19-revised ordinanceRevised #19 Page 1 of 2 ORDINANCE NO. _____ 1 2 An Ordinance Adopting a Small Scale Amendment to the Future Land Use Map of the 3 Comprehensive Plan, amending the designation of the Marshall Williamson property located 4 south of SW 64th Terrace approximately between SW 60th Avenue and SW 61st Court, from 5 Single-Family Residential (Two-Story) to Townhouse Residential (Two-Story). 6 7 WHEREAS, the Florida Legislature intends that local planning be a continuous and ongoing 8 process; and 9 10 WHEREAS, Section 163.3191, Florida Statutes, directs local governments to adopt needed 11 amendments to ensure that the Comprehensive Plan provides appropriate policy guidance for growth 12 and development; and 13 14 WHEREAS, the Planning and Zoning Department working with the Community Redevelopment 15 Agency (CRA) prepared a new Future Land Use Map Category to meet the needs of the Madison Square 16 Project and the concerns expressed by Commissioners and other residents; and 17 18 WHEREAS, the City of South Miami has prepared a small scale Future Land Use Map 19 amendment to change the designation of the approximately .85 acre Marshall Williamson property 20 located south of SW 64th Terrace between SW 60th Avenue and SW 61st Court from Single-Family 21 Residential (Two-Story) to Townhouse Residential (Two-Story); and 22 23 WHEREAS, the Local Planning Agency has reviewed or will review the proposed amendments to 24 the Comprehensive Plan and it has held or will hold an advertised public hearing and provide for public 25 participation in the process and rendered its recommendation to the City Commission before the final 26 reading and enactment of this ordinance. 27 28 NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF 29 SOUTH MIAMI, FLORIDA AS FOLLOWS: 30 31 Section 1. The City of South Miami hereby adopts the Small Scale Amendment to the Future 32 Land Use Map as indicated on the Map attached hereto and made a part hereof as Exhibit “A” and 33 changing the future land use map category from the Single Family Residential (Two Story) to Townhouse 34 Residential (Two-Story) for the properties identified as a part of the proposed Madison Square 35 Development Project more specifically legally described as 6488 SW 60th Avenue (Folio No. 09-4025-000-36 0850); Folio No. 09-4025-000-0852; and Folio No. 09-4025-065-0900. 37 38 Section 2. Codification. The provisions of this Ordinance shall become and be made part of the 39 Future Land Use Map of the City of South Miami’s Comprehensive Plan, as amended. 40 41 Section 3. Severability. If any section, clause, sentence, or phrase of this Ordinance is for any 42 reason held invalid or unconstitutional by a court of competent jurisdiction, this holding shall not affect 43 the validity of the remaining portions of this Ordinance. 44 45 Section 4. Ordinance in Conflict. All ordinances or parts of ordinances and all sections and parts 46 of sections of ordinances in direct conflict herewith are hereby repealed. 47 48 Revised #19 Page 2 of 2 Section 5. Effective Date.
