Res No 167-16-14722RESOLUTION NO.:167-16-14722 A Resolution authorizing the City Manager to expend an amount not to exceed $10,000 to Miami Dade College-School of Justice Assessment Center for the Sergeants promotional exam. WHEREAS,the Police Department isin need of providing a Sergeants promotional test to conform to the current Collective Bargaining Agreement;and WHEREAS,the Retirement of Lt.Henry Guzman has left a promotional opportunity for officers who have three (3)years seniority within the Department at the time of the examination; and WHEREAS,the City desires to provide a professional promotional examination and opportunity for advancement;and WHEREAS,aninitial inquiry into the availability of expert services for the givingofa promotional test for Sergeants uncovered a program ofMiami Dade College which offered the test for $7,950;and WHEREAS,an Invitation to Quote was developed and announced to find expert services necessary toprovidea professionalpromotional examination andonly one vendor,Sawgrass Group,Inc.who submitted abidin the amount of$20,000;and WHEREAS,pursuant to CityCharter,the City Commissionhas been delegated with the power to accept the bid or reject the bid;and WHEREAS,the City Manager recommends the rejectionof the bidand the approvalofa contract with Miami Dade College;and WHEREAS,Article III,Section5,Hof the City Charter provides that all purchases inexcessof $5,000shallbe approved after competitive conditions shallhave been maintained and competitive bidssoughtfromatleast three differentsourcesofsupplyifavailable,such determination tobe madebythe Commission.Italsoprovides that thissubsectiondoesnotapplyto the purchaseof expert services that have been approved by the City Commission. Lastly,the provided quote isfora written exam and BADGE exercise.The Badge exercise isa job-relevant scenario which is administered orallybya test proctor. In Ricci v.DeStefano,the City of NewHaven,Connecticutwasfoundtohave violated Title VII whenit rejected successful promotional test results achieved by non-minorities in favor of minorities.In itseffortto avoid a disparate impact against those minorities,the City ofNew Haven choseto discard the eligibility list.The U.S.Supreme Court ruled thata jurisdiction cannot discard an eligibility ]listsolelybecauseitdoesnotproduceadiversegroupofcandidatesand |required the City of New Haven to reinstate the list.Furthermore,the process J utilized to validate and develop the promotional process was based upon an in- j depth job task analysis which was upheld by the U.S.Supreme Court. TheCityof Milwaukee in2007wasfoundtohaveengagedinunlawful discriminationforusingpromotionalpractices that favored women and minoritiesinpromotionsfrompolicelieutenanttocaptain.In summary,any individuals who passed the written examination were placed on the eligibility list.The Chief would then select whoever he felt wasthebest fit for thejob and submit his decision tothe public safety board for approval.Without exception the publicsafetyboardapprovedhisrecommendations.Overthecourse of two years,42 promotions weremadewith 20+being minority orfemale.TheChief hadno documented,job related or systematic wayof making recommendations. Areverse discrimination lawsuitwas filed alleging that more qualified white maleswere systematically skipped over because of race or gender.Thecourt ruled in favor ofthe plaintiffs and required promotionfor all 17 individuals and back pay from the Chief and Public Safety board intheamountof $280,000 per person. Validation of Assessment Center Exercises: Forrankofsergeantateamof3-5subjectmatterexpertscanexpect 3-4 hours reviewing draftsof exercises or interview questions. 11 III.Resulting Test Plans and Specifications (Attachment B) Sawgrass Group will provideforeachrankacomprehensivejobtask analysis reportwith the necessary recommended selectionplanstoincludevalidated weights,KSA emphasis,exercises,andrecommended decision makingstrategies. Asampleselectionplanderivedfromajobtaskanalysisconductedfor the Cityof IndianapolisPolice Department has been included. IV.Proposed Methodology SawgrassGroupwill be utilizingasixphase content validation strategy for the sergeant rank.Thesixphasesare:1-Literature Review,2 -Job Interviews & Observations,3 -Task-KSA Survey Designand Dissemination,4-Task-KSA Analysis &Linkage,5-Final Reporting and Recommendations 6-Written Examination Reference Validation Thefirstphasestartswithaliteraturereviewincludingbutnotlimited to the following basic pieces of information: 1.History of the City of South Miami 2.Organizational Structure and Mission 3.Historical movement andplacementofsupervisorswithin the division and rank structure 4.ReviewofCityofSouthMiami/DadeCountycaselawon recruitment, hiringand selection 5.Calls forservicedata (i.e.,division,sector,andbeat) 6.Internal Affairs Databy general category 7.Samplesofbasicreportsutilizedforeachposition Upon completion ofthe literature review,Sawgrass Group,Inc.will commence phase two,which involves job interviews and job observations.During this phase,Sawgrass Group,Inc.will sendout online job interview surveysin advance offocus group meetingsandjob observations.During the focus groupmeetings andjob observations,Sawgrass Group,Inc.will be confirming the information gatheredthroughtheonlinesurveysand gathering additional new information. Thiswill set afirm foundation for defensibility and ensure the most accurate representation of the actual job duties. Thefinal phase involves the development of a written examination study guide for the rank of Sergeant.Thisinvolves the use of subject matter expert focus groups to thoroughly review with Sawgrass Group,Inc.eachcriticalTask- Knowledgelinkageand identify areaswithin proposed study guidematerialsbest showingaclear connection.For example,a critical task fora sergeant maybe to monitor a high-speed pursuit of a subject who committed afatalhitandrun. Appropriate codes may be the Florida State Statute (FSS)for Speeding,Cityof SouthMiami PD Policy -High SpeedPursuitGuidelinesand FSS -HitandRun. This "Task-Knowledge"connection would yield three validated references to develop questions for the Sergeant written examination. In summary,the SMPDshould expect the following deliverable per uniformed rank: 1.Comprehensive JobTaskAnalysisReport based firmlyon the Uniform Guidelines for Employee Selection standards andPrinciplesforValidation and Use of Personnel Selection Procedures. a.This report will include but is not limited to a summary of the literature review,validation strategy,survey methodology,survey results,analysis reports &graphs,recommendations andfinalized selection strategies. b.Itwillalsoincludeany unique challenges or circumstances the City of South Miamifaces with regardsto promotion. 13 c.Validated reference lists for each written examination in the promotional ranks VI.Written Examination Procedures Overview Sawgrass willdevelopabankofwrittenexaminationitemsfor the promotional rank ofsergeant.Approximately 110 examination items will bedeveloped.Items not meeting acceptablestandardswillbedroppedfromusageandreplaced. Written examinations willhaveon the cover,the SMPDlogo,clearindication of rankby name andcolorandbesequentially numbered.Packaging willbesuch thattamperingoropeningby unauthorized person (s)isevident.Pencils, Scantrons and instructions for the written examination will be included in the first package.In thesecond package,appeals instructions,answerkeys,appeals forms,and reference listforeach exam willbe included. WrittenExamination Development Development ofeachexamisaccomplishedbycollaboratingwithsubject matter experts (i.e.,incumbent sergeants/lieutenants)to developadetailedblueprint for the multiplechoiceexaminationquestions.For example,thesubject matter experts mayselectfrom the agencypoliciesandprocedures,leadership texts etc...forpotentialmultiplechoicequestions. Thedetailedmultiplechoiceblueprintwillbeusedby the Sawgrass todevelopa draftof potential questions for the exam.Thedraft of questions willbereviewed by the subject matter expert committee to determine validity,difficultyand quality.Any questions deemed unacceptable by the subject matter expert committee will not be included in the exam.Thefinal examination composition, will not be known byany staff fromSMPD. 14 Setting Cutoff Scores If recommended,the SawgrassGroup,Inc,will develop a cutoff for the exam. Typically,the Sawgrass will use70-80%asthe cutoff for theexam,depending on the agencystandardortheAngoffrating method to determine a valid cutoff, insummary,the Angoffrating method isa legally defensible method validated bycaselawwhichevaluates the difficultyofeach test itemto determine the overall cutoff.Inaddition,Sawgrasscalculates the standarderror of measurement,and conducts an item analysisto ensure the cutoff score used is accurate andlegally defensible. Written Exam Administration Reasonable accommodation requests (ADA)willbe coordinated viaSMPD Administration Department prior the examinationprocessforeachrank. Sawgrasswill use qualified staff independent of the SMPDto administer the actualexam.Allmaterials necessary willbeprovidedbySawgrass(i.e.pencils, scantron sheets,instructions,exam booklets). Asastandardpractice,the Sawgrass conducts an item analysisfor the multiple choiceexamto determine if there areany questions where anunusuallyhigh (i.e.,90%)number of candidates missaparticular question. Sawgrass wiil provide an opportunity for candidates to challenge any question on the writtenexam.Typically,thisisaccomplishedbyschedulingasession immediately after the written exam.Candidates must submit their own challenges to the exam andeachchallengeis submitted anonymously inwriting. TheSawgrassand subject matter expert paneldiscuss the validityof the challengeto determine ifitwillbe "accepted"or "denied".If the challengeis accepted,the question willbedroppedor adjusted ifapplicable.If the challenge is denied,no change is made.Final results will be communicated to candidates within five business days. Confidentialityisvitalto maintaining the integrityofapromotionalprocess. Therefore,the test development approach is designed to minimize asmuchas possible the perceptionandreality of theexactscenariosbeingknownby SMPD personneloutsideof the subjectmatterexpert committee. Assessment Center &OralBoard Development Upon completion of the jobtaskanalysisstage,Sawgrasswill develop outlines or general themes for development of assessment center exercises andoral board questions to be reviewed and approved by the subject matter expert committee, Sawgrasswill convene with the subject matter expert committee toclarify agencyspecificstandards,reporting requirements,orany other pertinent information necessary to create realistic exercises for SMPD. The primary communication channelwillbevia video conference /conference call/email.Newscenarioswillbe developed foreach subsequent promotional examination. Thissectionshallbedesignatedandknownasthe"CityofSouth Miami Conflictof Interest andCodeofEthics Ordinance."Thissection shall beapplicabletoallcitypersonnelasdefinedbelow,andshallalsoconstitutea standard ofethical conduct andbehaviorforall autonomous personnel,quasi-judicial personnel,advisory personnelanddepartmentalpersonnel.Theprovisionsofthissection shall beappliedina cumulative manner.By wayofexample,andnotasalimitation,subsections(c)and(d)maybeappliedtothesame contract or transaction. (b)Definitions.Forthepurposesofthissectionthe following definitions shallbe effective: (1)Theterm"commissionmembers"shall refertothemayorandthemembersofthecity commission. (2)The term "autonomouspersonnel"shallrefertothemembersofautonomousauthorities,boardsandagencies, suchas the citycommunity redevelopment agencyandthehealth facilities authority. (3)The term "quasi-judicial personnel"shallrefertothemembersofthe planning board,theenvironmentalreview and preservation board,the code enforcement boardandsuch other individuals,boardsand agenciesof the city as perform quasi-judicial functions. (7)The term "compensation"shall refer toanymoney,gift,favor,thingofvalueor financial benefitconferred,or to be conferred,in return for services rendered or to be rendered. (c)Prohibition on transacting business with the city. Nopersonincludedinthe terms definedinparagraphs(b)(1)through(6)andinparagraph(b)(9)shall enter into any contract or transact anybusinessinwhich that personora member of the immediate family hasa financial interest,direct or indirectwith the city or any person oragencyactingforthecity,andanysuch contract, agreement orbusiness engagement entered inviolationofthissubsectionshall render the transaction voidable. Willful violation of this subsection shall constitute malfeasance in office and shall affect forfeiture of office or position.Nothinginthissubsection shall prohibit or make illegal: (1)Thepaymentoftaxes,special assessments orfeesforservicesprovidedbythecitygovernment; (2)Thepurchaseofbonds,anticipationnotesor other securities that maybeissuedby the citythrough underwriters or directly fromtimetotime. Waiver of prohibition.The requirements ofthissubsectionmaybewaivedforaparticular transaction onlybyfour affirmative votesofthecitycommissionafterpublichearingupon finding that: (1)Anopen-to-allsealedcompetitiveproposalhasbeensubmittedbyacitypersonasdefinedinparagraphs (b)(2), (3)and(4); (2)Theproposalhasbeensubmittedbyapersonorfirm offering serviceswithinthescopeofthepracticeof architecture,professionalengineering,orregisteredland surveying,asdefinedbythelawsofthestateand pursuant totheprovisionsof the Consultants'Competitive NegotiationAct,andwhen the proposalhasbeen submittedbyacitypersondefinedinparagraphs(b)(2),(3)and(4); (3)The property orservicestobeinvolvedinthe proposed transaction areuniqueand the citycannotavailitself ofsuch property or services without entering a transaction which would violatethis subsection butfor waiver of its requirements;and (4)Thatthe proposed transaction willbeinthebest interest ofthecity. Thissubsectionshallbeapplicableonlyto prospective transactions,andthecitycommissionmayinnocaseratifya transaction entered in violation of this subsection. Provisions cumulative.This subsection shallbetakentobecumulativeandshallnotbe construed toamend or repeal any other lawpertainingtothesame subject matter. (d)Furtherprohibitionon transacting businesswiththecity. Additionally,noperson included intheterm defined in paragraph (b)(1)shall voteonor participate inanywayin anymatterpresentedtothecity commission ifthatpersonhasanyofthe following relationships withanyofthe personsorentitieswhichwouldbeormightbedirectlyorindirectlyaffectedbyanyactionofthecitycommission: (I)Officer,director,partner,ofcounsel,consultant,employee,fiduciary or beneficiary;or (2)Stockholder,bondholder,debtor,orcreditor,ifinanyinstancethetransaction or matter wouldaffect the person definedinparagraph (b)(1)inamannerdistinctfromthemannerinwhichitwouldaffectthepublic generally.Anyperson included intheterm defined in paragraph (b)(I)whohasanyofthe specified relationships orwho would or might,directly or indirectly,realize aprofitbytheactionofthecity commission shall notvoteon or participate inanywayin the matter. (E)Gifts. (l)Defmition.Theterm "gift"shall refertothetransferof anything ofeconomic value,whetherintheformof money,service,loan,travel,entertainment,hospitality,itemorpromise,orinany other form,without adequate andlawful consideration. (2)Exceptions.The provisions of paragraph (e)(1)shall not apply to: a.Political contributions specifically authorizedbystate law; b.Gifts from relatives or members ofone's household,unless thepersonisaconduiton behalf ofathirdpartyto the delivery ofagiftthatisprohibitedunder paragraph(3); c.Awards for professional or civic achievement; d.Material suchas books,reports,periodicals or pamphlets which are solely informational orofan advertising nature. (3)Prohibitions.A person described in paragraphs (b)(1)through (6)shall neither solicit nor demand any gift.Itis also unlawful foranypersonorentityto offer,give oragreeto give toanyperson included intheterms defined in paragraphs (b)(1)through (6),orfor any person included in theterms defined in paragraphs (b)(1)through (6)to acceptoragreetoacceptfrom another personorentity,anygiftfororbecauseof: a.An official public action taken,ortobe taken,or which could be taken,oran omission or failure totakea public action; b.A legal duty performed ortobe performed,or which could be performed,oran omission or failure to perform a legal duty; c.A legal duty violated ortobe violated,or which could be violated by any person included intheterm defined in paragraph (b)(1);or d.Attendanceorabsencefroma public meetingatwhich official actionistobetaken. (4)Disclosure.Any person included in theterm defined in paragraphs (b)(1)through (6)shall disclose any gift,or seriesof gifts from anyone personor entity,having a value inexcessof $25.00.The disclosure shall bemadeby filing acopyofthedisclosureformrequiredbychapter 112,Florida Statutes,for "local officers"with the city clerk simultaneously with the filing ofthe form with the clerk ofthe county and withthe FloridaSecretaryofState. (f)Compulsory disclosure byemployeesof firms doing business withthecity. Should any person included in theterms defined in paragraphs (b)(1)through (6)be employed by a corporation, firm,partnership or business entity in which thatpersonorthe immediate family doesnot have a controlling financial interest,and should the corporation,firm,partnership or business entityhave substantial business commitments toor from the city or any city agency,orbe subject todirect regulation bythe city oracity agency, thentheperson shall file aswornstatement disclosing such employment andinterestwiththeclerkofthe city. (g)Exploitation of official position prohibited. Noperson included intheterms defined in paragraphs (b)(l)through (6)shall corruptlyuseorattempttousean official position tosecure special privileges or exemptions forthatpersonorothers. (h)Prohibitiononuse of confidential information. Noperson included intheterms defined in paragraphs (b)(1)through (6)shall accept employment or engage in anybusinessor professional activity which onemight reasonablyexpectwouldrequireorinduceoneto disclose confidential information acquiredbyreasonofan official position,nor shall thatpersoninfactever disclose confidential information garneredor gained throughan official position withthe city,nor shall thatpersoneverusesuch information,directly or indirectly,forpersonal gain or benefit. No person includedinthe terms definedinparagraphs (b)(1)through(6)shall accept other employmentwhich wouldimpair independence of judgment in the performance ofanypublicduties. (j)Prohibition on outside employment. (1)Nopersonincludedinthe terms definedinparagraphs(b)(6)shallreceiveanycompensationforservicesasan officer or employee of the cityfromany source other than the city,except asmaybe permitted asfollows: a.Generally prohibited.Nofull-timecityemployeeshallacceptoutsideemployment,either incidental,occasional or otherwise,where citytime,equipment or materialistobeused or where such employment or any part thereof is to be performed oncitytime. b.When permitted.Afull-timecityemployeemay accept incidental or occasional outside employmentsolongas such employment isnot contrary,detrimental or adversetothe interest of the city or anyofits departments and theapproval required insubparagraphc.isobtained. c.Approvalof department headrequired.Anyoutsideemploymentbyanyfull-timecityemployeemustfirstbe approved inwritingbythe employee's department headwhoshallmaintaina complete record ofsuch employment. d.Penalty.Anypersonconvictedofviolatinganyprovisionofthissubsectionshallbepunishedasprovidedin section I-I I ofthe Code ofMiami-Dade County and,inadditionshallbesubjecttodismissalbytheappointing authority.Thecitymayalsoassessagainstaviolatorafinenotto exceed $500.00andthecostsofinvestigation incurred by the city. (2)Allfull-timecityemployeesengagedinany outside employmentforanyperson,firm,corporation or entity other thanthecity,oranyofitsagenciesorinstrumentalities,shall file,underoath,anannual report indicatingthe source oftheoutsideemployment,thenatureoftheworkbeingdoneandany amount ofmoneyor other consideration receivedbytheemployeefromtheoutsideemployment.Cityemployee reports shallbefiledwith the cityclerk.The reports shallbe available atareasonabletimeandplaceforinspectionbythepublic.Thecity managermay require monthly reports from individual employees or groupsofemployeesforgood cause.. (k)Prohibited investments. Nopersonincludedinthetermsdefinedinparagraphs (b)(1)through(6)oramemberoftheimmediate family shallhavepersonalinvestmentsinany enterprise which will create asubstantialconflict between private interests andthepublic interest. (I)Certain appearances and payment prohibited. (1)Nopersonincludedinthe terms definedinparagraphs (b)(1),(5)and(6)shallappearbeforeanycityboardor agencyandmakea presentation onbehalfofathirdpersonwith respect toanymatter,license,contract, certificate,ruling,decision,opinion,rate schedule,franchise,or other benefit sought by the third person.Nor shall thepersonreceiveany compensation or gift,directly or indirectly,forservices rendered toathirdperson,who hasappliedfororisseeking some benefitfromthecityoracityagency,in connection withtheparticularbenefit sought by the thirdperson.Nor shallthepersonappearinany court or beforeanyadministrativetribunalas counselor legal advisortoapartywhoseeks legal relieffromthecity or acityagencythroughthesuitinquestion. (2)Nopersonincludedinthe terms definedinparagraphs (b)(2),(3)and(4)shall appearbeforethecity commission or agencyonwhich the personserves,either directly or through an associate,andmakea presentation onbehalfofathird person with respect toany matter,license,contract,certificate,ruling,decision, opinion,rateschedule,franchise,or other benefitsoughtbythethirdperson.Nor shallsuch person receiveany compensation orgift,directly or indirectly,forservices rendered to athirdpartywhohasappliedfor or isseeking somebenefitfromthecitycommission or agencyonwhichthepersonservesin connection withtheparticular benefitsoughtbythethirdparty.Norshallthepersonappearinany court or beforeanyadministrativetribunalas counselor legaladvisortoathirdpartywhoseeks legal relieffromthecitycommission or agencyonwhichsuch person servesthroughthesuitinquestion. (m)Actions prohibited whenfinancial interests involved. Nopersonincludedinthetermsdefinedinparagraphs(b)(I)through(6)shallparticipateinany official action directlyorindirectlyaffectingabusinessinwhich that personorany member oftheimmediate family hasa financial interest.A financial interest isdefinedinthissubsection to include,but not belimitedto,any direct or indirect interest inanyinvestment,equity,or debt. (n)Acquiring financial interests. Nopersonincludedinthe terms definedinparagraphs (b)(1)through(6)shallacquirea financial interest ina project,business entity or property atatimewhen the person believes or has reason to believe that the financial interest maybedirectlyaffectedby official actionsorby official actionsbythecity or cityagencyofwhichthe personisan official,officer or employee. (0)Recommending professional services. Thomas F.Pepe 02-23-15 25 No person includedinthe terms definedinparagraphs (b)(1)through(4)may recommend theservicesofany lawyer or lawfirm,architect or architectural firm,publicrelations firm,or any other person or firm,professional or otherwise,toassistinany transaction involving the cityoranyofitsagencies,provided that a recommendation may properly bemadewhen required tobemadebythedutiesof officeandinadvanceata public meetingattendedby other city officials,officers oremployees. (p)Continuing application after city service. (1)Noperson included intheterms defined in paragraphs (b)(1),(5)and(6)shall,foraperiodoftwoyearsafter hisorhercityserviceoremploymenthasceased,lobbyanycity official [asdefinedinparagraphs (b)(1)through (6)]in connection withany judicial,or other proceeding,application,RFP,RFQ,bid,requestfor rulingor other determination,contract,claim,controversy,charge,accusation,arrest or other particularsubject matter inwhichthecity or oneofitsagenciesisapartyorhasany interest whatever,whether direct or indirect. Nothing contained inthis subsection shall prohibitany individual from submitting aroutine administrative request orapplicationtoacity department or agency duringthetwo-yearperiodafterhisorherservicehasceased. (2)The provisions ofthe subsection shall not apply to persons who become employed by governmental entities, 501(c)(3)non-profit entities or educational institutions or entities,andwho lobby on behalf ofthoseentitiesin their official capacities. (3)The provisions ofthis subsection shall apply to all persons described in paragraph (p)(l)whose city serviceor employment ceased after the effectivedateof the ordinance fromwhichthissectionderives. (4)No person described in paragraph (p)(l)whose city service or employment ceased within two years priorto the effective dateof this ordinance shall fora period oftwo years after his orher service or employment enter intoa lobbying contractto lobby any city official in connection with,any subject described in paragraph (p)(l)in which thecityoroneofits agencies isapartyorhasanydirectand substantial interest;andin which heorshe participated directly or indirectly through decision,approval,disapproval,recommendation,the rendering of advice,investigation,or otherwise,during his orher city service or employment.A person participated "directly" whereheorshe was substantially involved in the particular subject matter through decision,approval,disapproval, recommendation,the rendering of advice,investigation,or otherwise,during his orher city service or employment.A person participated "indirectly"where heor she knowingly participated in any way in the particular subjectmatter through decision,approval,disapproval,recommendation,the rendering of advice,investigation,or otherwise,during his orher city service or employment.All persons covered by this paragraph shall executean affidavit ona form approved bythe city attorney priorto lobbying any city official attesting thatthe requirements ofthis subsection donot preclude theperson from lobbying city officials. (5)Any person who violates this subsection shall be subject tothe penalties provided in section 8A-2(p). (q)City attorney torenderopinionsonrequest.
