61 2 3 4 5 6 7 8 9 RESOLUTION NO. _____ _ A Resolution of the City of South Miami, Florida, placing a non-binding ballot question on the Tuesday, November 8, 2016, Presidential Election ballot, to determine whether the voters support the building of a new City Hall, Police Station and Library using the value of the existing Library and/or City HalllPolice Station property, and how surplus funds from such a transaction should be spent. 6 10 WHEREAS, several developers/firms have made offers to acquire the South Miami City 11 Hall/Police Station, library properties and Sylva Martin property; and 12 WHEREAS, they have offered to rebuild South Miami City Hall/Police Station, library 13 and move the Sylva Martin building; and 14 WHEREAS, City Hall is 61 years old and in need of repair; and 15 WHEREAS, due to the current economic strengthening, this is an opportune time to 16 investigate a redevelopment of the City Hall campus including, the City Hall, Police Station, and 17 the Library; and 18 WHEREAS, the 2nd floor of the main building is not ADA accessible, making it 19 nonconforming under current Federal standards for such structures and therefore inappropriate 20 for public use; and 21 WHEREAS, some feel that the Commission would benefit from knowing whether the 22 residents agree that the City should build a new City Hall campus including, the City Hall, Police 23 Station, and the Library, using the value of the existing property as a tool for financing the 24 construction, and how the proceeds should b~ spent for other improvements, such as a pedestrian 25 bridge and improved sewer infrastructure. 26 NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY 27 COMMISSIONERS OF THE CITY OF SOUTH MIAMI, FLORIDA: 28 Section 1. A non-binding straw ballot question shall be placed on the Tuesday, 29 November 8, 2016, Presidential Election ballot for the purpose of submitting to the qualified 30 electors the question as set forth below. 31 Section 2. Notice of such election shall be published in accordance with the election 32 laws. 33 Section 3. The result of such election shall be determined by a majority of the qualified 34 electors of the City of South Miami voting upon the proposal at the Tuesday, November 8, 2016, 35 Presidential Election. All qualified electors of the City of South Miami shall be entitled to vote at 36 said election. The question shall appear on the ballot in substantially the following form: Page 1 of 3 1 2 Title: Non-binding ballot question concerning financing of a new City Hall campus and 3 other improvements. 4 BALLOT QUESTION: 5 Should the City use the value of the existing library and/or City Hall and Police 6 Station property to fund the construction of an environmentally sound and more 7 efficient City Hall campus including, City Hall, the Police Station and the Library 8 and other possible improvements to the City. 9 YES 10 NO 11 Section 4. The form of the ballot shall be in accordance with the requirements of general 12 election laws. 13 14 Section 5. Early voting shall be conducted in accordance with the requirements of 15 general election laws. 16 17 Section 6. Vote-by-mail ballot may be used by qualified electors of the City of South 18 Miami for voting on this question. The form of such absentee ballot shall be in accordance with 19 the requirements prescribed by general election laws. 20 21 Section 7. A sample ballot showing the manner in which the question or proposal 22 aforesaid will appear at this election shall be published and provided in accordance with the 23 applicable provisions of general election laws. 24 25 Section 8. This election on the proposal aforesaid shall be held and conducted in 26 accordance with applicable provisions of the general laws relating to elections and the provisions 27 of the Miami-Dade County Home Rule Charter. The City Manager or the manager's designee, 28 the Finance Director, and the City Clerk are hereby authorized and directed to take all 29 appropriate actions necessary to carry into effect and accomplish the provisions of this 30 resolution. 31 Section 9. Severability: If any section clause, sentence, or phrase of this resolution is 32 for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding 33 shall not affect the validity of the remaining portions of this resolution. 34 35 Section 10. Effective Date: This resolution shall become effective immediately upon 36 adoption by vote of the City Commission and, if approved by the electorate, the amendment to 37 the City Charter shall become effective ten (10) days following the date of the election held for 38 its approval. 39 40 41 42 PASSED AND ADOPTED this __ day of _____ , 2016.
