ORDINANCE NO.26~1 6"2259 An Ordinance Amendingthe Official Zoning Map,as authorized by Section 20-3.1(C),andother applicable provisions,amending the designation ofthe Marshall Williamson property located south of SW 64th Terrace approximately between SW 60th Avenue and SW 61st Court,from Single-Family Residential District RS-4toRT-9. WHEREAS,the City of South Miami has prepared anamendmenttothe Official Zoning Map to change the designation ofthe approximately .85 acre Marshall Williamson property located southof SW 64th Terrace between SW 60th Avenue and SW 61st Court from Single-Family Residential RS-4 to RT-9; and WHEREAS,the Local Planning Agency hasreviewedtheproposed amendment tothe Official Zoning Map,and ithas held an advertised public hearing and provided for public participation in the processandrendereditsrecommendationof approval tothe City Commission onavoteof5-1. NOW,THEREFORE,BEITORDAINEDBY THE MAYORANDCITYCOMMISSIONOF THE CITY OF SOUTH MIAMI,FLORIDA AS FOLLOWS: Section 1.The City of South Miami hereby adopts an amendment tothe Official Zoning Map changing the designation forthe Marshall Williamson property,located southof SW 64th Terrace approximately between SW 60th Avenue and SW 61st Court,from Single-Family Residential District RS-4 to RT-9.A copy ofthepertinentpartofthe Map is attachedheretoandmadeaparthereofas Exhibit "A". Background: The South Miami Community Redevelopment Agency (CRA)owns three (3)parcels of property onthe south sideof SW 64th Terrace between SW 61st CourtandSW 60th Avenue.Known asthe Marshall Williamson property,the three lots total approximately one (1)acre,are zoned Single- FamilyRS-4 and are undeveloped.Only one of the lots,folio number 09-4025-000-0850,has been assigned astreet address,6488 SW 60Lh Avenue.This is also the largest ofthethree parcels at 35,512 square feet.The other folios are 09-4025-065-0090 and 09-4025-000-0852. The CRA requests that the zoning be changed to Two-Family/Townhouse Residential RT-9.Itis important to note that earlier attempts to change the zoning have been unsuccessful,including a2015 application forLow Density Multi-Family Residential RM-18. This districtisappropriateinareas designated 'Two-Family/Townhouse Residentiar onthecity's adopted ComprehensivePlan. Mr.Basuaskedifthis item was reviewed by the Board before.Mrs.Tompkins explained that this item camebefore the BoardlastyearbutwasdisapprovedbyCity Commission. Dr.Philips askedif there wasaneedforaUnityofTitlefor the project.Mrs.Tompkins stated that the applicant would need to submit aUnity of Title with development plansfor the project. Mr.Greiner stated that the purpose is to rezone the property so that town houses could bebuilt on the property.This item isn't a development plan. Mr.Basu asked if the item that came before the Board was for multi-family residential.Mrs. Tompkins explained that the item that came before the Boardlastyearwas to have the property rezoned to RM-18,which meant 18unitsperacre.The item currently before the Board was to rezone the property toRT-9,which meant 9 units peracre.Mr.Pepe added that there appears to be consensus among all of the commissioners.He then stated that because this item is considered tobelessrestrictive,a vote of approvalfromeach of the 5 commissioners would be needed for this item to pass.. Dr.Philips askedifthefrontagewouldbe applicable foratwo-familyhouse.Mr.David explained to the Board that a conceptual schematic was presented toCRABoard.Basedon that schematic, the CRABoard endorsed the request before the Board.Mr.Basu added that the reason why the frontage requirement is not applicable in the RT-9 zoning district because townhouses are supposed to bebuiltin the district,not two-family homes.Two-family homes are not applicable in the RT-9 zoning district. Ms.Glaveyaskedif the Boardwouldsee the designatany other pointonce the zoninghas been approved.Mr.Pepe stated no.It would then be reviewed by the Environmental Review & Preservation Board. Ms.Fischer asked why the CRA wants to buildon the property.Mr.David stated that when the South MiamiCRA purchased the property,itwas always the intent to buildonitin order to satisfy the need for affordable workforce housing. Dr.Philipsasked how many townhouses would bebuilton the property.Mr.David stated that while there isno approved siteplanfor the project,they are proposing eight (8)townhomes on the site. Ms.Fischer askedif this project is proposed tobe done as part of the Madison Square project. Mr.David responded to Ms.Fischer's question by providing the Board with aplanfor the entire Madison Square project. Ms.Fischeraskedwhyitis necessary to have60unitsfora project.Mr.David stated itisnot financiallyfeasibleto develop a property forless than 60units.Ms.Glavey elaborated onMr. David's statement and added that it was a requirement of the banks.Last,Mr.Pepe added that the more units that are built,the cheaper itistobuild them.
