Background: On October 2,2001,the City Commission adopted Ordinance #24-01-1755 which changed the official zoning map for the property located at6001SW70 Street,identified as the Valencia Condominium Building,from"MO"Medium Intensity Officeto 'TODD MU-5"Transit Oriented Development District MixedUse-5.As part of the approval,itwasspecifically designated that all commercial space on the first floor ofthe building facing SW 59th Place was limited to retail usesassetforthinthe city's Permitted Use Schedule. Due to constant vacancies in the commercial space,the City adopted Ordinance #06-10-2031 on February2,2010.Ordinance #06-10-2031 amended the siteplanfor the Valencia Condominium building andallowedretailuses,office,business and personal services as set forthin the Permitted Use Schedule tooccupy the commercial space,provided that eachoffice,business and personal services useis approved via the SpecialUse Permit process as set forthin Section 20-5.8of the Land Development Code (LDC).Because the applicant,Larkin CommunityHospital,isproposingto open an"Office: Business/Professional"useat the ValenciaCondominiumbuilding,itis required that the itembe reviewed under the Special Use Permit process. Special Use Approval After review of the project,the proposed officeuse complies with the general requirements listedin Section 20-3.4(A)of the LDC in that the proposed use: •Complies with all requirements established in the TODDMU-5 zoning district; •Is compatible and complementary to the existing uses within the surrounding areas; Furthermore,the requested specialusedoes not conflict with the Comprehensive Planand complies with the LDC requirements set forth in Section 20-5.8(B)of the LDC in that the use: a.Will not adversely affect the health or safety of persons residing or working in the vicinity of the proposed use, b.Will not be detrimental to the public welfare or property or improvements in the neighborhood; and, c.Complies with all other applicable Code provisions. He stated that office uses shouldn't beas restrictive as retail uses.Staff responded that based on the parking conditions listedin the LDC;officetypeusesaremorerestrictive than retailuses. He then asked if the Metrorail parkingwas ever counted in the parking calculations for the Valencia Building.Mr.Lightfoot responded that he would have to check to see. Mr.Greiner expressed his concern over the fact that ause that is normally permitted by right in the TODD MU-5zoning district requires aspecialuse approval.Mr.Held responded that this ordinance isnot codified,but istied to the development agreement for the Valenciabuilding.
