RESOLUTION NO.161-16-14716 A Resolution approving a special use approval to permit a general restaurant at 7400 SW 57 Court. WHEREAS,pursuant to Section 20-3.4(B)(4)(b)of the Land DevelopmentCode (LDC)? the applicant,Chopsticks Restaurant Group,LLC submitted Application No.PB-16-017 tothe Planning Board requesting a Special Use Approval to operate a general restaurant located at 7400 SW 57 Court,within the Residential Office "RO",Hometown District Overlay "HD-OV" zoning district;and WHEREAS,the applicant proposes toleasethe existing vacant space that willfronton SW 57 Court;and WHEREAS,restaurants are permitted asaspecialuse within the Residential Office "RO",Hometown District Overlay "HD-OV"zoning district andare subject to meeting the general conditions specified inLDC Section 20-5.8and subject to meeting the special use requirements setforthinLDC Section 20-3.4(B)(4)(b)fora general restaurant;and WHEREAS,the applicant's restaurant specialuse meets the special use requirements set forth in LDC Section 20-3.4(B)(4)(b)which are: i.All such establishments shall provide only inside or patio service on private property.Public streets,rights-of-way,sidewalksand required setbacks maynotbeused forpatioor street-side services of anykind. ii.No services of a drive-in or of afastfood nature shall be permitted. iii.Thecity commission shall review and recommend approval,disapproval or modification of allsiteplansand project specifications forthisspecialusepermit;and WHEREAS,theapproval of aspecialuserequiresa recommendation fromthePlanning Boardandtheapproval of theCityCommissionafterapublichearing;and WHEREAS,attheJuly21,2016 PlanningBoardmeeting,andfollowingapublic hearing,theBoardreviewedapplication PB-16-017 andvoted6ayes,0naystorecommended approval of the request foraspecialusetooperatearestaurant;and WHEREAS,theCity Commission desirestoacceptthe recommendation of the Planning Board. Subject Property located at 7400 SW 57 Court Request: Chopsticks Restaurant Group,LLC,the applicant,is requesting approval to operate a general restaurant in the first floor tenant space located at 7400 SW57 Court via the Special Use approval process outlined in Section 20-5.8 of the Land Development Code. SpecialUse Approval -7400 SW 57 Court August 16,2016 Page2 of 5 Analysis: Pursuant to the SpecialUse Conditions,Section 20-3.4 of the LDC,aspecial use may be approved and permitted by the City Commission atapublic hearing,after a recommendation by the PlanningBoard,provided that suchusecomplieswith the general requirements,special requirements,andany other conditions that the City Commission may consider appropriate and necessary. When reviewing the project,the following items are noted: •Theproposed tenant spacewilloccupy the entirefirstfloorof the two (2)storybuilding. Thespacewaspreviously occupied byTuttiBambini,aclothing store. •The subject property is near similar restaurant uses to the north (TownKitchen&Bar, Mojito's,andCafePastis)and to the east (Food Spot w/Subway,ChickenKitchen,and Power Pizza). •Inaddition to the proposed use,existingprofessionalservice type usesarelocatedin the buildingon the second flooraswell.Also,professional type usesarelocated to the east of the subject property. •Residential typeusesarelocatedtoboththesouthandto the west of the subjectproperty. •Pursuantto the attachedSite/Floor Plan,sheet A-l providedby the architect,Greg Neville, The breakdown of the tenant spaceisas follows: o Patron Area:1,166 S.F. o Non-Patron Area:1,532 S.F. •When the building was originally designed,ii wasproposedthat the first floorwould contain retail typeusesandthesecond floor would contain officetypeuses.Thisisevident intheattached site plan,SP-1,whichshowsthatthe building wasdividedintoboth retail and officeusesthat required atotaloftwenty-six (26)parking spacesatthetimewhenit was originally designed.Becauseitwasamixeduse building,a parking spacereductionof 20%wasapplied to the project that reduced the amount ofrequired parking spacesto twenty (20).Thisreductionwas consistent withSection 20-7.6(B)(2)whichstates: The following parking reduction shallapplytomixeduse buildings withtwo(2)or moreofthethree(3)usecategories (retail,office,residential)usesprovided that nooneuse constitutes more than seventy-five (75)percent of thegross floor area:the total requiredparkingspacesforamixedusebuildingshallbereduced by twenty (20)percent Special Use Approval -7400SW 57 Court August 16,2016 Page 3 of 5 •TheattachedSitePlan,sheet SP-1,alsoindicated that the building hasfourteen(14)off- street parkingspaces.Itis important tonote that whenthebuildingwasdesigned,it receivedcreditforatotalofsix(6)on-street parking spaces that weredirectlyadjacentto the building.This parkingspacecreditisconsistentwithSection 20-7.6(B)(l)of the LDC which states: On-street spaces adjacent toalotshallcounttowardtheparkingrequirements forthatlot;apartialspacelongerthaneleven(11)feet shallcountasafull space. Asshownon the attached Site/FloorPlan,sheet A-l,the applicantisproposingto renovate the tenant space in order to accommodate the useofa general restaurant.This includes the installationofanewkitchenwithfoodprepareaandabararea.Typically,both the restaurant andbaruse are prohibited in the RO zoningdistrict.However,because the property islocated in the Hometown District,these types ofusesare permitted under the HometownDistrict Overlay.Pursuant toSection20-7.2(B)of the LDC, The requirements of thisArticleshallbeinadditiontoeachandeveryother requirement of the City of SouthMiami Land DevelopmentCode (Code),andin the case of conflict,theprovisions of this Article shall control. Furthermore,pursuant to Section 4-2(a)of the CityCodeof Ordinances,the distance requirement for the sale of alcoholic beverages of500 feet between residential properties and restaurants,bar/lbunges andnightclubs does notapplywithin the Hometown District.Also,the 500 foot distance requirements between restaurants,bar/lounges and nightclubs located within the Hometown District and residential properties located just outside the Hometown District does not apply either. Parking Space Analysis Pursuant to Section 20-7.12(A)of the LDC,the parking condition for a general restaurant isas follows: •Oneparking space per 100 SF devoted topatronuse •Oneparking space per 300 SF devoted tonon-patronuse Pursuant to the information provided,the minimum amount of parking spaces required for the proposed general restaurant isas follows: Patron Use Parking Space Requirement 1,166 &-F7 1 Parking Space 100 SrA =11.66 Parking Spaces «12 Parking Spaces SpecialUse Approval -7400 SW 57 Court August 16,2016 Page4 of 5 Non-Patron Use Parking Space Requirement 1,532 £rft 1 Parking Space 300£rft =5.10 Parking Spaces «6 Parking Spaces Basedon the calculationslistedabove,the proposedgeneral restaurant willbe required to provide a minimum of eighteen (18)parkingspaces. After the 20%reduction listedinSection20-7.6(B)(l)of the LDC wasoriginally applied to the building,a total of twenty (20)parking spaces were requiredfor the building with ten (10)of those spaces beingrequiredby the retail component.When applied to the proposed restaurant use,there would bea deficit of eight (8)parking spaces.In order to meet the minimum requiredparkingfor the proposed restaurant use,the applicant would either have to payinto the Hometown District Improvement Trust Fund of $l,000/parking space deficient or obtain a SpecialExceptionwaiving the deficient parkingspaces.This requirement is consistent with the following LDC sections: •Section 20-7.6(CU2Mb) //thereare fewer spaces providedthanrequiredforexisting buildings,the applicantmay:obtainaspecialexceptionwaivingthenumberofadditional spaces requiredin accord withtheprocess set forthinSection20-7.51 of this chapter;or pay intotheHometown District ImprovementTrust Fund afeeas set forth below. •Section 20-7.6(CM2Md The feepaymentintothe Hometown District Improvement Trust Fund foreach space required but not providedshallbeonethousanddollars($1,000.00)per parkingspaceperyearpayable at thetime of renewal of theoccupational license.This fee may be adjusted periodicallybytheCity Commission as appropriate. Atthistime,the applicant hasnotinformedstaffofhowtheywantto address theshortageof required parking spaces. Special Use Approval Afterreview of the project,the proposed general restaurantusecomplieswithboththe generaland special requirements listedinbothSection 20-3.4(A)andSection 20-3.4(B)(4)(b)of the LDC,respectively,in that the use: •Is compatible and complementary to the existing uses within the surrounding areas; •Shallprovideonlyinsideorpatioservice;Public streets,rights-of-way,sidewalksand required setbacks may notbeusedforpatioor street-side services of anykind; •Noservices of adrive-inorofafastfoodnatureshallbe permitted;and SpecialUse Approval -7400 SW 57Court August 16,2016 Page5 of 5 Furthermore,the requested specialusedoesnotconflictwith the Comprehensive Plan and complieswith the LDC requirements set forthinSection20-5.8(B)(l)of the LDC in that the use: a)Will notadverselyaffectthehealthorsafetyofpersons residing or working in the vicinity of the proposed use, b)Willnotbe detrimental to the publicwelfareorpropertyor improvements in the neighborhood;and, c)Complieswithall other applicableCodeprovisions. Last,if the specialuseis,in the future,determined by the Director of Planning to be adversely affecting the healthor safety of personsresidingorworkinginthevicinity of the proposeduse, tobe detrimental to the publicwelfareorpropertyor improvements in the neighborhood,orto benotincompliancewith other applicableCodeprovisions,the specialuseapprovalmaybe modifiedor revoked by the CityCommissionuponnotificationandpublichearing. Planning Board Action: After the publichearingheldfor the item at the PlanningBoard'sJuly21,2016 meeting,the Board recommended approval PB-16-017 with a vote of 6 to 0. Mr.Basu stated that the location of the proposed restaurant is a good example of shared parking. When asked about the amount of patrons will come to the restaurant,Mr.Friedman stated that there would be approximately fifty (50)seats.
