Ord No 18-16-2251ORDINANCE NO.18-16-2251 An Ordinanceamending Chapter 5,ArticleI,Section5-1 of theCity of South Miami's Code of Ordinancesprotecting wifcl feralparrots,theirnestingtreesandtheireggsandestablishingcriminal penaltiesand enforcement procedures. WHEREAS,theCityCommission of theCityofSouthMiami("City")herebyfindsanddeterminesthatwild feral parrotsareyear-roundresidentbirds(non-migratory)ofSouthMiami;and WHEREAS,theCity Commission findsanddeterminesthatparrotsarefreeranging,self-sufficient,(non- caged)wild birds within the city limits of South Miami;and WHEREAS,theCity Commission findsanddetermineswildferalparrotsaresuccessfullynestingwithinthecity limits of South Miami;and WHEREAS,theCity Commission findsanddeterminesthatparrotshavebeen endangered bybeinghuntedby certain people forsaleand therefore deserves the protection of theCity of SouthMiamifor conservation purposes. NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1.City of SouthMiamiCode of Ordinances,Chapter5,ArticleI,Section5-1,isherebyamendedtoreadas follows: CHAPTER 5.ANIMALS AND FOWL Sec.5-1.-City declared a wildlife sanctuary. (a)Forthepurpose of this section "wildlife"shallbedefinedasallnativebirds,mammals,reptiles,andamphibians, andallanimal species otherwise protected byfederal,state,orcountylaw. (b)Theterritory embracing thecorporatelimits of thecityisherebydeclaredtobeawildlifesanctuaryanddesignated as "environmentally sensitive." (c)Itshallbeunlawfultoharass,wound,poison,capture,orkillwildlifewithintheterritoriallimits of thecity,except aspart of ascientificstudybyindividualswithappropriatefederaland/orstatelicensesandapproval of thecity manager. (d)Itshallbeunlawfultointroduceintothepublicairspacebroad-spectruminsecticidesorbiocideswithinthe territoriallimits of thecitythatmayharmwildlife,thenaturalfoodsupplyforwildlife,pollinators,ornatural biological control species. (e)Removal.Wildlife,nototherwiseprotectedbyfederalorstatelaw,thatcreateasignificantthreattothehealth and/orsafetyofpersonsorotheranimals,as determined bythecitymanager,canbehumanelytrappedbystate certifiedanimalcontrolspecialistsforrelocation. (f)Wildferal Parrots. (1)Feral parrot is defined to mean abird,classified scientifically within the taxonomic order Psittaci formes, that is living out of doors and not in a cage. (2)Activenest isdefinedtomeananestinhabitedfromtimetotimebyoneormorewildferalparrotsthat contains eggs or birds less than one year in age. (3)The young ofawild feral parrotshallincludenestlings,fledglings,immatureandjuvenileparrots. (4)Acts prohibited. a.Itisunlawfulforany person(s)withintheCity,without legal authority,to knowingly harass,injure, killor capture awildferalparrot,orremoveitfromitsnight roost oritsnest. b.Itisunlawfulforany person(s)withintheCity,without legal authority,to knowingly andinany manner,take,remove,destroyorhavepossession of anyeggsoranyyoung of awildferalparrot. Ord.No.18-16-2251 c.Itisunlawfulforany person(s),withoutlegal authority,toknowinglycutdownorinanyotherway harmatreein which there existsanactivenest of a wM feral parrot within theCity. d.Itisa defense toa violation of subsection c of this section if atreeiscut down in compliance with theCity'sCode of Ordinancesand/orLandDevelopmentCodeandbyoratthedirectionofthe ownerofthetree,provided arrangements withalicensed rehabilitation facility aremadeforthecare of anyeggsor young wildferal parrots foundinthetree. (5)Penalties.Anypersonwhoshallviolateanyoftheprovisionsofthissection(orany subsequent amendments hereto),orwhoshallfailtocomplyherewith,orwithany of the requirements hereof,may beprosecutedinCourtanduponafindingofguiltshallbeliablefora fine ofupto$500.00foreach offenseand/or imprisonment foratermnottoexceedsix(6)months. (6)Enforcement.Inlieuofarrestbyapoliceofficer,acodeenforcementorpoliceofficermayissueacivil citation fora violation of this section whichshallbe enforced pursuant tothe procedure provided in section 2-25 of this Code. Section 2.TheCityClerkisinstructedtosendacopy of thisordinancetotheBoard of the Miami-Dade County Commission,andtoall municipalities in Miami-Dade County. Section23.Codification.Theprovisionsofthisordinanceshallbecomeandbemadepart of theCodeof OrdinancesoftheCityofSouthMiamiasamended;thatthesectionsofthisordinancemayberenumberedorre-lettered to accomplish suchintention;andthattheword "ordinance"maybechangedto"section"orotherappropriateword. Section 34.Severability.If anysection,clause,sentence,orphrase of thisordinanceisforanyreasonheld invalidorunconstitutionalbyacourt of competentjurisdiction,thisholdingshallnotaffectthevalidityoftheremaining portions of this ordinance. Section 45.Ordinances in Conflict.Allordinancesorparts of ordinances andallsectionsandparts of sections of ordinances indirect conflict herewith are hereby repealed.
