An Ordinance amending the Land Development Code,Article VI,Section 20-6.1,and
other applicable provisions,to define the term "less restrictive"asit applies to the voting
requirements of the City Commission.
WHEREAS,theCity regulates development withinits boundaries through theLand
Development Code;and
WHEREAS,theCity Charter providesinArticleII,"City Commission,"Section 6,
"Ordinances,"Subsection D.l,"VotingProcedure,"and"RequirementsforAdoption,"that:
Except as otherwise provided inthischarter,five affirmative votes of thecity
commission shallbe required toapprovetheactionsindicatedbelow:
Toamendlanduseanddevelopmentregulationsinanymannertomakethemless
restrictive;and
WHEREAS,no definition is provided fortheterm "less restrictive;"and
WHEREAS,theLandDevelopmentCodecontainsasimilarprovisioninSection20-
6.1(AX3)(a),and similarly without a definition fortheterm "less restrictive";and
WHEREAS,theCity Commission desirestoprovideadefinitionfortheterm "less restrictive"
soastoaddcertaintytothe amendment processforlanduseand development regulations;and
WHEREAS,uponthe recommendation oftheCitystaffandprofessionalconsultants,this
amendment provides the appropriate definition;and
WHEREAS,thePlanningBoardshallreviewandmakearecommendationpriortoenactmentof
this ordinance;and
WHEREAS,theCity Commission desires toadoptthis Ordinance to accomplish the above
objectives.
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section1.SouthMiamiLand Development CodeArticleVI,"Administration and Enforcement,"
Section20-6.1,"Administrativeentities,"isherebyamendedtoreadas follows:
20-6.1 -Administrative entities.
(A)CityCommission.
(1)Establishment,membership and organization oftheeCity eCommission shallbein accordance
withtheCityCharterandtheCodeof Ordinances oftheeCity.
(2)Powers and duties.

(a)The eCity eCommission shallhaveallsuch powers and duties asaregrantedand conferred
by statelaw,the Code of Ordinances ofthe eCity andthisCode.
(b)The eCity eCommission shallprovideforthehealth,safety,convenience andgeneral
welfare of the citizens of SouthMiamithroughtheregulationscontainedinthisCode.
(c)The eCity eCommission shallreceive recommendations fromtheplanningboardandthe
environmental review andpreservationboard,andshallbeguided by suchboards.
(d)The eCity eCommission shallactincompliancewithandfurtherance of the eCity's adopted
Comprehensive Plan.
(e)The eCity eCommission may:
i.Amend theprovisions oftheadopted Comprehensive PlanandthisCode;
ii.Change zoning districtboundaries;
iii.Authorize home occupationallicenses;
iv.Grantvariancesfromtheprovisions ofthisCode;
v.Permitthe continuation of nonconforming uses;
vi.Authorize specialuses;and
vii.Makefinal judgment onappeals of administrativedecisions.
(f)TheeCityeCommissionshallhavethepowerandthedutytohearanddecidetheabove
mattersinaccordance with theprovisions of thisCode.
(3)Procedures.
(a)Voting.Allordinancesandresolutionsthatrequiremorethanonereadingforpassageor
enactment shallbepassedonfirstreadingbyamajorityvote.
(i)Exceptforthoseitemslistedin(ii)and(iii)below,notlessthanthree(3)
affirmativevotes of theeCityeCommissionshallberequiredto pass or enact an
agenda item.
(ii)With theexceptionsetforthbelowin(iii)below,four(4)affirmativevotes of the
eCityeCommissionshallbe required for final approval of achangetotheadopted
Comprehensive Plan,arezoning,a variance,aspecialuse,aspecialexception,ora
plannedunit development.
(iii)Five(5)affirmativevotes of theeCityeCommission shall be required toenactan
amendmenttolanduseanddevelopmentregulationsinanymannertomakethem
less restrictive.Anamendmentis"lessrestrictive"if anyone of thefollowing
occurs:
(a)theamendment increases density,intensity,floor area ratioorbuildingheight:
(b)theamendmentallowslessersetbacksorbuilding separation requirements;
(c)theamendmentallows greater buildingcoverageorimperviouscoveragethan
the maximum,orless coverage thanthe minimum,allowedbyexisting
regulations:
(d)the amendment addsausetoa zoning district that hasa higher intensity than
any of the existing uses.The intensity of auseshallbe determined by

projectedtripgeneration rates,assetforthintheInstitute of Transportation
Engineers.Trip Generation Manual,last amended edition:
(e)the City Commission determines by three (3)affirmative votes that a proposed
amendment that isnot covered by subparagraphs (a)through (d)above-be
treated as less restrictive:
(iv)An amendment is not less restrictive if it decreases density,intensity,floor area
ratioor building height,if itrequiresgreater setbacks or building separation
requirements,if itprovidesforlessbuildingcoverageorlot coverage,or if itaddsa
usetoa zoning districtthathasthesameoralower intensity thanany of theexisting
uses.The intensity of auseshallbe determined by projected trip generation rates,as
set forth inthe Institute of Transportation Engineers.Trip Generation Manual,last
amended edition:
(b)Public Hearings.
i.The eCity eCommission shallholdpublichearingswhen amending theadopted
Comprehensive Plan,amending thetext of thisCode,rezoning,approving special
uses,approving special exceptions,granting variances and permitting nonconforming
uses.All other itemsshallnot require a public hearing for commission action.
ii.Actions uponsite plans,variances,administrative appeals,planned unit developments,
nonconforming uses,special exceptions and special uses shall beby resolution.All
other actions shallbeby ordinance.
(c)The eCity eCommission maydeferactiononany application or other matter before it,for
cause,fora reasonable period of time.
(d)The eCity eCommission may refer a matter backtothe planning board orthe
environmental review and preservation board for further consideration and
recommendation.
(e)Whenany request requiring apublichearingbeforethe planning boardhasbeenacted
uponbythe commission anddeniedorfailedtopass,such proposed change,inthesameor
similar formshallnotbe reconsidered bythe commission fora period of atleastone(1)
year following thedate of suchactionexceptinwhichcase reconsideration is possible after
six(6)monthsfromthedate established forthepriorhearingatthe request of themajority
of the commission.
(f)Financial Interest.
i.Any member of the eCity eCommission whohasaspecialfinancialinterest,director
indirect,inany matter shallmakethat interest known andshall abstain from
participation therein inanymanner.
ii.Willful failure to disclose such financial interest shall constitute malfeasance in office
andshall render theaction voidable bythecity commission.

Section 2.Codification.Theprovisions of thisordinanceshallbecomeandbemadepart of the
Land Development Code of the City of South Miami as amended.
Section3.Severability.If anysection,clause,sentence,orphrase of thisordinanceisforany
reasonheldinvalidorunconstitutionalbyacourt of competent jurisdiction,thisholdingshallnotaffect
thevalidity of theremainingportions of thisordinanceortheGuidelinesadoptedhereunder.

Section 4.Ordinances in Conflict.All ordinances orparts of ordinances andall sections andparts
of sections of ordinances in direct conflict herewith arehereby repealed.
Section 5.Effective Date.This ordinance shall become effective upon enactment.

Background:
TheCity regulates land use and development within its boundaries through the City's
Comprehensive Plan and Land Development Code.The City Charter provides in Article II,"City
Commission/'Section 6,"Ordinances,"Subsection D.l,"Voting Procedure/'and "Requirements
for Adoption/'that:
"Exceptas otherwise provided inthis charter,five affirmative votes of the city
commission shall be required to approve the actions indicated below:
To amend land use and development regulations inany manner to make them less
restrictive!.]"
TheLand Development Code contains asimilarprovisionin Section 20-6.1(A)(3)(a),yet neither
document contains a definition for the term "less restrictive".
Analysis:
Without a definition of "less restrictive",the determination of whether a particular amendment
requires a unanimous vote may be subject to conflicting opinions and interpretations.The
proposed Ordinance provides an appropriate and objective definition that willadd certainty to
future amendments to the landuseand development regulations.

Section 20-6.1(A)(3)(a)would be amended to read as follows:
(3)Procedures.

Planning Board Recommendation:
Afterreviewingandholdingapublic hearing on the itemon September 13,2016,the Planning
Board recommended approval of the ordinance bya vote of5ayes to 1nay.The motion also
included an urgent recommendation that the Commission reconsider the five vote requirement
in the charter at some point in the future.
Recommendation:
TheCity Commission approved the ordinance onfirst reading on August 2,2016.Since that
time,staff has refined the wording (as indicated above by the highlighted text)and removed a
paragraph regarding amendments that pertain to two or more lots.Itis recommended that the
City Commission approve the revised ordinance on second reading.

Ms.Glavey stated that she agrees with the comments made byMr.Greiner and that thistypeof
change should during the process of amending the LDC andCompPlan.Mr.Pepe stated the
five-fifth vote is currently in the City's Charter aswell and requires a referendum vote to change
the requirement.He then stated that one of the commissioners tried to get the item on the
ballot but was unable todoso.Because of that,you can't change the LDC without changing the
Charter.
Ms.Glavey asked if there has been a problem with disputes regarding less-restrictive items,of
which Mr.Held stated yes.
Ms.Fischer asked Mr.Held who directed himto work on this item.Mr.Held responded that he
works at the request of the either the City Manager or the City Manager.Mr.Pepe stated that
you have to look back at who sponsored the item.

Ms.Fischer then stated that the language in the proposed ordinance was extraneous andwas
not necessary.She then suggested that the item be tabeled so that it could befully reviewed.
