An Ordinance amending Chapter 1,Section 1-8 of the City of South Miami's
Code of Ordinances regarding general penalties for offenses.
WHEREAS,Section 1-8 of theCity of South Miami's Code of Ordinances doesnot
provideforcode enforcement citations;and
WHEREAS,section1-8doesnotprovideforspecial assessments intheeventthatthe
Cityincursthecost of curinga violation thatcausesa nuisance;and
WHEREAS,section 1-8 references a municipal court that no longer exists.
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1.City of South MiamiCode of Ordinances,Chapter 1?Section 1-8,"General
penalty;continuing violations,"ishereby amended toreadasfollows:
Sec.1-8.-General penalty;continuing violations.
Whenever in this Code orinany ordinance of the city any act is prohibited oris
made or declared to be unlawful or an offense,or whenever in such code or ordinance
thedoing of anyactis required orthefailuretodoanyactis declared tobe unlawful,
where no specific penalty is provided,therefor,the violation of any such provision of
this codeorany ordinance shall be punished byafine not exceeding five hundred
dollars or imprisonment fora term not exceeding six months,orby both such fineand
imprisonment in the discretion of the municipal a^court of competent jurisdiction.In
lieu of arrest bya police officer,a code enforcement or police officer may issue a civil
citation which shall be enforced pursuant to the procedure provided in section 2-25 of
this Code.Each day that any violation of any provision of this Code or of any other
City ordinance shalt-continues,jt shall constitute a separate offense.
In addition to the penalties hereinabove provided,any condition caused or
permitted to exist in violation of any of the provisions of this Code orany ordinance
shall be deemed a public nuisance andmaybe,bythe city,abated as provided bylaw,
and each day that such condition continues shallbe regarded asa new and separate
offense.In the event that the City incurs any costs to abate the nuisance,the cost
incurred maybe assessed againstthepropertyinthesame manner asanyother property
assessment orit may be included inan enforcement order of the City's Special Master.
Section 2.Codification.The provisions of this ordinance shall become and be made
part of the Code of Ordinances of theCity of South Miami as amended;that the sections of this
ordinancemaybe renumbered or re-lettered to accomplish such intention;andthattheword
"ordinance"maybe changed to"section"orother appropriate word.

Section 3.Severability.If any section,clause,sentence,or phrase of this ordinance is
foranyreasonheldinvalidorunconstitutionalbyacourt of competentjurisdiction,thisholding
shallnotaffectthe validity of the remaining portions of this ordinance.
Section 4.Ordinances in Conflict.All ordinances or parts of ordinances andall
sectionsandparts of sections of ordinances indirectconflict herewith areherebyrepealed.
Section 5.Effective Date.This ordinance shall become effective upon enactment.
