A Resolution for special use approval to permit a general restaurant at

WHEREAS,pursuant toSection 20-3.4(B)(4)(b)of theLand Development Code(LDC),
theapplicant,Manaca South Miami Center,LLC submitted Application No.PB-15-029 tothe
Planning Board requesting aSpecialUseApprovaltooperateageneral restaurant located at
6144 South Dixie Highway,within the General Retail "GR"zoning district;and
WHEREAS,the applicant proposestodemolishand construct anewgeneral restaurant
inthe existing vacant space that willfrontonSouth Dixie Highway;and
WHEREAS,restaurants are permitted asaspecialuse within theGeneralRetail "GR"
zoningdistrictandissubjecttomeetinggeneralconditionsspecifiedinLDCSection20-5.8and
subjecttomeetingspecialuserequirementssetforthinLDCSection20-3.4(B)(4)(b);and
WHEREAS,the applicant's generalrestaurantspecialusemeetsthespecialuse
requirementssetforthinLDCSection20-3.4(B)(4)(b)whichare:
i.Allsuchestablishmentsshallprovideonlyinsideorpatioserviceonprivate
property.Publicstreets,.rights-of-way,sidewalksandrequiredsetbacksmaynotbe
used for patio or street-side services of anykind.
ii.No services of a drive-in or of afastfood nature shallbe permitted.
iii.Thecity commission shallreviewand recommend approval,disapproval or
modification of allsiteplansandproject specifications forthisspecialusepermit;
and
WHEREAS,pursuanttoSection 20-5.8(C)of theLDC,anapprovedspecialuseshall
lapseaftersix(6)months if nomasterbuildingpermitwhichimplementsthespecialuseor
certificate of occupancyhasbeenissuedforsuchuseand if thecitycommissionhasnotspecified
a longer approval period for good cause;and
WHEREAS,the applicant isrequestingaone(1)year extension onthespecialuse
approvalinorderto allow for coordination and proper planning of theproject;and
WHEREAS,the approval of aspecialuserequiresa recommendation from the Planning
Boardandthe approval of theCity Commission aftera public hearing;and
WHEREAS,atthe November 10,2015 Planning Board meeting,and following a public
hearing,the Board reviewed application PB-15-029 and voted 5ayes,0naysto recommend
approval of the request fora special useto operate a general restaurant;and
WHEREAS,theCity Commission desiresto accept the recommendation of the Planning
Board.

NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1.The recitals set forth inthis resolution aretrue,they are supported by
competent substantial evidence andtheyareincorporatedintothis resolution byreference.
Section 2.Special Use Application (PB-15-029)submitted by applicant Manaca South
Miami Center LLC,to operate ageneral restaurant located at6144 South Dixie Highway,within
the General Retail "GR"zoning district ishereby approved subject tothe following terms and
conditions aswellasall applicable City ordinances,codes,rulesand regulations:
1.Adhere tothe Special Conditions applicable inSection 20-3.4(B)(4)(b)
General Restaurant andSection20-5.8SpecialUseApproval of theLand
Development Code,listed.
2.The request foranextension of timetoallowfor coordination andproper
planning of the project isapprovedforaperiod of 360daysfollowingtheinitialsix
(6)month Special Use time period.
3.Anyandall exterior renovationsor modifications forthenew establishment
are subject to approval by the ERPB.
4.A parking covenant shallbe executed and recorded,satisfactory totheCity
Attorney,toinsurethattheparkingontheentireparcelisavailabletoallusers of the
property.
Section 3.Severability.If anysectionclause,sentence,or phrase of thisresolutionisfor
anyreasonheldinvalidor unconstitutional byacourt of competent jurisdiction,theholdingshall
not affect the validity of the remaining portions of this resolution.
Section 4.Effective Date.This resolution shall become effective immediately upon
approval byvote of theCity Commission.

KNOW ALL MEN BY THESE PRESENTS thatthe undersigned,Manaca South
MiamiCenter.LLC(the "Owner"),herebymakes,declaresand imposes onthelands herein
described,this Parking Covenant (the "Covenant"),andthe covenants running withthetitleto
thelands contained herein,whichshallbebindingonOwnerand their heirs,successors and
assigns,personal representatives,mortgagees,lessees,andagainstall persons claiming by,
through or under them.
WHEREAS,Owner isthe owner of that certain property within theCity of South Miami,
a Florida municipal corporation (the"City"),locatedat 6144 South Dixie Highway in Miami-
Dade County,Florida,more particularly describedon Exhibit "A"(the"Property");and
WHEREAS,Owner,anditssuccessors,heirs,andassigns,intendsto construct onthe
Propertya mixed-use development (the "Development");and
WHEREAS,OwnerdesirestoenterintothisCovenantinordertoassurethe City that
Owner,itssuccessorsorassigns,willcomplywiththeconditions of theResolutiongrantinga
specialusetopermitarestaurantandawaiverofoff-streetparkingregulations.
NOW,THEREFORE,forvaluableconsideration,thereceiptandsufficiencyofwhich
areherebyacknowledged,theOwnerherebyagreesasfollows:
1.Theaboverecitalsaretrueandcorrectandbythisreferenceareincorporatedasif
fully set forth herein.
2.OwnerdesirestoenterintothisCovenantrunningwiththelandtoassuretheCity
thattheOwnerwillcomplywiththeconditionsoftheResolutionsapprovingthespecialuseand
waiver.

3.IfthePropertyissoldorconveyedsubsequenttotherecordation of thisCovenant,
whichrunswith,touchesand concerns the Property,eachofthesubsequentowner(s)andtheir
heirs,successors and assigns,as applicable,shall be bound bythe terms,provisions and
conditions of this Covenant.
4.FortheTermofthisAgreement,Owneragreesthatoff-streetparkingonthe
PropertyasshownonthesiteplanapprovedbytheCityCommissionshallbeavailableatall
timestovisitorstotheProperty.Nospacesshallbereservedforcertainusers of theProperty,
exceptforspaceslimitedtovehicleturnaroundandspaceslimitedtohandicappedpersons.
5.TheprovisionsofthisCovenantshallbecomeeffectiveuponitsrecordationinthe
PublicRecords of Miami-DadeCounty,Florida.Intheeventitisnecessaryordesirabletore-
record,thenattheoption of theCityandifallowedbylaw,theCovenantmaybere-recorded
whennecessaryorrequiredtomaintain,uninterrupted,theeffectiveness of thecovenantrunning
with theland during the entire term of this Covenant.
6.This Covenant maybe modified,amended,or released astoany portion of the
Property bya written instrument executed on behalf of the Owners and approved bytheCity
Commission.Shouldthisinstrumentbemodified,amendedorreleased(otherthanasprovided
in Section 5 above),theCity Manager shall execute a written instrument inrecordable,formtobe
delivered tothe Owner and recorded inthePublic Records of Miami-Dade County,Florida,
effectuating and acknowledging such modification,amendment,or release,inaform approved
bytheCity Attorney.
7.Invalidation of anyofthesecovenantsby judgment of courtshallnotaffectany of
theother provisions,whichshallremaininfullforceandeffect.
8.Allrights,remediesandprivilegesgainedhereinshallbedeemedtobe
cumulative and the exercise of any oneor more shall neither be deemed to constitute an election
or remedies,norshallitprecludethepartyexercisingthesamefrom exercising suchother
additional rights,remedies or privileges as may be available toit.
9.This Covenant shallbe recorded inthe Public Records of Miami-Dade County,
Florida,at Owner's expenseonorbeforeJune30,2016 unlessanextensionoftimetorecordis
grantedinwritingbytheCityAttorney.Ownershalldeliveracertifiedcopy of thisrecorded
Covenant tothe City Attorney within thirty (30)days of recordation.
10.ThisCovenantshallbebindingontheOwnerandeachthe subsequent owneras
wellastheirheirs,successorsandassigns,asapplicable,eachshallbeboundbytheterms,
provisionsandconditionsofthisCovenant.

Background:
Located in the General Retail (GR)zoning district,the applicant is proposing to redevelop the
site located at 6144 S.Dixie Highway which currently hasa one-story building that is occupied
bya furniture store.As part of the revitalization,the applicant is proposing to demolish the
existing one-story building and construct two (2)new separate one-story buildings on the site.
One structure will support retail while the other structure will support restaurant space.
Subject Building located 6144 S.Dixie Highway
Request:
After reviewing the proposed general restaurant usefor compliance with the Land
Development Code (LDC),Comprehensive Plan and Future LandUse Map,the applicant is
requesting the following:
1.SpecialUse approval via Section 20-3.4(A)and Section 20-3.4(B)(4)(b),LDC

Analysis:
Pursuant to the SpecialUse Conditions,Section20-3.4of the LDC,aspecial use may be
approved and permitted by the city commission atapublichearing,after a recommendation by
the^plinning board and that such use complies with the general requirements,special
requirements,andany other conditions that thecity commission mayconsider appropriate and
necessary.
Whenreviewing the project,the followingitemsare noted about the project:
•Thebuildingis currently occupied bya furniture store.
•The proposed project is near similar restaurant usesto the south (Kyojin Japanese Buffet,
McDonalds,andCafe Bonjour).
•Once redeveloped,the proposed general restaurant spacewillbe comprised of1,500
square feet.
Parking Analysis
As shown on the attached site plan,the applicant is proposing a complete redevelopment of
the site.Pursuant to both the Permitted Use Schedule,Section20-3.3(D)and Section 20-
4.4(B)(7)of the LDC,the parkingconditionforageneral restaurant useisone(1)parkingspace
per one hundred (100)square feet of gross floor area.Therefore,the 1,500 square foot general
restaurant willbe required to provideaminimumoffifteen(15)parking spaces where twenty-
two off-street parking spaces are being proposed.
Special Use Approval
After review of the project,the proposed general restaurant use complies with both the
general and special requirements listed in both Section 20-3.4(A)and Section 20-3.4(B)(4)(b)
and of the LDC,respectively,in that the use:
•Is in compliance with the General Retail (GR)zoning district;
o Is compatible and complementary to the existing uses within the surrounding areas;
•Is providing only inside or patio service on private property only;and
•Is not providing services of a drive-in orof a fast food.
Pursuant to Section20-5.8(C)of the LDC,an approved special use shall lapse after six(6)
months ifno master building permit which implements the special use or certificate of
occupancy has been issued for such use andif the city commission has not specified a longer
approval period forgood cause.The applicant is requesting a one year expiration extension of
the SpecialUseapproval to allow for coordination and proper planning of the project.Section
20-5.8(D)of the LDC allows for the CityCommissionto extend Special Use Approvals.Four(4)
affirmative votes of the city commission may grant an extension fora previously approved
special use ifa proper and timely request is made by the applicant prior to the expiration of the
approval period.

The requested special use does not conflict with the Comprehensive Planand complies with the
LDC requirements set forth in Section 20-5.8(B)of the LDC in that the use:
a.Will not adversely affect the health or safety of personsresidingor working in the vicinity
of the proposed use,»*
b.Will not be detrimental to the public welfare or property or improvements in the
neighborhood;and,
c.Complies withall other applicable Code provisions.
Last,if the specialuseis,in the future,determined by the Director of Planning,to be adversely
affecting the healthor safety of persons residingor working in the vicinity of the proposed use,
to be detrimental to the public welfare or property or improvements in the neighborhood,orto
be not in compliance with other applicableCodeprovisions,the specialuseapprovalmaybe
modified or revoked by the City Commission upon notification and public hearing.
Planning Board Action:
At the November 10,2015public meeting andfollowingapublichearing,the Board voted 5-0
to recommend approval of SpecialUse Permit application PB-15-029.
TheBoardalso recommended that the developer address an extension of the 6 month Special
Useapprovalwith the City Commission inorder to provide the time needed to construct the
new structures.
Recommendation:
Staff recommends approvalfor the SpecialUseapplication to operate ageneral restaurant with
a one (1)year extension fora total of one and one half [VA)yearsat6144S.DixieHighway
subject to the following terms and conditions aswellas all applicableCityordinances,codes,
rules and regulations:

Dr.Philips asked how the rear parking spaces wouldbe accessed,if there isno entrance,only
anexit.Mr.Proctor responded that the spaces wouldbe accessed through the alleyway.Dr.
Dr.Philips asked how employee parkingwouldbe managed.Mr.Proctor explained how the
parking space ratiofor restaurant usesin the GR zoning district workandhowit will manage
parking spaces for workers of the restaurant.
Mr.Basu stated that the correct parking space ratiofor restaurant usesfor the record.He
then stated that the city's parkingisanissue because the city uses suburban parking
requirements inan urban setting.The issue needs to be addressed.
Mr.Greiner stated that he was in agreement withMr.Basuin that the parking issue should be
addressed.

TheApplicantmakes the following specific requests in conjunction with the
Application:
1.SpecialUse Approval fora general restaurant,including beer/wine
service and outdoor dining;and
2.Varianceof parking requirements to permit 24 off-street parking spaces
(27 spaces required).
Therequestfora restaurant complieswiththe standards in the "GR"zoning
district,which allowsa broad rangeofretailuses,including restaurants.The
development ofa restaurant onthe Property will comply with City's prescribed
standards for"specialuse"approval in that a restaurant willnot adversely affect the
health and safety of persons residing or working in the areaandwill not be
detrimental to the public welfare.
The variancesof off-street parking requirements is substantiated by the
following facts:
1.The variance is necessary torelive particular extraordinary conditions
relating toa specific property.Thesize and configuration of the
Property result in variances to redevelop commercial square footage that
is comparable to the amount currently developed on the Property.
Developing additional restaurant space and fewer parking spaces than
required by the Land Development Code is necessary tojustify the
redevelopment.

2.Denial of the variance would result in hardship to the Owner.The shape
of the Property,with a narrow width of about 65 feet in the center of the
Property,distinguish the Property and limit the Property's
redevelopment capability ina manner that is morerestrictive than other
properties in the GR District.
3.Extraordinary conditions and circumstances do not resolve from the
actions of the Applicant.The Applicant has not reduced or otherwise
altered the sizeor shape of the Property since purchasing the Property in
2013.
4.The requested variance is the minimum variances necessary to make
possible the reasonable use of the land,building or structure.The Land
Development Gode offers unreasonable restrictions on restaurants by(1)
requiring more parking in the GR District for restaurants than required
in the Hometown District.
5.Approval of the variance will be consistent with the general intent and
purpose of the Land Development Code,arid will not be injurious to the
neighborhood or otherwise detrimental to the public welfare.The area
surrounding the Property is non-residential,and the right-of-way areas
include additional parking spaces available to visitors to the Property.
The application complies with Future LandUse Objective 1.1by
bringing the Property into compliance with the purposes ofthe current
Land Development Codein the following ways:
(a)The development isa Mixed-Use development that complies with
modern goalsand objectives;and
(b)The development dramatically expands the amount of
landscaping and open spaceon the Property.
Section20.5.8(c)of the Land Development Code provides that an approved
specialuseshalllapse after 6monthsifno master building permit hasbeenissued.By
virtue of this application and the ability of theCity Commission vested in the Land
Development Codeto extend the approval period,please accept this request toextend
thistimeframetoone(1)yearafterCity Commission approval.There areexisting
leases governing useof the Property that willdelay re-development.Inaddition,the
building permit process,particularly at certain Miami-Dade County agencies,is
lengthyandcumbersome.Theadditionaltimeperiodwillnot create adverseimpacts
to the surrounding area or to the public interest.
