Ord No 34-16-2267ORDINANCE NO.34-16-2267 An Ordinance amending the City of South Miami Land Development Article VI,Section 20-6.1(B)(4)(a)iiito provide fora recommendation of the Planning Board when the Board is deadlocked. WHEREAS,the City's LandDevelopmentCodeusuallyrequiresthatan application mustreceivea recommendation fromtheCity'sPlanningBoardbeforethe applicationmaybeapprovedbytheCityCommission;and WHEREAS,theCitymaydesiretoreducethequorumneededbythePlanning Board from five members to four members;and WHEREAS,the Planning Board maybe deadlocked if the number of members necessary fora quorum isanevennumberoreven if the quorum isanoddnumber,a deadlock may occur when the number of member's present issix;and WHEREAS,section 20-6.1(B)(4)(a)iiidoes provide that,astoallitems that go before Planning Board,theBoardshall transmit its recommendation totheCity Commission within 45daysand that if the Board has not reached a decision onthe item before the expiration of such 45-day time period,then the item shallbe transmitted forthwith to the City Commission with a "No Comment"recommendation.Even if this provision canbe interpreted to include a situation when the Board is deadlocked,it would delay the transmittal to the City Commission by45days. WHEREAS,the Planning Board has,orwillhave,reviewed this proposed ordinance before the enactment of this ordinance. NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1.Article VI,titled "ADMINISTRATION AND ENFORCEMENT", Section 20-6.1(B)(4)(a)iii of theCity of South Miami's Land Development Codeis hereby amended and shall read as follows: 20-6.1 -Administrative entities. *** (B)Planning Board. *** (4)Procedures. (a)Quorum and voting. i.A quorum shall befive(5)members. ii.Amajorityvote of thememberspresentshallberequiredtopassuponany matter onwhichthe board is required toactunderthisCode. iii.Recommendations on all items before the Bboard shall be transmitted to theCeity Ceommission within forty-five(45)calendar days of thetimethattheitemfirst Page 1 of2 Ord.No.34-16-2267 appearsonaregularlyscheduledBboardagenda.If theBboardhasnotreachedadecision ontheitembeforeitduringsaidforty-five(45)dayperiod,or if the Board has reviewed theapplicationandisdeadlocked,thentheitemshallbetransmittedforthwithtothe Ceity Ceommission with a "No Comment"recommendation. *** Section 2.Codification.The provisions of this ordinance shall become and bemadepart of theCode of Ordinances of theCity of SouthMiamiasamended. Section 3.Severability.If anysection,clause,sentence,or phrase of this ordinance isforany reason held invalid or unconstitutional bya court of competent jurisdiction,this holding shallnotaffectthe validity of the remaining portions of this ordinance orthe Guidelines adopted hereunder. Section 4.Ordinances in Conflict.All ordinances or parts of ordinances and allsectionsandparts of sections of ordinances indirect conflict herewith arehereby repealed. Section 5 enactment.
