A Resolution approving a variance of both the front setback and the side interior

WHEREAS,Mr.RamonLastrasubmittedan application(number PB-16-025)requesting two
variances from Section 20-3.5E of theLand Development Code(LDC)to construct an addition ontoan
existing residential structure within theRS-3 Zoning District at7400SW64 Court;and
WHEREAS,thefirst variance request isto allow the reduction of thefront setback from twenty-
five(25)feetto eighteen feet two inches (18'2");and
WHEREAS,the second variance request istoallowthe reduction of theside interior setback
from seven feetsix inches (7'6")tofivefeet (5');and
WHEREAS,the approval of a variance requiresa review bythe Planning Boardanda
recommendation toapprove,denyorapprovewith conditions,aswellasthe approval of theCity
Commission after a public hearing;and
WHEREAS,atits September 13,2016 meeting,the Planning Board held a public hearing onthe
application,considered each of the variance criterion listedin Section 20-5.9 of theLDCand voted
unanimouslyto recommend approval of thevariancesrequested;and
WHEREAS,the Mayor andCity Commission of theCity of SouthMiami,having considered
each of thevariancecriterionlistedinSection20-5.9 of theLDCandhavingfoundthatthoseconditions
havebeenmet,desireto approve theapplicationforthevariance.
NOW THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF SOUTH MIAMI,FLORIDA THAT:
Section 1.Therecitalssetforthinthisresolutionaretrueandtheyaresupportedbycompetent
substantialevidenceandtheyareincorporatedintothisresolutionbyreferenceas if setforthinfull
herein.
Section 2.The application (numberPB-16-025)submittedbyMr.Ramon Lastra requestinga
frontsetback of eighteenfeettwoinches (18'2"),wheretwenty-fivefeet (25')isrequired,andaside

Background:
Located in the Medium Lot Single-Family Residential "RS-3"zoning district,the applicant is
proposing to expand their existing one-story residential structure in order to accommodate a
new master bedroom and kitchen area on the property.Because of the placement of the
structure and the surrounding trees on the property,the applicant has requested a variance of
both the front and side interior setback requirement in order to accomplish this goal.

Mr.RamonLastra,owner of the subject property,is requesting approval through Variance
Approvals,Section20-5.9(G)(l)of the Land Development Code (LDC)oftwovariances:(1)to

reduce the minimum front setback for the RS-3 zoning district from25 feet to 18'-2";and (2)to
reduce the minimum side interior setback from 7'-6"to 5 feet.
Analysis:
Pursuant to Section 20-5.9 of the LDC,a variance foryard setbacks canbe reviewed and
permitted by the City Commission atapublic hearing,after a recommendation by the Planning
Board.
When reviewing the project,the following items are noted about the project:
•As indicated on the attached Location Sketch,the subject property isa corner lot
property witha one-story single family residence that was constructed in the early 1950's
aswellasa one-story accessory structure at the rear of the property.The "L"shaped
single family residence is positioned insuchaway that itis angled,allowing for the front
entrance tobe viewed from the intersection ofSW 64th CourtandSW 74th Street
•As indicated on the attached Existing Landscape/Demo FloorPlan,sheet A-l,there are
approximately eighteen (18)shade trees on the property that surround the single family
residence.
•In order to preserve the existing tree canopy on the site,the owner has elected to work
around the constraint by designing the proposed addition so that itis located at the front
of the residence.By accomplishing this,the proposed SitePlan,sheet S-l,shows that
approximately 114 square feet will encroach into the front setback area and
approximately 8 square feet will encroach into the side interior setback area.These
encroachments are for the proposed master bedroom only.The owner isalso proposing
to expand the kitchen area by approximately 76 square feet;the kitchen expansion does
not encroach into anyof the required setback areas.Finally,the owner is proposing to
renovate the existing wooden deck that is adjacent to the street so that itisin
compliance with Section 20-3.6(B)(7)of the LDC whichallows wooden decks to project
into required setbacks and extend uptofive(5)feet from property lines.The wooden
deckon the south sideof the house isfive(5)feet from the property lineand therefore
complies with the Code.
•Pursuant to the attached LocationSketch,the property is approximately 11,500 square
feet,which exceeds the minimum lotsize requirement of 10,000 square feet for the RS-3
zoning district,per Section 20-3.5(E)of the LDC.
•The table below details the proposed coverages for the project and their compliance with
the RS-3 Dimensional Requirements outlined in Section 20-3.5(E)of the LDC.

As indicated in the table above,the project will not meet the minimum front or side
interior setback requirement for the RS-3 zoning district.Because of that,the applicant
is requesting a front setback variance of approximately 6'-10"and a side interior setback
variance of 2'-6".
Pursuant to Section 20-5.9(H)of the Land Development Code,all variance decisions shallbe
based onan affirmative findingasto each of the following criterion:
1.The variance is necessary to relieve particular extraordinary conditions relating to a
specific property;
Dueto the positioning of the singlefamily residence on.the property,the areas available
on the sideof the structure are limited without encroachment into the required setback
areas.In order for the proposed addition to be placed at the rear of the property,the
interior room layout of the bungalow styled structure would need to be reconfigured in
order to accommodate the addition.Furthermore several specimen trees are located
throughout the site.Their extensive root systems further limit the potential locations
where the addition could be proposed without removing the trees.
2.Denial of the variance would result in hardship to the owner.Hardship results if the
restriction of the zoning ordinance,when applied to aparticular property,becomes
arbitrary,confiscatory or unduly oppressive because of conditions of the property that
distinguish it from other properties under similar zoning restrictions;
Applicationof the setback requirements might require a reconfiguration of the interior
spaces within the singlefamily structure and removal of several specimen trees.
However,smaller additions couldbe constructed in the proposed locations andstill
comply with the setback requirements.

3.The extraordinary conditions and circumstances do not result from the actions of the
applicant;
Because the residence wasbuiltin the early 1950's,the positioning of the residence was
not the result of the actions of the owner.
4.The requested variance is the minimum variance necessary to make possible the
reasonable use of the land,building or structure;
Even though the positioning of the house and the locationof two specimen trees make
expansion challenging,the house canbe expanded in such away that the setback
requirements are satisfied.Thus,the requested variances are not the minimum
necessary to make possible the reasonable use of the land,building or structure.
5.That the approval of the variance will be consistent with the general intent and
purpose of the Land Development Code,and will not be injurious to the neighborhood
or otherwise detrimental to the public welfare.
Because the owner is proposing to preserve the existing tree canopy on the property,a
majority of the proposed addition willbe shielded fromviewof the adjacent right-of-
way.Furthermore,the applicant has provided letters of support from nearby residents
which have been attached.Other than the Front andSide Interior Setback,the proposed
project isin compliance with the dimensional requirements for the RS-3 zoning district.
Therefore,the approval of the variance would not be injurious to the neighborhood or
detrimental to the public welfare.Additionally,the variance is consistent with the
general intent and purpose of the LandDevelopment Code.
Planning Board Recommendation:
The Planning Board reviewed the application ata Public Hearing on September 13,2016 and
unanimously recommended approval
Recommendation:
Itis recommended that the City Commission deny the variance application.

addition will haveaslight encroachment onthefrontandsidesetbacksofourproperty.

We are the homeowners of the property located at 7400 sw64 court,in South Miami.We reside at this
address and are requesting a variance to the Front and Interior Side setbacks required for our property
to allow for the addition ofa master bedroom to the front of the home.The site and existing horne have
a number of conditions which restrict the locations for a functional addition and require our request for
a variance to accommodate the addition.We are considering this addition inlieu of rebuilding the home
inan effort to maintain the single story bungalowstyleand character of the home and maintain the
heavily landscaped nature of the surrounding neighborhood.
Theexisting home,built in 1951,is set onan angle on the site relative to the property lines.This
positioning of the home limits the available areas on the sideof building for the addition without
encroachment on the required setbacks.The property isa corner lot requiring an additionally deep
setback distances on the street sideof the property further limitingthelocationof the addition.The
interior room layout of the home is programmed such that an addition to the rearof the home would
require the replacement of the existing bedroom(s)toallow access to the rearof the home.These
limitations created by the existing structure limit the abilitytoaddto the existing home without
encroaching on the required setbacks.
In addition,the property hasasignificant number of specimen sized trees (greater than 2'in diameter
trunksand/or mature growth structures /trees)throughout thesite.Thelocationof these trees and
their extensive root systems further limitthe potential locations where the additioncouldbe proposed
without removaloflong growth landscape.
As the homesitsonanangleto the propertylines,theproposed encroachment on the frontand side
setbacksare the corners of the proposed addition,nottheentireside encroaching on the setback.The
frontsetbackis requested tobereducedfrom25'-0"to18'-2",aNowing fora full depth parkingareain
frontoftheaddition.The interior sidesetbackisproposedtobe reduced fromtherequired7'-6"
minimum setback to 5'-0".The total aggregatesidesetbacks .(interior and street side combined)of not

Dear Neighbor,
We are residents of South Miami,planning to doan addition to our house.We are both architects and
renovated the 1951Bungalow house when we purchasedit11yearsago.Having outgrown the house a
bit,we are now in need of expanding andourproposedplanwillrequireaVariancefrom the Cityof
South Miami.
Our variance application proposes a one story addition at the front of the house.Inan effort to
maintain the integrity of the original house and the mature trees surrounding it,ourareasfor expansion
are limited.Because the original house was set atanangle to the property lines,three comers of the
addition will have aslight encroachment on the frontandside setbacks of our property.We are
required by the Cityof South Miamito notify youofour proposed application foravariance.
The addition is intended tobe sensitive to the characterof the neighborhood and appropriate for the
scale of the existing house,itis our understanding that youwill be receiving additional information
from the City of South Miami regarding our variance request.
