77 1 ORDINANCE NO. -------- 2 3 An Ordinance amending Chapter 1, Section 1-8 of the City of South Miami's 4 Code of Ordinances regarding general penalties for offenses. 5 6 WHEREAS, Section 1-8 of the City of South Miami's Code of Ordinances does not 7 provide for code enforcement citations; and 8 9 WHEREAS, section 1-8 does not provide for special assessments in the event that the 10 City incurs the cost of curing a violation that causes a nuisance; and 11 12 WHEREAS, section 1-8 references a municipal court that no longer exists. 13 14 NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY 15 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 Section 1. City of South Miami Code of Ordinances, Chapter 1, Section 1-8, "General penalty; continuing violations," is hereby amended to read as follows: Sec. 1-8. -General penalty; continuing violations. Whenever in this Code or in any ordinance of the city any act is prohibited or is made or declared to be unlawful or an offense, or whenever in such code or ordinance· the doing of any act is required or the failure to do any act is declared to be unlawful, where no specific penalty is provided, therefor, the violation of any such provision of this code or any ordinance shall be punished by a fine not exceeding five hundred dollars or imprisonment for a term not exceeding six months, or by both such fine and imprisonment in the discretion of the municipal.1!..court of competent jurisdiction .. In lieu of arrest by a police officer, a code enforcement or police officer may issue a civil citation which shall be enforced pursuant to the procedure provided in section 2-25 of this Code. Each day that any violation of any provision of this Code or of any other City ordinance shall-continue§., it shall constitute a separate offense. In addition to the penalties hereinabove provided, any condition caused or permitted to exist in violation of any of the provisions of this Code or any ordinance shall be deemed a public nuisance and may be, by the city, abated as provided by law, and each day that such condition continues shall be regarded as a new and separate offense. In the event that the City incurs any costs to abate the nuisance, the cost incurred may be assessed against the property in the same manner as any other property assessment or it may be included in an enforcement order of the City'S Special Master. 41 Section 2. Codification. The provisions of this ordinance shall become and be made 42 part of the Code of Ordinances of the City of South Miami as amended; that the sections of this 43 ordinance may be renumbered or re-lettered to accomplish such intention; and that the word 44 "ordinance" may be changed to "section" or other appropriate word. 45 1 Section 3. Severability. If any section, clause, sentence, or phrase of this ordinance is 2 for any reason held invalid or unconstitutional by a court of competent jurisdiction, this holding 3 shall not affect the validity of the remaining portions of this ordinance. 4 5 Section 4. Ordinances in Conflict. All ordinances or parts of ordinances and all 6 sections and parts of sections of ordinances in direct conflict herewith are hereby repealed. 7 8 Section 5. Effective Date.
