RESOLUTION NO.1 60-1 6-1 471 5 A Resolution approving a special use approval to permit a general restaurant at 6620 SW 57 Avenue. WHEREAS,pursuant to Section 20-3.4(B)(4)(b)of the Land Development Code (LDC)? theapplicant,Apoke,Inc.submitted Application No.PB-16-015 tothe Planning Board requesting a Special Use Approval tooperatea general restaurant located at6620SW57 Avenue,within the Planned Unit Development -Mixed Use "PUD-M"zoning district;and WHEREAS,the applicant proposes to lease the existing vacant space that willfronton SW 57 Avenue;and WHEREAS,restaurants are permitted asa special use within the Planned Unit Development -Mixed Use MPUD-MM,zoning district andare subject to meeting thegeneral conditions specified in LDC Section 20-5.8and subject to meeting the special use requirements set forth in LDC Section 20-3.4(B)(4)(b)fora general restaurant;and WHEREAS,the applicant's restaurant special use meets the special use requirements set forth in LDC Section 20-3.4(B)(4)(b)which are: i.All such establishments shall provide only inside or patio service on private property.Public streets,rights-of-way,sidewalks and required setbacks may not beused forpatioor street-side services of anykind. ii.No services of a drive-in or of afastfoodnatureshallbe permitted. iii.Thecity commission shall review and recommend approval,disapproval or modification of allsite plans and project specifications forthis special use permit;and WHEREAS,the approval of a special use requires a recommendation fromthe Planning Board andthe approval of theCity Commission aftera public hearing;and WHEREAS,attheJuly21,2016 Planning Board meeting,and following apublic hearing,the Board reviewed application PB-16-015 and voted 6ayes,0naysto recommended approval of the request fora special usetooperatea restaurant;and WHEREAS,theCity Commission desires to accept the recommendation of the Planning Board. Subject Property located at 6620 SW 57 Avenue Request: Apoke,Inc.,the applicant,is requesting approval to operate a General Restaurant out of a tenant space located at RedRoad Commons,6620 SW57 Avenue via the Special Use approval process outlined in Section 20-5.8 of the Land Development Code. Parking SpaceAnalysis As per Ordinance #29-09-2021,the extent ofretail,office,and restaurant uses shall not exceed, andbelimitedby,the capacityofprovidedparking.The Development shallcomplywith the parking requirements in the Land Development Code,Section 20-4.4(B)forallretail,officeand restaurant uses. After review of the project,the proposed general restaurant use complies with both the general andspecial requirements listedin both Section20-3.4(A)and Section 20-3.4(B)(4)(b)of the LDC,respectively,in that the use: •Is compatible and complementary to the existing uses within the surrounding areas; •The establishment shallprovideonlyinsideorpatio service on private property;Public streets,rights-of-way,sidewalks and required setbacks maynotbe used for patio or street-side services of anykind; •No services ofadrive-inorofa fast food nature shallbe permitted;and Furthermore,the requested special use does notconflictwith the Comprehensive Planand complies with the LDC requirements set forthin Section20-5.8(B)(l)of the LDC in that the use: a)Will notadverselyaffectthehealthorsafetyofpersons residing orworkinginthe vicinity of the proposed use, b)Will notbe detrimental to the publicwelfareor property or improvements inthe neighborhood;and, Special Use Approval -6620 SW 57 Avenue August 16,2016 Page4 of 4 c)Complieswithall other applicable Codeprovisions. Planning Board Action: After the public hearing heldfor the itemat the Planning Board's July21,2016 meeting,the Board recommended approval PB-16-015 witha vote of6to0.Please note that the applicant handed out an information packet during the hearing that explained the business model for the restaurant.Itis attached as Exhibit "A."
