That all terms and conditions of this agreement shall,be fully complied with and all the work approved and/or required under the building permit, shall be faithfully and completely performed in accordance with the application, plans and specifications filed by the applicant and approved by the City of South Miami Building, Zoning and Planning Department. 2. That pending satisfaction thereof, this agreement shall be made a part of any contract, lease or deed changing the ownership or rental of the premises described herein, and shall be deemed a covenant running with the land and be binding upon the undersigned, his lessees, his heirs,assigns and successors in title. 3. That the authorized representatives of the City of South Miami are hereby granted access to the premises above described;to determine whether compliance has been had with this agreement and for the purpose of carrying out the terms and conditions of'this agreement should the undersigned fail to do so within the prescribed time. 4. The Dumpster must be removed from the property within a day period. If associated with a building permit, then dumpster is to be removed prior to granting of a final building inspection. Should the building permit expire, the dumpster must be removed immediately. 5. Where required under this agreement that the dumpster be rergoved form the premises, the undersigned agrees to do so at their own expense and at no expense to the City of South Miami. In the event that the undersigned fails to do so, he does hereby grant to the City of South Miami and its duly authorized representatives and agents the right to enter upon said land and to remove said dumpster. In addition to any other legal remedy, the City, at its option is entitled to compel speck performance of the terms and conditions of this agreement. The undersigned hereby agrees to be responsible for all court costs and reasonable attorney's fees in the event that the City is successful in any court action. 6. Miscellaneous permit fee, $50.00.
