Ord No 33-16-2266ORDINANCE NO.33-16-2266 An Ordinance amending Chapter 2,Article I,Section 2-2.1 (B),(C)and (C)1 and 2 of the City of South Miami's Code of Ordinances,to modify the capitalization of key words and to add requirements for Sunshine Meetings. WHEREAS,inthepast,twoor more Commissioners have held a Sunshine meeting but the notice of that meeting was never senttoall of theCity Commission members;and WHEREAS,the City Commission desires to amend Chapter 2,Article I,Section 2-2.1 (B),(C)and(C)1and2 of theCode of Ordinances to modify the capitalization of key words andtoadd requirements for Sunshine Meetings in order to require more notice to the entire commission. NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1.Chapter 2,Article I,Section 2-2.1 (B),(C)and(C)1 and 2 of the Code of Ordinances of the City of South Miami,Florida,are hereby amended and shall read as follows: Sec.2-2.1.-Rules of procedure of Ceity Ceommission. The following rules of procedure shall govern all meetings of the Ceity Ceommission,namely: B)SPECIAL MEETING;WORKSHOP MEETING and SUNSHINE MEETINGS.A special meeting,sunshine meeting (a meeting of two or more members of the City Commission to discuss any matter that may foreseeably comebeforethe Commission foraction)ora workshop meeting of theCeity Ceommission maybe called bythe Mmayor whenever^inhis opinion,the public business may require it,or whenever three (3)or more members of the Ceity Ceommission request a special or workshop meeting ortwo (2)or more members of the City Commission request a sunshine meeting.Whenever a special,sunshine or workshop meeting shallbe called bythe Mmayor,a notice in writing signed bythe Mmayor shallbe served onthe Ceity Celerk, and whenever a special sunshineor workshop meeting shallbecalledby three (3)or more members of the Ceity Ceommission,notice in writing signed by such commission members shallbe served in writing upon the Ceity Celerk.The Celerk shall forthwith serve either verbal or written notice upon each member of the Ceity Ceommission,the Mmayor,the Ceity Mmanager andthe Ceity Aattorney,stating thedateand hour of the meeting, andthe purpose for which such meeting is called,andno other business shall be transacted at that meeting other than that for which the meeting was Page 1 of4 Ord.No.33-16-2266 called.The twenty-four-hour time limit may be waived in time of public emergency affecting life,health,property orsafety.The Celerk,shall insure that written notice is sent to the Mayor and all of the member of the City Commission informing them of the date,time and place of the special, sunshine or workshop meeting at least twenty-four (24)hours in advance of in the notice of a special the meeting,shall allow notless than twenty four (21)hours to elapse between thecall of the meeting andthedateand hour of the meeting.A copy of said notice istobe posted ina prominent and conspicuous place atinthe Ceity Hhall notless than twenty-four (24)hours prior to such meeting.The minutes of each special,sunshine or workshop meeting shall show include the manner and method by which notice of such special,sunshine or workshop meeting was given,or shall show a state the reason why the notice wasnotgivenas required bythis section.waiver of notice.All special,sunshine or workshop meetings shallbe open tothe public and shall be held atinthe Ceity Hhall.For the purposes of this paragraph,the leaving of a copy of the written notice atthe residence of the Mmayor orany commissioner shall constitute service of written notice on such mayor and commissioner.All written notices thatare required bythis section tobesent maybe sent inanyform of communication that appears in text format,such asan email,and that canbe printed. (C)AGENDA.There shall bean official agenda for every meeting of the Ceommission which shall determine the order of business conducted at the meeting.The Ceommission shallnottake action upon anyitem,matter or business (city business)which isnot listed upon the official agenda without approval of at least three (3)commission members present at such regular meeting toadd such Ceity business tothe official agenda.The official agenda shallbe prepared bythe Celerk in appropriate form approved bythe Ceommission.City business maybe placed onthe agenda bythe Mmayor, the Ceity Mmanager,any commissioner,andthe Ceity Aettorney.A physical agenda books,if requested in writing bya member of theCity Commission,willbe prepared bythe clerk's office andwillbe placed inthe Commission's mailbox incityhall.The agenda package willalsobe uploaded intothe City's cloud server or similar electronic location andonthe City's webpage,A copy of the agenda shall be delivered to each commissioner,the mayor,thecity manager,andthecity attorney at least seventy-two (72)hours prior toany regularly scheduled meeting,and twenty- four(24)hours prior toanyspecial,sunshineor workshop meeting. Except for emergencies,noitemwillbe placed onthe agenda of a regular meeting of the commission which hasnotbeen delivered tothe Ceity Celerk by noon onthe Wednesday preceding such regular meeting,excepting as provided in this subsection 2-2.1(C). (l)Add-ons:No business shallbe conducted ata regular meeting that isnot reflected inthe official agenda unlessthe official agenda is amended or supplemented to reflect additional business ("add-on items")tobe conducted atsaid meeting ("add-on agenda")and unless the add-on agenda is posted Page 2 of4 Ord.No.33-16-2266 and delivered tothe Ceity Ceommission.The add-on agenda items must be delivered totheCeityCelerknolater thean 4:00p.m.ontheday of the meetingandmustbepostedonthe Ceity's websitenolaterthan5:00 p.m.^ and,at substantially the same time,it shall be forwarded to the members of theCeity Ceommission beforethe commencement of the relevant meetings electronically orbyany comparable means.TheCeity Celerk isfurther directedtomakesaidadd-onitem(s)availabletothepublicattheentranceto the commission chambers duringevery commission meeting.TheCeity Celerk shall atthe end of the consent agenda,readintothe record the title of any proposed add-on item(s)sought tobe placed on that agenda.Nothing hereinshallaffectthe requirement thatanyadd-onitemcanonlybeplaced onthe agenda bythe approval of the majority vote of theCeity Ceommission. (2)Workshops,sunshine andspecial meeting:NoCeity business maybe conducted ata special,sunshine or workshop meeting other than that for which this meeting was called. **** Section 2.Codification.The provisions of this ordinance shall become and be made a part of the Code of Ordinances of theCity of South Miami as amended. Section 3.Severability.If anysection,clause,sentence,or phrase of this ordinance isforany reason heldinvalidor unconstitutional byacourt of competent jurisdiction,this holding shallnotaffectthevalidity of the remaining portions of this ordinance. Section 4.Ordinances in Conflict.All ordinances orparts of ordinances and all sections and parts of sections of ordinances in direct conflict herewith are hereby repealed.
