ORDINANCE NO.12-16-2245 An Ordinance relating to the City's Schedule of Fee and Fines;amending ordinance 22-14-2200 to increase some fees,adding new fees,and deleting some fees from the schedule. WHEREAS,the Mayor and City Commission desires to adopt a new Fee Schedule allowing funding which will cover the cost of services provided;and, WHEREAS,the proposed changes are set forth in the attached Schedule of Fees and Fines and the text that is highlighted in yellow isfor tracking purposes only and shall be deleted when the ordinance is enacted after second reading;and WHEREAS,the Mayor and City Commission desire to revise the adopted Fee Schedule allowing funding which will cover the cost of services provided. NOW,THEREFORE,BEIT ORDAINED BYTHE MAYOR AND THE CITY COMMISSION OF THECITYOF SOUTH MIAMI,FLORIDA,THAT: Section 1.The Schedule of Fines and Fees,as approved in Ordinance 22-14-2200,is hereby amended soas to increase some fees,adding new fees,and deleting some fees from the schedule all as set forth on the attached Schedules taken from the 2014 Schedule of Fees and Fines.The 2014 Schedules that are not included in the attachment to this ordinance shall remain infull force and effect andshallbe included in this ordinance.Upon enactment the text highlighted in yellow that was used for tracking amendments to the schedule at first and second reading aswellasall text with aline striking through it and the amounts found in the columns labelled "Current"and "1st Reading"shall bedeletedfromtheschedules. Section 2.Any such fees maybe waived or reduced by the Mayor and City Commission by way of resolution. Section 3.Severability.If any section,clause,sentence,or phrase of this ordinance is forany reason heldinvalidor unconstitutional bya court of competent jurisdiction,this holding shall not affect the validity of the remaining portions of this ordinance. Section 4.Ordinances in Conflict.All ordinances or parts of ordinances and all sections and parts of sections of ordinances indirectconflict herewith are hereby repealed. At the April 19,2016,City Commission Meeting,the Mayor and Commission reviewed the proposed revisions to the City's "Schedule of Fees and Fines."TheCity Administration has recommended the below revisions through the suggestions provided by Commission or after further review by Department j Directors. Public Works &Utilities Fee Schedule The existing title has been revised from Public Works &UtilitiesFee Schedule to Public Works Fee Schedule,in order to clarify the charges associated with the Public Works Department. The fee title Street Name or Directional Signshas been revised to Directional Signs.Trash collections has been adjusted to1/3 truck load,8 cubic yards and appliances will have a new feeof $75 each.| Public Works barricades (up to 100)have also been adjusted to $250 per day.Barricades (101 or more)! each per daywillbe$3 each.1 The bridges,bus shelters,permanent traffic barricade,guardrail and guideposts permit classifications j were removed as they are not applicable within the Cityof South Miami.I Police Department Fee Schedule j Foroffdutywork,a$40per hour feeper the OfficerIsinplace,afivedollar per hour feeforuseofa marked police car when needed.The existing Radio fee per Officer,per day,as well as towing signs per j premises have been targeted tobe eliminated "in the proposed Ordinance tobesentto you soon for j youraction.Thisproposed Ordinance \s intended toeliminate current Codeprovisionswhichhavenot ! been implemented by the Cityfor many years.We are proposing a much simpler to administer process,! whichwillbemuch more effective for the community.; Tow operators and storage sites who require Police intervention due to disturbances and/or to settle ! disputes or have found not to have complied with all applicable Florida State Statues,Miami-Dade County Ordinances andorCityof South MiamiTowing Ordinances shallbe fined $500 by the Cityof South Miami after the 2nd documented police response.After12 such responses the Cityshall reserve the right to suspend any such operators Business License.Each such call for service requires two Officersto attend asitis reported asa disturbance.ThisisforOfficer safety.Eachcall takes two Officers off their other duties for as much as an hour. Parks &Recreation Fitness Center Fee Schedule Basedon the weight training and cardiovascular equipment available at the City's Fitness Center,andits proposed relocation to the ground floor,the Parksand Recreation Department is proposing to simplify the membership types and revise the fee schedule.Pleasefind below highlights of the changes which havebeenincorporatedbasedonthe Commission's recommendationsfromthe 1st reading andfurther review by the Parks and Recreation Department. Members who elect to enroll in monthly or annual recurring payment options with credit card willNOT be required to paya non-refundable,one-time administration/registration feeof $30.00 City staff evaluated the fees charged by other municipalitiesandprivateclubs located inMiami-Dade County and discovered the following proposed rates tobeinline: Parks &Recreation Community Pool Fee Schedule Swim and Water Aerobics Fees Water Aerobics Swim Classes $35unlimited monthly pass $60for810classes $5dailyclassfee Resident participants who attend all required classes (perfect attendance)are entitled toa $30 refund upon request.Request for refund must be made inwriting at least seven (7)days after the last class date.Refundsmaytake approximately 4-6 weeks tobe processed. Special Events Fee Schedule TheCityof South MiamiParksandRecreation Department is responsible for setting up the portable stage,extensions and attaching stairs.The Department has received several requests for the useof the City's stage fornon-City related events in the past year.City resources,includingstaff,vehicles and time are required to assemble and break-down the stage before and after an event. Every day,Isee kids stillnotproperlyre strained,so let's review what the recommenda tions are for children in vehicles: •Under 12 months: Yourchild under age1 should always rideina rear-facing car seat.There are different typesof rear-facing car seats:In fant-only seats can only be used rear-facing.Con vertible and 3-in-l car seats typicallyhave higher height and weight limits forthe rear-facing posi tion,allowingyouto keep your child Tear-facing for a longer period of time.A rear-facing car seat is best for youryoung child to use.It has a harness and ina crash,cradles and moves with your child to reduce the stress to the child'sfragileneckand spinal cord. •1 to 3 Years:Your child should remain in a rear-facing car seat until heorshe reaches the top heightorweightlimit allowed byyourcar seat's manufacturer.Once your child outgrows the rear- facing car seat,heorshe isreadyto travel ina forward-facing car seat with a harness.A for ward-facing car seat has a harness and tether that limits your child's forward movement during a crash. •4to7 Years:Keep your childina forward- facingcar seat witha harness until he or she reaches the top height or weight limit allowed by yourcar sefs manufac ture.Once your child outgrows the forward- facing car seat,it's time, to travel in a booster seat but still in the back seat. •3 to 12 Years:Keep your child ina booster seat untilheor she isbig enough tofitina seat belt properly.Fora seat belt to fitproperlythelapbelt must lie snugly across die upperthighs,not the stomach.The shoulder beltshouldliesnugacross the shoulder and chest and not cross the neck or face.Remember:Your child should still ride in the back seat because it's safer there.A booster seat positions the seat beltso that itfitsproperly overthe stronger parts of yourchild'sbody.
