Res No 185-16-14740RESOLUTION NO.185-16-14740 A Resolution declaring that the personal property,described in the attached list,is "surplus"and authorizing the City Manager to dispose of the "surplus" items. WHEREAS,Section 2-4.7 titled:"Surplus city-owned property"of the City of South Miami Code of Ordinances states that all personal property owned by the Cityshall not besold unless and untilitis declared to be surplus property by resolution of the City Commission;and WHEREAS,the City Manager is recommending that the attached list of personal property items be classified as "surplus"because said property serves no useful function for any activity or in any location within the City and should besold to the highest bidder by way of a City auction or as otherwise provided in section 2-4.7 of the City Code of Ordinances;and NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITYOFSOUTH MIAMI,FLORIDATHAT; Section 1.The personal property described in the attached list of property is "surplus" andCity Manager is hereby authorized to dispose of the items in accordance with the procedure set forth in section 2-4.7of the CityCodeof Ordinances,including sale at public auction. Section 2.Severability.Ifany section,clause,sentence,or phrase of this resolution is forany reason heldinvalidor unconstitutional bya court of competent jurisdiction,thisholding shall not affect the validity of the remaining portions of this resolution. (a)Items of personal property owned bythe city shall not be sold unless and until itis declared tobe surplus property by resolution of the city commission. (b)Thecity commission shallnotconsiderdeclaringanyitemofpersonalpropertytobesurplus unless the city manager has affirmatively recommended such action thereon. (c)Upondeterminationbyresolutionbythecity commission thatanitemofpersonalpropertyissurplus,the city manager is hereby authorized toselltothe highest bidder atpublic sale or,if approved by the commission by resolution,atpublicauction,saiditemofpersonalpropertyafter advertising thedate,time and place of said sale or auction once a week for three (3)consecutive weeks ina newspaper of general circulationin the city. Thecity manager shall have therightto accept orrejectanyorallbids.Inthe event thepersonalpropertyshall be offered for sale or auction,andnobidsshall be received therefor,itshall be deemed that such property has novalueand the city manager inhisdiscretionmayorderit destroyed or otherwise disposed of. (d)This section shallnotapplyto stolen,abandoned or confiscated personal property which has come intothe city's possession.
