Ord No 35-16-2268ORDINANCE NO.35-16-2268 An Ordinance amending Chapter 2,Article I,Section 2-2.1(M)of the Code of Ordinances,to modify the procedure for prior City Attorney approval of all resolutions,ordinances and other documents before inclusion on the Commission agenda. WHEREAS,theCitydesirestoamend Chapter 2,Section 2-2.1(M)of theCode of Ordinances to clarify the language thatexistsinthecodenow,which is confusing;and WHEREAS,beforeaCity Manager,anyCity Manager,putsan item onthe agenda,it should firstbe reviewed bytheCity Attorney,andthe City Attorney should be given a reasonable amount of time to review the item in light of allthe work that is being asked of him or her;and WHEREAS,the City desires to have the most expeditious path to approval asis possible for items needing City Attorney approval,while not sacrificing quality review for legal sufficiency andform. NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1.Chapter 2,Article I,Sections Section 2-2.1(M)of the Code of Ordinances,City of South Miami,Florida,ishereby amended andshallreadasfollows: Sec.2-2.1.-Rules of procedure of Ceity Ceommission. Thefollowingrules of procedureshallgovernallmeetings of theCeity Ceommission,namely: **** (M)ORDINANCES,RESOLUTIONS,MOTIONS AND CONTRACT. (1)Preparation and presentation of ordinances and resolutions. **** (2)Prior approval by administrative staff of agenda items by City Attorney.All ordinances,resolutions,and contract documents shall,before presentation tothecommission,havetheapprovalbe reviewed bytheCity AttorneyastoformandlegalitybythecityattorneypriortotheCityManager including them on an agenda for action by the City Commission.However,if afterreasonable efforts,theCityManagerisunabletotransmitacopy of the itemtotheCityAttorney,orif,afterareasonabletimehaspassedsincedelivery of the item to the City Attorney,the City Attorney is unable to communicate his et4as authorized representative,andshallhavebeenapprovalorthereasonsfor his disapproval of the item,theCity Manager may addthe item tothe agenda withanexplanationastowhytheitemhasnotbeenexaminedandapprovedby theCity Attorney for administration bythecity manager orhisauthorized representative,where there are substantive matters of administration involved. Provided,however,that if approvalisnotgiven,thenthecitymanagershallso Page1 of2 Ord.No.35-16-2268 advisethe commission andgivethereasonsadvancedbythecitymangerfor withholdingapproval.Noordinances,resolutions,orcontractshallbecome effective or enforceable unless it has been endorsed by the City Attorney as being approved astoformandlegality. **** Section 2.Codification.The provisions of this ordinance shall become andbe made a part of the Code of Ordinances of the City of South Miami as amended. Section 3.Severability.If any section,clause,sentence,or phrase of this ordinance isfor any reason held invalid or unconstitutional bya court of competent jurisdiction,this holding shallnotaffectthe validity of the remaining portions of this ordinance. Section 4.Ordinances in Conflict.All ordinances or parts of ordinances and allsectionsandparts of sections of ordinancesindirect conflict herewith arehereby repealed. Section 5. enactment. Effective Date.This ordinance shall become effective upon PASSED AND ENACTED this6 th day of December 2016.
