an amount of $25,513,883, is hereby approved, as summarized
24 below:

26 Section 3. Any amount encumbered during Fiscal Year 2015 -2016, but paid in Fiscal
27 Year 2016 -2017, shall be transferred in accordance with GAAP and reflected in the 2016 -2017
28 budget.
29 Section 4. Any money received by the City of South Miami from any non - revenue
30 generating source, such as a grant, gift or donation, whether from any person or governmental
31 agency, may be added to any line item or items in the adopted budget without legislative
32 action, provided, however, that if the gifting person or agency places any condition on the use
33 of said money, the money shall only be disbursed and /or applied toward the purposes for
34 which the money was given. All monies received under a condition regarding its use or
35 expenditure shall be segregated and accounted for based upon generally accepted accounting
36 principles and, where appropriate, placed into separate and individual trust and /or escrow
37 accounts. Any money drawn from those accounts may only be disbursed and /or applied in
38 accordance with the limitations placed upon those monies by the gifting person or agency.
39 Section 5. Severability. If any section, clause, sentence, or phrase of this ordinance
40 is for any reason held invalid or unconstitutional by a court of competent jurisdiction, this
41 holding shall not affect the validity of the remaining portions of this ordinance.
42 Section 6. Ordinances in Conflict. All ordinances or parts of ordinances and all
43 section and parts of sections of ordinances in direct conflict herewith are hereby repealed.
44 Section 7. Effective Date. This ordinance shall become effective upon enactment.
