Tompkins, AICP, Planning DireClor% July 12, 2016 J An Ordinance Amending the Official Zoning Map, as authorized by Section 20-3.1(C), and other applicable provisions, amending the designation of the Marshall Williamson property located south of SW 64th Terrace approximately between SW 60th Avenue and SW 61st Court, from Single-Family Residential District RS-4 to RT-9. BACKGROUND: The South Miami Community Redevelopment Agency (CRA) owns three (3) parcels of property on the south side of SW 64 th Terrace between SW 61 st Court and SW 60 th Avenue. Known as the Marshall Williamson property, the three lots total approximately one (1) acre, are zoned Single- Family RS-4 and are undeveloped . Only one of the lots, folio number 09-4025-000-0850, has been assigned a street address, 6488 SW 60 th Avenue. This is also the largest of the three parcels at 35,512 square feet. The other folios are 09-4025-065 -0090 and 09-4025-000-0852. The CRA requests that the zoning be changed to Two -Family/Townhouse Residential RT-9. It is important to note that earlier attempts to change the zoning have been unsuccessful, including a 2015 application for Low Density Multi-Family Residential RM-18. ANALYSIS: The property is bounded by SW 64 th Terrace (north), SW 60 th Avenue (east) single-family homes (south) and SW 61 st Court (west). Section 20-3.1 of the Land Development Code provides that: The purpose of this district is to provide suitable sites for the development of well planned, environmentally compatible, low density attached single-family residential projects of a two-family and/or townhouse nature, which are located in such a manner as to serve as effective transitional land use elements between single-family and more intensive multi-family residential or commercial areas. This district is appropriate in areas designated "Two-Family/Townhouse Residential" on the city's adopted Comprehensive Plan. The CRA has also requested that the. property's designation on the Comprehensive Plan's Future Land Use Map (FLUM) be changed to Townhouse Residential (Two-Story). This is an appropriate designation for RT-9 zoning, as the "Two-Family/Townhouse Residential" category no longer exists. The analysis and ordinance for that request is presented as a separate agenda item. Similarities also exist in the dimensional requirements of the two districts, as provided in Section 20-3.5E, F, and H of the LDC. Based on the table above, with a one (1) acre site it appears that a maximum of eight (8) two-family or six (6) townhouse units could be built if the requests are approved. Under the current zoning designation, a maximum of seven units could be built. This assumes that the new lots can meet the required dimensions and no land is needed for right-of-way dedications or other public improvements. It also assumes the site is exactly one (1) acre in size; different public records give varying sizes, so surveys will be required when the development plans are submitted. RECOMMENDATION: Staff recommends approval of first reading of this Ordinance and subsequent referral to the Planning Board for their review and recommendation. Second reading of the Ordinance will follow, at a date to be determined. An Ordinance Amending the Official Zoning Map, as authorized by Section 20-3.1(C), and other applicable provisions, amending the designation of the Marshall Williamson property located south of SW 64 th Terrace approximately between SW 60th Avenue and SW 61 st Court, from Single-Family Residential District RS-4 to RT-9. 8 WHEREAS, the City of South Miami has prepared an amendment to the Official Zoning Map to 9 change the designation of the approximately .85 acre Marshall Williamson property located south of SW 10 64 th Terrace between SW 60 th Avenue and SW 61 st Court from Single-Family Residential RS-4 to RT-9; 11 and 12 13 WHEREAS, the Local Planning Agency has reviewed or will review the proposed amendment to 14 the Official Zoning Map, and it has held or will hold an advertised public hearing and provide for public 15 participation in the process and rendered its recommendation to the City Commission before final 16 reading and enactment. 17 18 NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF 19 SOUTH MIAMI, FLORIDA AS FOLLOWS: 20 21 Section 1. The City of South Miami hereby adopts an amendment to the Official Zoning Map 22 changing the designation for the Marshall Williamson property, located south of SW 64 th Terrace 23 approximately between SW 60 th Avenue and SW 61 st Court, from Single-Family Residential District RS-4 24 to RT-9. A copy of the pertinent part of the Map is attached hereto and made a part hereof as Exhibit 25 {{A". 26 27 Section 2. Codification. The provisions of this Ordinance shall become and be made part of the 28 Official Zoning Map of the City of South Miami as amended. 29 30 Section 3. Severability. If any section, clause, sentence, or phrase of this Ordinance is for any 31 reason held invalid or unconstitutional by a court of competent jurisdiction, this holding shall not affect 32 the validity of the remaining portions of this Ordinance or the Guidelines adopted hereunder. 33 34 Section 4. Ordinances in Conflict. All ordinances or parts of ordinances and all sections and 35 parts of sections of ordinances in direct conflict herewith are hereby repealed. 36 37 38 39 40 41 42 43 44 45 46 47 48 Section 5.
