An Ordinance relating to the fee schedule; amending Ordinance 22-14-2200 to increase some
fees, adding new fees, and deleting some fees from the schedule.
At the April 19, 2016, City Commission Meeting, the Mayor and Commission reviewed the proposed
revisions to the City's "Schedule of Fees and Fines." The City Administration has recommended the
below revisions through the suggestions provided by Commission or after further review by Department
Directors.
Public Works & Utilities Fee Schedule
The existing title has been revised from Public Works & Utilities Fee Schedule to Public Works Fee
Schedule. in order to clarify the charges associated with the Public Works Department.
The fee title Street Name or Directional Signs has been revised to Directional Signs. Trash collections
has been adjusted to 1/3 truck load, 8 cubic yards and appliances will have a new fee of $75 each.
Public Works barricades (up to 100) have also been adjusted to $250 per day. Barricades (101 or more)
each per day will be $3 each.
The bridges, bus shelters, permanent traffic barricade, guardrail and guideposts permit classifications
were removed as they are not applicable within the City of South Miami.
Police Department Fee Schedule
For off duty work, a $40 per hour fee per the Officer is in place, a five dollar per hour fee for use of a
marked police car when needed. The existing Radio fee per Officer, per day, as well as towing signs per
premises have been targeted to be eliminated in the proposed Ordinance to be sent to you soon for
your action. This proposed Ordinance is intended to eliminate current Code provisions which have not
been implemented by the City for many years. We are proposing a much simpler to administer process,
which will be much more effective for the community.
Tow operators and storage sites who require Police intervention due to disturbances and/or to settle
disputes or have found not to have complied with all applicable Florida State Statues, Miami-Dade
County Ordinances and or City of South Miami Towing Ordinances shall be fined $500 by the City of
South Miami after the 2nd documented police response. After 12 such responses the City shall reserve
the right to suspend any such operators Business License. Each such call for service requires two
Officers to attend as it is reported as a disturbance. This is for Officer safety. Each call takes two
Officers off their other duties for as much as an hour.
Parks & Recreation Fitness Center Fee Schedule
Based on the weight training and cardiovascular equipment available at the City's Fitness Center, and its
proposed relocation to the ground floor, the Parks and Recreation Department is proposing to simplify
the membership types and revise the fe.e schedule. Please find below highlights of the changes which
have been incorporated based on the Commission's recommendations from the 1" reading and further
review by the Parks and Recreation Department.
Members who elect to enroll in monthly or annual recurring payment options with credit card will NOT
be required to pay a non-refundable, one-time administration/registration fee of $30.00
City staff evaluated the fees charged by other municipalities and private clubs located in Miami-Dade
County and discovered the following proposed rates to be in line:
Parks & Recreation Community Pool Fee Schedule
Swim and Water Aerobics Fees
Water Aerobics Swim Classes

$5 daily class fee
Resident participants who attend all required classes (perfect attendance) are entitled to a $30 refund
upon request. Request for refund must be made in writing at least seven (7) days after the last class
date. Refunds may take approximately 4-6 weeks to be processed.
Special Events Fee Schedule
The City of South Miami Parks and Recreation Department is responsible for setting up the portable
stage, extensions and attaching stairs. The Department has received several requests for the use of the
City's stage for non-City related events in the past year. City resources, including staff, vehicles and time
are required to assemble and break-down the stage before and after an event.

7 WHEREAS, the proposed changes are set forth in the attached Schedule of Fees and
8 Fines and the text that is highlighted in yellow is for tracking purposes only and shall be deleted
9 when the ordinance is enacted after second reading; and
10 WHEREAS, the Mayor and City Commission desire to revise the adopted Fee Schedule
11 allowing funding which will cover the cost of services provided.
12 NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE CITY COMMISSION OF
13 THE CITY OF SOUTH MIAMI, FLORIDA, THAT:
14 Section 1. The Schedule of Fines and Fees, as approved in Ordinance 22-14-2200, is
15 hereby amended so as to increase some fees, adding new fees, and deleting some fees from
16 the schedule all as set forth on the attached Schedules taken from the 2014 Schedule of Fees
17 and Fines. The 2014 Schedules that are not included in the attachment to this ordinance shall
18 remain in full force and effect and shall be included in this ordinance. Upon enactment the text
19 highlighted in yellow that was used for tracking amendments to the schedule at first and
20 second reading as well as all text with a line striking through it and the amounts found in the
21 columns labelled "Current" and "1st Reading" shall be deleted from the schedules.

23 Section 2. Any such fees may be waived or reduced by the Mayor and City Commission
24 by way of resolution.

26 Section 3. Severability. If any section, clause, sentence, or phrase of this ordinance is
27 for any reason held invalid or unconstitutional by a court of competent jurisdiction, this holding
28 shall not affect the validity ofthe remaining portions of this ordinance.

30 Section 4. Ordinances in Conflict. All ordinances or parts of ordinances and all sections
31 and parts of sections of ordinances in direct conflict herewith are hereby repealed.
32 Section S. Effective Date. This ordinance shall become effective upon enactment.

When traveling, kids
should wear seat belts
or be in car seats

F ormally, buckling
up in a vehicle is
second nature.
Open the door, sit
down, start the car and
buckle your seat belt.
But according to the
National Highway Traffic
Safety Administration, in
the United States in 2014,
9,385 peopJe lost their
lives as a result of not
completing this simple,
essential step.
That's why local law
enforcement agencies will
join the adm.inistration
May 23 to JWle 5 in the
national Click It or Ticket
enforcement campaign.
This enforcement period
comes ahead of the Me~
morial Day holiday, one
of the busiest travel week~
ends of the year.
While 88.5 percent of
passenger vehicle occu-
pants buckled up in 2015,
almost 50 percent of oc~
cupants of fatal crashes
nationwide are not re~
strained, according to the
administration,
Many believe that driv~
ing in large vehicles,
trucks or SUVs offers
greater protection during
a vehicle crash. Sadly, this
is not the case.
According to NHTSA,
61 percent of pickup truck
occupants who were killed
in crashes were not buck-
led up. That's compared
to 42 percent of passenger
car occupants who were
killed while not wearing
their seat belts. Addition-
ally, men and young
adults are more likely to
not wear seat belts.

still not properly re-
strained, so let's review
what the recommenda-
tions are for children in
vehicles:
• Under 12 months:
Your child under age 1
should always ride in a
rear-facing car seat. There
are different types of
rear-facing car seats: In~
fant-only seats can only
be used rear-facing. Con-
vertible and 3-in-l car
seats typically have higher
height and weight limits
for the rear~facing posi~
tion, allowing you to keep
your child rear-facing for
a longer period of time. A
rear~facing car seat is
best for your young child
to use. It has a harness
and in a crash, cradles
and moves with your child
to reduce the stress to the
child's fragile neck and
spinal cord.
.1 to 3 Years: Your
child should remain in a
rear-facing car seat until
he or she reaches the top
height or weight limit
allowed by your car seat's
manufacturer. Once your
child ontgrows the rear-
facing car seat, he or she
is ready to travel in a
forward-facing car seat
with a harness. A for-
ward~facing car seat has
a harness and tether that
limits your child's forward
movem€,:nt during a crash,

your child in a forward-
facing car seat with a
harness until he or she
reaches the top height or
weight limit allowed by
your car set's manufac~
ture, Once your child
outgrows the forward-
facing car seat, it's time
to travel in a booster seat
but still in the back seat .

your child in a booster
seat wltil he or she is big
enough to fit in a seat belt
properly. For a seat belt to
fit properly the lap belt
must lie snugly across the
upper thighs, not the
stomach. The shoulder
belt should lie snug across
the shoulder and chest
and not cross the neck or
face. Remember: Your
child should still ride in
'the back seat because it's
safer there. A booster
seat positions the seat
belt so that it fits properly
over the stronger parts of
your child's body.
