1I ORDINANCE NO. 2 An Ordinance of the City of South Miami, located in Miami -Dade County, 3 Florida , approving a tentative millage rate for the fiscal year commencing 4 October 1, 2016, through September 30, 2017 ( "fiscal year 2016/2017 ") which 5 amount may be amended at the first or second reading, and approving and 6 enacting the final millage rate of the City on second reading. 7 WHEREAS, pursuant to section 200.065, Florida Statutes, tax assessments for all real 8 property within the jurisdiction of the City of South Miami ( "City "), for the fiscal year 2016 -2017 9 has been made by the property appraiser for Miami -Dade County; and 10 WHEREAS, the City's current millage rate is 4.3000 and the rolled -back rate for the fiscal 11 year 2016 -2017 is 4.0086; and 12 WHEREAS, the initial proposed millage of 4.3000 represents a 0% increase from the 13 City's current rate and approximately 7.27% increase over the rolled -back rate for the fiscal 14 year 2016 -2017; and 15 WHEREAS, pursuant to section 200.065, Florida Statutes, the Mayor and City 16 Commission are required to adopt a tentative millage rate and, thereafter, a final millage rate 17 for the taxing jurisdiction of the City of South Miami. 18 NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE 19 CITY OF SOUTH MIAMI, FLORIDA THAT: 20 Section 1. There shall be and hereby is levied upon real property in the City of South 21 Miami, Florida, a tax of 4.3000 mills on the dollar for the operational expenses of the 22 government of the City for the fiscal year beginning October 1, 2016, and ending September 30, 23 2017. This results in a 0% increase in the City's 2015 -2016 fiscal year property tax rate but an 24 increase of 7.27% or 0.2914 mills over the roll back rate of 4.0086 which is statutorily 25 characterized as an increase in property tax. 26 Section 2. Severability. If any section, clause, sentence, or phrase of this ordinance 27 is for any reason held invalid or unconstitutional by a court of competent jurisdiction, this 28 holding shall not affect the validity of the remaining portions of this ordinance. 29 Section 3. Ordinances in Conflict. All ordinances or parts of ordinances and all 30 section and parts of sections of ordinances in direct conflict herewith are hereby repealed. 31 Section 4. Effective Date.
