Tompkins, Planning Director DATE: July 12 , 2016 SUBJECT: 19 An Ordinance Adopting a Small Scale Amendment to the Future Land Use Map of the Comprehensive Plan, amending the designation of the Marshall Williamson property located south of SW 64th Terrance, approximately between SW 60 th Avenue and SW 6ist Court, from Single-Family Residential (TWO-Story) to Townhouse Residential (TWO -Story). BACKGROUND: The South Miami Community Redevelopment Agency (CRA) own s three (3) parcels of property on the south side of SW 64 th Terrace between SW 61 st Court and SW 60 t h Avenue . Known as the Marshall Williamson property, the three lots total approximately one (i) acre and are undeveloped . Only one of the lots, folio number 09 -4025-000 -0850, ha s been assigned a street address , 6488 SW 60 t h Avenue . This is also the largest of the three parcels at 35 ,512 square feet . The other folios i n clude 09-4025 -065 -0090 and 09-4025-000-0852 . The CRA requests that the Future Land Use Map (FLUM) of the Comprehensive Plan be changed from Single-Family Residential (TWO-Story) to Townhouse Residential (TWO-Story). Earlier attempts to change the land use designation have been unsuccessful , including a 2015 application for Multiple-Family Residential (Four-Story). ANALYSIS: The property is bounded by SW 64 t h Terrace (north), SW 60 t h Avenue (east) Single-family homes (south) and SW 61 st Court (west). The Comprehensive Plan states that this category is intended to limit development townhouse type dwelling units on parcels of land not less than 10,000 square feet in area. Each dwelling unit should have its own at-grade access to the outdoors. Excerpt from the FLUM: JKT .1 IIIJ I l1li • ,I !!I • :I ii !III I I .1 IIIJ III ~ I I ~' ~==~~----~ Z:\Commission Items\2016\07-12-2016\Marshall Williamson FLUM Amendment Report .docx Marshall Williamson Future Land Use Map Amendment July 12, 2016 Page 4 of 4 The request seems to be consistent with several goals and policies ofthe Comprehensive Plan: • Implement priority SMCRA programs and projects, including but not limed to: "in-fill" housing, construction of multi-family units, substantial rehabilitation of housing (HUD Complex), and streetscape and infrastructure improvements (Future Land Use Policy 5.1.2). • To assure the availability of sound and affordable housing for all current and future residents of the City of South Miami with special focus on infill and redevelopment and to include housing units in the Hometown District. It is recognized that the choice of location rests with the individual and that the City's role is to implement policies that expand choices (Housing Goal 1). • Utilize the Future Land Use Plan and zoning map to assure a diversity of housing types (Housing Policy 1.1.1). The CRA has also requested that the property's designation on the Official Zoning Map be changed to RT-9. That analysis and ordinance are presented as separate agenda items. RECOMMENDATION: Staff recommends approval of first reading of this Ordinance and subsequent referral to the Planning Board for their review and recommendation. Second reading of the Ordinance will follow, at a date to be determined. An Ordinance Adopting a Small Scale Amendment to the Future Land Use Map of the Comprehensive Plan, amending the designation of the Marshall Williamson property located south of SW 64 th Terrace approximately between SW 60th Avenue and SW 61 st Court, from Single-Family Residential (Two-Story) to Townhouse Residential (Two-Story). 8 WHEREAS, the Florida Legislature intends that local planning be a continuous and ongoing 9 process; and 10 11 WHEREAS, Section 163.3191, Florida Statutes, directs local governments to adopt needed 12 amendments to ensure that the Comprehensive Plan provides appropriate policy guidance for growth 13 and development; and 14 15 WHEREAS, the Planning and Zoning Department working with the Community Redevelopment 16 Agency (CRA) prepared a new Future Land Use Map Category to meet the needs of the Madison Square 17 Project and the concerns expressed by Commissioners and other residents; and 18 19 WHEREAS, the City of South Miami has prepared a small scale Future Land Use Map 20 amendment to change the designation of the approximately .85 acre Marshall Williamson property 21 located south of SW 64th Terrace between SW 60 th Avenue and SW 61 st Court from Single-Family 22 Residential (Two-Story) to Townhouse Residential (Two-Story); and 23 24 WHEREAS, the Local Planning Agency has reviewed or will review the proposed amendments to 25 the Comprehensive Plan and it has held or will hold an advertised public hearing and provide for public 26 participation in the process and rendered its recommendation to the City Commission before the final 27 reading and enactment ofthis ordinance. 28 29 NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF 30 SOUTH MIAMI, FLORIDA AS FOLLOWS: 31 32 Section 1. The City of South Miami hereby adopts the Small Scale Amendment to the Future 33 Land Use Map as indicated on the Map attached hereto and made a part hereof as Exhibit "A" and 34 changing the future land use map category from the Single Family Residential (Two Story) to Townhouse 35 Residential (Two-Story) for the properties identified as a part of the proposed Madison Square 36 Development Project more specifically legally described as 6488 SW 60th Avenue (Folio No. 09-4025-000- 37 0850); Folio No. 09-4025-000-0852; and Folio No. 09-4025-065-0900. 38 39 Section 2. Codification. The provisions of this Ordinance shall become and be made part of the 40 Future Land Use Map of the City of South Miami's Comprehensive Plan, as amended. 41 42 Section 3. Severability. If any section, clause, sentence, or phrase of this Ordinance is for any 43 reason held invalid or unconstitutional by a court of competent jurisdiction, this holding shall not affect 44 the validity of the remaining portions of this Ordinance or the Guidelines adopted hereunder. 45 46 Section 4. Ordinance in Conflict.
