A Resolution authorizing a temporary changein the permitted hours of construction operations of
Florida Power &Light (FPL)to perform work on SW 62 Avenue,between SW 70th Street and South Dixie
Highway.
WHEREAS,Pursuant to Section 7-16(g)ofCodeof the Ordinances,as amended by Ordinance No.5-15-
2212,all construction sites shall comply with the city'snoise code andit provides in pertinent part asfollows:
All construction sites shallcomplywith the city'snoisecode.Construction activityislimitedto the hours of7:00
a.m.through-6:00 p.m.on the weekdays ofMondaythru through Friday;and between the hours of9:00a.m.
through 5:00p.m.on Saturday.No construction activityis permitted onSunday.Notwithstanding the above,no
construction activities shall take placein,orwithin500 feet of,residentially zoned districts,other than those in the
Hometown District,on either Saturday or Sunday and,asto construction activities in non-residentially zoned
districts and in the Hometown District,alldaysof the week and hours of the daymaybe changed by resolution of
the City Commission upon a finding of extraordinary circumstances.
WHEREAS,FPL wishes to perform work along SW 62 Avenue,between SW 70th Street and South Dixie
Highwayto replace existing transmission line concrete poles along the east side of SW62 Avenue;and
WHEREAS,the transmission line clearances are only available during the night and the type of equipment
being used will impact traffic due to a required lane closure.In addition,the FPL's operations at night will cause
minimal traffic impact;and
WHEREAS,allowing construction activities at night maybe changed by resolution of the City Commission
upon its finding of extraordinary circumstances;and
WHEREAS,FPLis requesting authority to conduct transfer services during night hours;and
WHEREAS,approval of this request will not be detrimental or harmful to the surrounding area of the
community at large.
NOW,THEREFORE,BEIT RESOLVED BYTHE MAYOR AND CITY COMMISSION OF THE CITYOF SOUTH
MIAMI,FLORIDA THAT:
Section 1:The recitals set forth above have been found to be true and they are hereby incorporated by
reference asiffully set forth herein.The construction hours are hereby changed temporarily for the current
construction activities of FPL for two weeks,commencing on August 8,2016 oruntil such time as the City
Commission or the City Manager revokes these extended hours of operation.The temporary hours of construction
operations are limited to the hours of 9:00 PMto6:00AM.The contractor shallhire,at their own expense,anoff
dutyCityof South MiamiPolice officer for these daysandduring these hours to insure that the FPL complies with
the City's ordinances andthis resolution.The extended hours for construction activity authorized bythis
Resolution mayalsobe reduced or revoked upon determination of the City Manager inhis sole and absolute
discretion that a violation of any of the City's ordinance or this Resolution has occurred and has not been resolved
tohis satisfaction or that the noiselevelis otherwise excessive.This resolution maybe revoked atany time in the
sole and absolute discretion of the City Commission.
Section 2.Severability.Ifany section clause,sentence,or phrase of this resolution isforany reason held
invalidor unconstitutional bya court of competent jurisdiction,the holdingshallnotaffect the validityof the
remaining portions of this resolution.
Section 3.Effective Date.This resolution shall become effective immediately upon adoption by vote of
the City Commission.

Background:Ordinance No.5-15-2212 prohibits construction activity to take placeduring
nighthoursfrom6:00 PM though7:00AM.FPL is transferring /replacing
existing transmission line concrete polesalong the east side of SW62 Avenue as
per the City's request to comply with ADA requirements to allowsafe passage of
bicycles and pedestrians.
Due to Heavy traffic duringdaylight hours onSW62 Avenue,and because the
electric transmission linesrequiretraffic clearances during movement between
poles which are only availableduring the night forthisarea,FPL is requested a
waiver,to allow them to work during night hours.
Resolution 113-16-14668 was approved on June 21,2016.This resolution
authorized the work during night hours until July15,2016.
FPL was unable to complete the work during the previous approved time andis
requesting a renewal of the waiver of construction hours for one week,
commencing on August 8,2016,to complete the work described above.The
work will take place along SW62 Avenue,betweenSW 71st Street and US-1.
Request:The Resolution attached is to waive the limitation on hours of construction,as
authorized by the Ordinance.The work is anticipated to be completed within
the next two weeks.

An Ordinance amending Section 7-16.(g)ofthe Code of Ordinances ofthe

WHEREAS,from time to time a project that will benefit the City of South Miami may,
due to extraordinary circumstances require work to be performed on Sundays and earlier than
9:00a.m.on Saturdays and
WHEREAS,the Mayor and the City Commission desire to provide for more flexibility
under extraordinary circumstances for changing the days and hours of permissible work.
NOW,THEREFORE,BEIT ORDAINED BYTHEMAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1.Section 7-16.(g)ofthe Code of Ordinance oftheCityof South Miami is
hereby amended inpertinentparttoreadas follows:

Section3.Severability.Ifany section,clause,sentence,orphraseofthis ordinance is
foranyreasonheldinvalidor unconstitutional bya court of competent jurisdiction,this holding
shallnotaffectthevalidityoftheremainingportionsofthisordinance.
Section4.Ordinances inConflict.All ordinances orparts of ordinancesandall
sectionsandparts of sections of ordinancesindirectconflictherewithareherebyrepealed.
However,itisnottheintentofthis section to repeal entire ordinances,orpartsof ordinances,
thatgivetheappearance of beinginconflictwhenthetwoordinancescanbeharmonizedor
when onlya portion ofthe ordinance inconflictneedstobe repealed to harmonize the
ordinances.If theordinanceinconflictcanbeharmonizedby amending itsterms,itishereby
amendedto harmonize thetwoordinances.Therefore,onlythat portion thatneedstoberepealed
toharmonizethetwoordinancesshallbe repealed.
