A non-binding straw ballot question shall be placed on the Tuesday, 17 November 8, 2016, Presidential Election ballot for the purpose of submitting to the qualified 18 electors the question as set forth below. 19 Section 2. Notice of such election shall be published in accordance with the election 20 laws. 21 Section 3. The result of such election shall be determined by a majority of the qualified 22 electors of the City of South Miami voting upon the proposal at the Tuesday, November 8, 2016, 23 Presidential Election. All qualified electors of the City of South ,Miami shall be entitled to vote at 24 said election. The question shall appear on the ballot in substantially the following form: 25 26 Title: Non-binding ballot question concerning financing of a new City Hall campus and 27 other improvements. 28 BALLOT QUESTION: 29 Should the City consider the sale of the library and/or City Hall and Police Station 30 to allow the construction of a new City Hall, Police Station and Library and other 31 possible improvements in the City. 32 YES 33 NO 34 Section 4. The form of the ballot shall be in accordance with the requirements of general 35 election laws. Page 1 of 2 I 1 2 Section 5. Early voting shall be conducted in accordance with the requirements of 3 general election laws. 4 5 Section 6. Vote-by-mail ballot may be used by qualified electors of the City of South 6 Miami for voting on this question. The form of such absentee ballot shall be in accordance with 7 the requirements prescribed by general election laws. 8 9 Section 7. A sample ballot showing the manner in which the question or proposal 10 aforesaid will appear at this election shall be published and provided in accordance with the 11 applicable provisions of general election laws. 12 13 Section 8. This election on the proposal aforesaid shall be held and .conducted in 14 accordance with applicable provisions of the general laws relating to elections and the provisions 15 of the Miami-Dade County Home Rule Charter. The City Manager or the manager's designee, 16 the Finance Director, and the City Clerk are hereby authorized and directed to take all 17 appropriate actions necessary to carry into effect and accomplish the provisions of this 18 resolution. 19 Section 9. Severability: If any section clause, sentence, or phrase ofthis resolution is 20 for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding 21 shall not affect the validity of the remaining portions of this resolution. 22 23 Section 10. Effective Date: This resolution shall become effective immediately upon 24 adoption by vote of the City Commission. 25 26 PASSED AND ADOPTED this __ day of _____ , 2016. 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 ATTEST: CITY CLERK READ AND APPROVED AS TO FORM, LANGUAGE, LEGALITY AND EXECUTION THEREOF CITY ATTORNEY Page 2 of 2 APPROVED: MAYOR COMMISSION VOTE: Mayor Stoddard: Vice Mayor Welsh: Commissioner Edmond: Commissioner Liebman: Commissioner Harris: 1 RESOLUTION NO. ___ _ 2 3 A Resolution of the City of South Miami, Florida, placing a non-binding 4 ballot question on the Tuesday, November 8, 2016, Presidential Election 5 ballot, to determine whether the voters support the use of the value of the 6 existing Library and/or City HalllPolice Station property to fund the 7 building of a new Library and/or City Hall and Police Station and possibly 8 other improvements in the City. 9 10 WHEREAS, several developers/firms have made offers to acquire some 11 properties owned by the City including the South Miami City/Hall/Police Station, and 12 library properties; and 13 14 WHEREAS, some have offered to rebuild South Miami City HalllPolice Station, 15 library, and if necessary, to relocate the Sylva Martin building to be repurposed for use by 16 the public; and 17 18 WHEREAS, City Hall is 61 years old and in need of repair; and 19 20 WHEREAS, the 2nd floor of the main building is not ADA accessible, making it 21 nonconforming under current Federal standards for such structures and therefore 22 inappropriate for public use; and 23 24 WHEREAS, redesign and reconstruction of the South Miami City Hall complex 25 was first proposed in the 1994 Hometown Plan Area 2 ("Hometown Too" plan), and has 26 been considered by the City and its residents ever since; and 27 28 WHEREAS, due to the current economic strengthening, and the multi-million 29 dollar repairs and retrofitting needed for the City Hall complex, this is an opportune time 30 to investigate a redevelopment of the City Hall campus including, the City Hall, the Police 31 Station, and the Library; and 32 33 WHEREAS, a proposed transaction might will provide additional resources to 34 fund the connection of residents in low-lying areas of the City to municipal sewer, at a 35 savings of tens of millions of dollars to the taxpayers; and 36 37 WHEREAS, some feel that the Commission would benefit from knowing whether 38 the residents agree that the City should build a new City Hall campus including, the City 39 Hall, Police Station, and the Library, using the value of the existing property as a tool for 40 funding the construction so taxpayers do not have to pay tens of millions of dollars for this 41 purpose. 42 43 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY 44 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, THAT: 45 46 Section 1.
