Resolution No.071-16-14626 A Resolution approving an application fora waiver of off-street parking space requirements for the property located at 6144S.Dixie Highway. WHEREAS,Manaca South Miami Center submitted an application PB-15-030 fora variance to reduce the required number of off-street parking spaces from27to24fora proposed commercial redevelopment that includes a combination of general restaurant and retail use that willbe located at 6144 South Dixie Highway inthe General Retail (GR)zoning district;and WHEREAS,subject to Section 20-4.4(B)(ll)of theLand Development Code which states that the parking condition for retail useis generally one(1)parking space per three hundred (300)square feet of grossfloorarea,atotal of twelve (12)off-street parking spaces are required;and WHEREAS,subject to Section 20-4.4(B)(7)of the Land Development Code which statesthatthe parking condition for general restaurant useisone(1)parking space per one hundred (100)squarefeet of grossfloorarea,atotal of fifteen (15)off-street parking spacesare required;and WHEREAS,the applicant is proposing atotal of twenty-one (21)off-street parking spacesforthe proposed commercial redevelopment;and WHEREAS,the applicant is proposing to redevelop the public right-of-way byadding bothlandscapingandtwo(2)additionalparkingspacesrequiringthattheapplicantcomplywith theregulationslistedinSection20-4.4(A)(2)of theLand Development Code;and WHEREAS,Section20-4.4(A)(2)of theLand Development Codeprovidesthat "unimprovedrights-of-wayadjacenttobusinesspropertyincommercialzoningdistrictsmaybe improvedbytheabuttingpropertyownerforcreditason-streetparkingspacesbywritten agreement approved bythe application totheCity Manager provided thatthepropertyowner complies with subsection 20-4.4(A)(3)";and WHEREAS,Section 20-4.4(A)(3)of theLand Development Code provides that "An annualfee of onethousanddollars($1,000.00),perspace,whichshallincreasefive(5)percent annually,shallbepaidintotheParkingFundforallon-streetparkingspaceswhicharecredited orcountedtowardrequiredparkingfornewstructures,orachangeinusethatincreasesthe minimumnumber of off-streetspacesrequiredafterthedate of January2,2008";and WHEREAS,PursuanttoSection20-5.9(H)of theLandDevelopmentCode,The City's PlanningandZoningDepartmenthasmadethefollowingfindings: 1.The variance is necessary in order to accommodate the minimum amount of off-street parkingspacesrequiredtodeveloptheproposedcommercialredevelopment. Res.No.071-16-14626 2.Denyingthevariancewouldlimititsredevelopmentcapabilityinamannerthatis morerestrictivethanotherpropertiesintheGRzoningdistrict. 3.Theextraordinaryconditionsandcircumstancesareduetotheirregularshapedlot, notthe applicant. 4.Basedonthesize of thesubjectlot,therequestedvarianceistheminimumvariance necessary to make possible the reasonable use of theland. 5.BecausetheareasurroundingthesubjectpropertyiswithintheGRzoningdistrict, thevariancewouldnotbeinjurioustotheneighborhoodordetrimentaltothepublic welfare of the community. WHEREAS,theapproval of avariancerequiresarecommendationfromthePlanning Boardandtheapproval of theCityCommissionafterapublichearing;and WHEREAS,atthe November 10,2015 PlanningBoard meeting,andfollowingapublic hearing,theBoardreviewedapplication PB-15-030 andvoted5ayes,0naystorecommend approval of therequestforavariancetoreducetherequirednumber of parkingspacesfrom27to 24forthe proposed commercial redevelopment;and WHEREAS,theCity Commission desirestoacceptthe recommendation of thePlanning Board and approve the Variance. NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1:Therecitalssetforthinthisresolutionaretrue,theyaresupportedby competentsubstantialevidenceandtheyareincorporatedintothisresolutionby reference. Subject Building located 6144 S.Dixie Highway Variance -6144 5.DixieHighway April 5,2016 Page2of5 Request: After reviewing the variance request for compliance with the Land Development Code (LDC), Comprehensive Plan andFutureLandUse Map,the applicant is requesting the following: 1.Variance of off-street parking space requirements to permit 23 off-street parking spaces where 27are required via Section 20-5.9(H),LDC 2.Improvement of the right-of-way adjacent to the subject property for credit as on-street parkingspacesviaSection 2Q-4.4(A)(2),LDC 3.Payment into the City of South MiamiParkingFundvia Section 20-4.4(A)(3),LDC Analysis: Pursuant to the Varianceapprovals,Section20-5.9 of the LDC,avariancefor off-street parking canbereviewedandpermittedbythecitycommissionata public hearing,aftera recommendation by the planning board. Whenreviewing the project,the followingitemsarenotedabout the project: •Thespaceis currently occupied byafurniturestore. •Once redeveloped,the proposed redevelopment will consist of the followingsquare footages: oRetailUse:3,510 square feet o Restaurant Use:1,500 square feet •Pursuant to Section 20-4.4(B)(ll)of the LDC,the parkingconditionforretailuseis generally one (1)parkingspaceper three hundred (300)square feet of grossfloorarea •Pursuant to Section 20-4.4(B)(7)of the LDC,the parking condition forgeneral restaurant useis one (1)parkingspaceper one hundred(100)square feet of grossfloorarea Parking Analysis Asshownon the attachedrevisedsite plan,the applicantisproposinga complete redevelopment of the site.Pursuant to the information listed above,the retail component of the redevelopment willrequireatotal of twelve (12)parking spaces,whereas the general restaurant component willrequire fifteen (15)fora total of twenty-seven (27)parkingspaces requiredfor the project. After review of the attached revisedsiteplan,itis shown that the applicantwillbeprovidinga total of twenty-one (21)parkingspaceson the siteand one (1)turnaroundspace.Itis important to note that as shown on the attached Revised Plat for Larkin Pines as well as the Sketch of BoundarySurvey,the area to the southof the subjectpropertyhas been reservedfor parkingand beautification which is considered publicright-of-way.Theapplicantisproposing to redevelopthisareaaswell,adding both landscapingand two (2)additionalparkingspaces.If approved,the applicant would have to comply with the regulations listedinSection20- 4.4(A)(2)of the LDC which isas follows: Variance -6144 5.Dixie Highway April 5,2016 Page3of5 Unimproved rights-of-way adjacent to business property in commercial zoning districts may be improved by the abutting property owner for credit as on-street parking spaces by written agreement approved by the application to theCity Manager provided that the property owner complies with subsection 20- 4.4(A)(3).TheCity Manager upontheadvice of theParkingBoard,will determine if the installation of parking meters is warranted and appropriate for the area. Furthermore,pursuant to Section 20-4.4(A)(3)of the Land Development Code, Anannual fee of one thousand dollars($1,000.00),per space,whichshall increase five(5)percent annually,shallbe paid intotheParkingFund for all on- street parking spaces whichare credited or counted toward required parkingfor new structures,orachangeinusethatincreasestheminimum number of off- street spaces required after the date ofJanuary2,2008. Once redeveloped,the applicant will be providing a total of twenty-three (23)off-street parking spaces for the project.In order to meet the minimum requirement of twenty-seven (27)off- street parkingspacesfor the project,the applicantis requesting avariance to waive four(4)off- street parking spaces. Because the applicant's project will affect the public right-of-way,the proposed commercial redevelopment was reviewed by the Public Works Department.As referenced in the attached emails,Public Works isin agreement with the proposed configuration of the alley in that itwill be safer for the users.Furthermore,Public Works has requested that a tree covenant be put in place that will cover all of the landscape improvements that are proposed within the right-of- way.Last the Public Works department is requiring that the applicant make sure that the locations of the proposed plantings do not conflict with any existing utilities. Variance Approval Pursuant to Section 20-5.9(H)of the Land Development Code,all variance decisions shall be based onan affirmative findingas to each of the followingcriterion: 1.The variance is necessary to relieve particular extraordinary conditions relating to a specific property; Due to the sizeand configuration of the subject property,avariance would be necessary to accommodate the minimum amount of off-street parking spaces required to redevelop commercial square footage that is comparable to the amount currently developed on the property (approximately 6,434 S.F.). 2.Denial of the variance would result in hardship to the owner.Hardship results if the restriction of the zoning ordinance,when applied toa particular property,becomes Variance -6144 S.Dixie Highway April 5,2016 PageA of 5 arbitrary,confiscatoryorundulyoppressivebecauseofconditionsofthe property that distinguishitfrom other properties undersimilarzoningrestrictions; Due to the irregular shape of the subject property,denial of the variance would limit the redevelopment capability of the siteand make it more restrictive than other properties in the GR district. 3.Theextraordinaryconditionsand circumstances donotresultfromtheactionsofthe applicant; The shape orsize of the lothas not been reduced or modified by the applicant.The current shape of the lotis how it was originally platted. 4.The requested varianceisthe minimum variancenecessarytomakepossiblethe reasonable use of the land,buildingor structure; While there isn't a maximum requirement forbuilding coverage for the "GR"zoning district,the district does have a maximum impervious coverage whichis85%of the lot. Basedon the size of the subject lot,the maximum amount of impervious coverage allowed for the site would be approximately 13,136 square feet.Because the applicant is proposing to pave 13,136 square feet (85%),there would be no additional area available to add the parking spaces that are deficient.Furthermore,the applicant is proposing the best use of the irregularly shaped lot. 5.Thatthe approval of thevariancewillbe consistent withthe general intent and purpose of theLand Development Code,and will not be injuriousto the neighborhood or otherwise detrimental to the public welfare. Because the area surrounding the subject property is populated with commercial type uses followed by residential districts further to the east,a buffer between the subject property and the residential properties has been created.Because of this,a variance for four(4)parking spaces would not beinjuriousto the neighborhood or detrimental to the public welfare of the community. Planning Board Action: At the November 10,2015public hearing the PlanningBoard recommended approvalof the Variance with a vote of 5 to 0.
