Ord No 19-16-2252ORDINANCE NO.19-16-2252 An Ordinance of the City of South Miami establishing a moratorium on the subdivision of parcels of land pending the adoption of an amendment to the City's Land Development Code,Section 20-4.2,governing subdivision of land. WHEREAS,theCityCommissionhasexpressedconcernsastothemannerand procedurethroughwhichpropertyintheCity of SouthMiamiisbeingsubdivided;and WHEREAS,theCity Commission hasbeenintheprocess of amending 20-4.2forovera year;and WHEREAS,on March 15,2016,theCity Commission passed,onfirst reading amendments to Sections 20-5.17 and 20-4.2,of the City's Land Development Code;and WHEREAS,on April 12,2016,the Planning Board reviewed the proposed ordinances and recommended that thelotsplit ordinance be adopted with amendments,andthe other ordinance not be enacted;and WHEREAS,itis anticipated thattheCity Commission will address the ordinance on thi and fourth reading on July 19th,2016 and itis anticipated that the ordinances may need a fifth reading; WHEREAS,the Mayor and Commission desire to maintain thestatusquountilthe ordinances canbe approved or rejected bytheCity Commission. NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1.TheCityherebyenactsa temporary moratorium onthe processing of any applications forthe subdivision of landintheCity.The moratorium shallexpireon August 19, 2016_or thedate that theCity Commission enacts or rejects an amendment to section 20-4.2 of the Land Development Code,whichever occursfirst,providedthe expiration datehasnotbeen extendedbyresolutionasprovidedherein.TheCityCommissionmayextendtheexpirationdate foran additional 30daysby written resolution inthe event that section 20-4.2 hasnotbeen enacted or rejected by August 19,2016. Section 2.Determination of Vested Rights or Denial of All Economic Use. (A)Nothing inthisOrdinanceshallbeconstruedorappliedtoabrogatethe vestedright of apropertyownertocompletesubdivision of aparcelwheretheproperty ownercandemonstratebysubstantialcompetentevidenceeach of thefollowing: 1.A governmental action occurred prior tothe effective date of this Resolution uponwhichthepropertyownerhas detrimentally relied,ingoodfaith, by making substantial expenditures;and 2.It would behighlyinequitabletodenythe property owner therightto complete the subdivision of the owner's land. Page 1 of2 Ord.No.19-16-2252 (B)Any property owner claiming vested rights or denial ofalluseunderthis Resolution mustfilean application withtheCity Commission fora determination within 90 days afterthe effective dateofthis Resolution.Thetimelimitfor filing an application shall be jurisdictional.The application shall contain a sworn statement astothebasis upon which the vested rights or denial ofalluseare asserted,together with documentation requiredbytheCityandanyother documentary desirestosupportthe claim.Each document submitted shallhave,attached toitorbe accompanied by,a sworn statementattesting,underpenaltyof perjury,tothetruthofthefactscontainedinthe documentandattestingthatthe document,ifacopy,isatrueandaccurateduplicateof theoriginal.TheCity Commission shallholdapublichearingonthe application and, baseduponthe competent substantial evidence presented atthe hearing,shallmakea determinationastowhetherthepropertyownerhasestablishedavestedright. Section 3.Judicial Review.Judicial review of final decisions bytheCity Commission underSection1aboveshallbebyfilinganactioninCircuitCourtandunderSection2ofthis Ordinanceshallbebythefiling of aPetitionforWritofCertiorariintheCircuitCourtofthe EleventhJudicialCircuitinandforMiami-DadeCountyin accordance withtheFloridaRules of AppellateProcedureforthereviewofthe quasi-judicial decisionsof municipalities. Section 4.Exhaustion of Administrative Remedies.No property ownerclaimingthat thisOrdinance,asapplied,constitutesorwouldconstituteatemporaryorpermanenttakingof privatepropertyoranabrogationofvestedrightsmaypursuesuchclaimincourt,unlessheorshe hasfirstexhaustedtheapplicableadministrativeremediesprovidedinSections2 of this Ordinance. Section 5.Severability.Ifanysectionclause,sentence,orphrase of thisordinanceisfor anyreasonheldinvalidor unconstitutional byacourt of competent jurisdiction,theholdingshall notaffectthe validity of the remaining portions of this ordinance. Section 6.Effective Date.This Ordinance shallbe effective immediately upon adoption.
