Res No 231-16-14786RESOLUTION 231-16-14786 A Resolution of the Mayor and City Commission of the City of South Miami, Florida,supporting legislative efforts torepeal,orin the alternative,amend section 403.7033,Florida Statutes,so that local governments are no longer preempted from enacting legislation regulating non-degradable containers. WHEREAS,theCity Commission diligentlystrivesto preserve the environment and which is important tothe economy of theCity of SouthMiami;and WHEREAS,plastic bags and Styrofoam containers are detrimental because they do notfully degrade and they introduce unsafe chemicals intoour environment;and WHEREAS,plastic bagsand Styrofoam containers createthe potential forthe death of land and marine animals through entanglement and/or ingestion;and WHEREAS,theexpansiveusage of single-usebagsandtheirtypicaldisposalrates createsanimpedimenttotheCity'swastereductionandrecyclinggoals,whilecreatingimsightly litter;and WHEREAS,single-use plasticbagsand containers aredifficulttorecycleand frequently contaminatematerialthatisprocessedthroughtheCity'srecyclingprograms;and WHEREAS,replacingsingleusebagsandcontainerswithreusablebagsandcontainers isconsideredaquickandeasywaytoreducewasteandlitter,protectwildlifeandconserve resources;and WHEREAS,the City Commission acknowledges that some businesses have taken affirmative stepsto accomplish thisgoaland recognizes their proactive efforts;and WHEREAS,itisinthe best interest of the public forthe Florida Legislature to allow local regulation of single-use bags and containers. NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA,AS FOLLOWS: Section 1.The above Recitals are true and correct and incorporated herein by this reference. Section 2.TheCityCommission oftheCity of SouthMiamisupportstherepealof,or,in the alternative,an amendment to,Section 403.7033,Florida Statutes,which would allow forlocal regulation ofnon-degradablebagsandcontainers,suchasthosemade ofplasticandStyrofoam. Section4.Severability.If anysectionclause,sentence,orphrase ofthis resolution isforany reasonheldinvalidor unconstitutional byacourtof competent jurisdiction,theholdingshallnot affect thevalidity oftheremainingportions ofthis resolution.
