An Ordinance of the Mayor and City Commission of the City of South Miami amending
the Land Development Code,Article III,"Zoning Regulations,"Section 20-3.5,
"Dimensional Requirements,"to amend and clarify the setback requirements for side
street first and second story facades of structures on corner lots,and for side interior
setbacks for additions to structures with a five foot setback,in the RS-1,RS-2,RS-3T
RS-4 and RS-5 zoning districts;and Section 20-3.6,"Supplemental Regulations,"
subsection (F)(4),to correct the title of the director responsible for determining which
streets are frontage and side streets.
WHEREAS,the development of corner lots with respect to which are the front or side streets of
the lot are sometimes confusing;and
WHEREAS,the Land Development Code provides in Section 20-3.6(F)(4)that "In determining
which streets are the frontage and side streets,the director of building and zoning shall be guided by the
existing development pattern[;]"and
WHEREAS,the present setbacks in the RS-1 through RS-53 districts do not have a category
called Second Story Side Street Setback;and
WHEREAS,in the RS-27 and RS-3-zoning districts,in Section 20-3.5E for one story structures,
and in Section 20-3.5H fortwo story structures,the Side Street Setback (forboth the 1st and 2ndfloors)
is 15 feet;and
WHEREAS,for interior lotsin single family residential zoning districts,in Section 20-3.5H,Table
1,the Side Setback (not the Side Street Setback)ranges from7.5to10feet,and the 2nd Story Side
Setback ranges from 7.5 to 15 feet;and
WHEREAS,there may bealonglineof houses on non-corner lotsin the single familyzoning
districts observing 25feet,or more,front setbacks andatthe end of the street maybe erected a house
witha 15 feet setback (either builtwith one ortwo stories)that gives the appearance likeitisstickingout
from the setback line that the rest of the houses have to observe,likea "sore thumb;"and
WHEREAS,the South Miami Commission desires to create the requirement for "Second Story
Side Street Setback,"and establish for corner lotsthecriteriaof25feetintheRS1 through RS4 RS3
categories and 20 feet in the RS5 category as the distance that the side second story facade must be set
back from the property lineof the loton the street declared as the side street,and desires to further
create the requirement First Floor Side Street Setback,with the criteria of 20 feet as the distance the side
first story facade must be set back fromthe property lineof the loton the street declared as the side
street,forboth one andtwostory structures inRS-2and RS-3,except inRS-5.whichmayremainat 15
feet because of the 50 feet wide lots;and
WHEREAS,the Planning Boardreviewedthis ordinance onJuly21,2016 and recommended
denial bya vote of 5to 1.
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE
CITY OF SOUTH MIAMI,FLORIDA:
Section 1.Article III,"ZoningRegulations,"Section20-3.5,"Dimensional Requirements,"ofthe
Land Development Code,Cityof South Miami,Florida,is hereby amended andshallread as follows:

20-3.5 Sec.-Dimensional requirements.
(A)Residential Districts.In residential districts,the maximum density,minimumlot area and frontage,
minimumyard setbacks,maximum coverage and maximum building heights for the permitted uses in
each district shall be determined from the Dimensional Requirements Table for either single-family
residential districts one-story (Section 20-3.5(E))or single-family residential districts two-story
(Section 20-3.5(H))or multi-family districts (Section 20-3.5(F)).
(B)Nonresidential Districts.In nonresidential districts,theminimumlot area and frontage,minimumyard
setbacks,maximum floor area,maximum coverage and maximum building heights for permitted
uses in each district shall be determined from the Dimensional Requirements Table for
nonresidential districts (Section 20-3.5(G)).
(C)Dimensional Requirement Tables.
(1)The use of land and the erection of buildings and other structures on land shall be subject to the
dimensional requirements of the applicable zoning district,as reflected on the four tables
labeled "Dimensional Requirements,Single-Family Residential Districts,One-Story"(Section
20-3.5(E))or "Dimensional Requirements,Single-Family Residential Districts,Two-Story"
(Section 20-3.5(H):),"Dimensional Requirements,Multi-family Districts"(Section 20-3.5(F))and
"Dimensional Requirements,Nonresidential Districts"(Section 20-3.5(G)).
(2)There shall be no variation or deviation from such dimensional requirements except where
expressly allowed by this Code.
(3)Minimum and maximum dimensional requirements for permitted uses withina PR or PI use
district shall be the same as those listed in the following tables for uses within the most
restrictive use district located adjacent to the subject PR orPI property.
(D)Properties Abutting Single-Family Zoning Districts.

(A)Purpose.The purpose of this ordinance isto establish special dimensional requirements and
performance standards to regulate two-story single family structures and two-story additions
within the residential zoning districts:"RS-1"Estate Residential,"RS-2"Semi-Estate
Residential,"RS-3"Low Density Single-Family Residential,"RS-4"Single-Family Residential
and "RS-5"Single-Family Residential (50'lots)of the Cityof South Miami.
(B)Applicability.The requirements of this Section shall be in addition to each and every other
requirement of the Cityof South MiamiLand Development Code (Code),and in the case of
conflict,the provision of this Section shall control.
(C)Performance Standards.The performance standard set forthin this section will guide the
development of two-story residential homes in the single family residential districts:RS-1,RS-2,
RS-3,RS-4 and RS-5.The performance standards are necessary in order to address yard
setbacks,open space,adequate landscaping,plan review process,and existing character of
the residential neighborhoods in the Cityof South Miami.By implementing these standards the
citywill be able to preserve and enhance the neighborhood character through architectural
designs that are consistent and responsive to the individual context of the city architecturally
diverse neighborhoods.
(1)Building Site.The development of two-story residential homes shall be constructed onalot
that is suitable for residential development,provides adequate setbacks and the necessary
infrastructure to support the development.
(2)MinimumLot Size.The minimum lot size for residential homes shall be subject to the
dimensional requirements set forthin the Land Development Code table labeled
"Dimensional Requirements Single-Family Residential District Two Story"Section 20-
3.5(H).For irregular shaped lots,the average lotwidth rather than the frontage width shall
be used at the discretion of the Planning Director.
(3)Yard Setback Requirements.Nobuildingor structure,or any part thereof,including
covered porches or terraces,but not including uncovered steps,projections shall be
erected at a lesser distance from the front,side or rear lineof any building site than the
front,side or rear setback distance,respectively,prescribed and established herein for
such building site.Nothing herein shall prohibit a building or structure from having more
than the minimum required setbacks.
(a)Side Setbacks (Interior).Refer to Table 1:"Proposed Preliminary Minimum Side Yard
Setbacks."
Side yards shall be measured from the closest point of the structure's vertical outside
wallto the side lotline,ona bearing parallel to the front lotline,at ground level.

(b)Front Setback.The minimum front setback shall be consistent with the dimensional
requirements reflected on the Land Development Code table labeled "Dimensional
Requirements Single-Family Residential DistrictTwo Story"(Section 20-3.5(H)).
(c)Side Setbacks (Street).The minimum side setback (street)for structure that abuts a
street shall be consistent with the dimensional requirements reflected on the Land
Development Code table labeled "Dimensional Requirements Single-Family
Residential District Two Story"(Section 20-3.5(H)).
(d)Rear Setback.The minimum rear setback of twenty-five (25)feet shall be maintained
and required on principle buildings in the single-family residential district,as reflected
on the Land Development Code table labeled "Dimensional Requirements Single-
Family Residential DistrictTwoStory"(Section 20-3.5(H)).
Section 2.Article III,"Zoning Regulations,"Section 20-3.6,"Supplemental Regulations,"
Subsection (F),"Roadway Dedications,Improvements and Setbacks,"of the Land Development Code,
Cityof South Miami,Florida,is hereby amended and shall read as follows:
20-3.6 -Supplemental regulations.
(F)Roadway Dedications,Improvements and Setbacks.
(1)Public road rights-of-way shall be dedicated and paved to the minimum widths set forthin the
city's adopted Transportation Element or as follows,whichever is greater:
(a)One hundred (100)feet for:Bird Road (SW 40 Street),Miller Road (SW 56 Street)and
Sunset Drive (SW 57 Avenue).
(b)Eighty(80)feet forKendallDrive(SW88 Street).

(c)Twenty-five (25)feet for Progress Road (from SW 70 Street to SW 68 Street).
(d)Seventy (70)feet for section and half section line roads.
(e)Fifty (50)feet forall other roads,unless required otherwise herein.
(f)Thirty-five (35)feet forall private roadways.
(g)Twenty (20)feet forall alleys.
(2)All dedicated public roadways shall be improved by the abutting property owner to the
specifications of the city or county.
(3)No structures,other than utility poles,shall be located nearer to the centerline of an abutting
roadway than a distance equal to one-half of the official right-of-way width plus the minimum
required yard setback.
(4)In determining which streets are the frontage and side streets,the Ddirector ofbuilding the
Planning and zZoning Department shall be guided by the existing development pattern.
(5)Required yard setback distances shall be measured from the official right-of-way line,
regardless of whether such rights-of-way have been dedicated.
Section 3.Codification.The provisions ofthis ordinance shall become and be made part of the
Land Development Code of the Cityof South Miami as amended.
Section 4.Severability.If any section,clause,sentence,or phrase ofthis ordinance isfor any
reason heldinvalidor unconstitutional bya court of competent jurisdiction,this holding shall not affect the
validityof the remaining portions of this ordinance or the Guidelines adopted hereunder.
Section 5.Ordinances in Conflict.All ordinances or parts of ordinances and all sections and
parts of sections of ordinances in direct conflict herewith are hereby repealed.
Section 6.Effective Date.This ordinance shall become effective upon enactment.

Background:
This ordinance wasfirst presented to the PlanningBoardat the May10,2016 meeting at the
request'ofVice-MayorWelsh.Aftermuchdiscussion,the itemwasultimately withdrawn.
Planningstaff were directed to.provide additional information and return the itemto the
Board.
The concern this ordinance is intended to address is the lack of symmetry onablockface when
the houseon the corner lotispositionedatarightangletothe other houses ontheblock.
Whenthisoccurs,that property'ssideyardisalignedwith the frontyardsoftheremainderof
the block.Because a required sideyard street setback isless than a required front yard setback,
the houseon the corner maybeclosertothe street than the other houses on the block.
Inaneffortto prevent this arrangement,theCityisproposing amending the side street setback
requirements forsingle-family residences as provided in Sections 20-3.5(E)&(H)oftheLand
Development Code (LDC).Further,anew requirement fora second-story street side setback is'
proposed.It was thought that addingthis requirement would create alessbulky appearance
along the side street.

Analysis:..
Theside street setback requirements areprovidedinSections 20-3.5(E)forone-story structures
and (H)fortwo-storystructures.Bothone-storyandtwo-structurescurrentlyhaveaside street
setback oftwenty (20)feet in RSI andfifteen (15)feetfor RS2 -RS5.Thereareno separate
setback requirements forthesecond story;inother words,thetwostoriesmaybeflushwith
one another.The proposed amendment increases the side street setback for the first floor and
creates agreatersetback requirement forthesecondfloorforthe RS-1 through RS-4 distriqts.
Figures1,2,and3(attached)depict,foratypicallot,thebuildablearea,currentsetbacks,and
proposed setbacks for corner lots'.
Thereiscurrentlyathirty(30)footdifference between theside street andfrontyard setback in
RSI.Theproposed amendment will reducethisdifferencebyfive (5)feetbyincreasing the side
street setbackrequirement.However,thesearelargerlots(minimum40,000squarefeet)so
thedifferenceisless likely to.benoticeableasthehouses will likely bespaced farther apart
(please see Figure 4).A separate secondstorysetbackisnotproposed.Withthe current RS-2
requirements,there isatwenty (20)foot difference betweenthefrontyardandsideyard
setbacks.Withproposedchanges in RS2,there will beafifteen(15)footdifference between
thefront yard and first floor sidestreet setbacks,thesearealso larger lots (minimum 15,000
squarefeet).RS3 and RS4 properties currently,have aten (10)foot difference betweenfront
yardandside street setback.Withthe proposed changes,they will havea five (5)foot
differencebetweenthesetbacks.Theproposedtwenty-five(25)footsecondfloorsetback will
bealignedwith the frontyardsetbackoftheadjacenthouse(pleasesee Figure 5),butthe
second floor maybesteppedbackorrecessed from the first floor.In RS5,thereisaten (10)
footdifference between the proposed firstfloorside street andfrontyardsetbacks,both
existingand proposed.Under.the proposed amendment,thesecondfloor will be setback five
(5)feetfarther,and will bemore closely aligned with the neighboring house(pleasesee Figure
6).Theproposedchangesseemtohavethegreatestimpacton RS5 properties.Given thesizeof
these lots (minimum 6,000squarefeetand50footfrontage),thenewsetbacksresultina
narrower houseforacornerlot,perhaps asnarrowas22.5 feet inwidthonthesecondfloor.
This canimpactthe design of the houseandthe efficiency ofthe floor plans.However,the
housecan still bebuilttothe maximum FAR of.525by providing atwenty (20)footside street
setback for both floors.
Theproposeddraftalsocorrectsminortypographicalerrorssuchasthetitleof the director
responsible for determining which'street is considered tobethe front ofa corner lot property.
Planning Board Acton:
After the public hearingheldontheitematthe Planning Board's July 21,2016 meeting,the
Boardrecommendedthat PB-16-016 notbeapproved,withavoteof5-1.
