Res No 140-16-14695RESOLUTION NO:140-16-14695 A Resolution declaring that the personal property,described in the attached list,is "surplus"and authorizing the City Manager to dispose of the "surplus" items. WHEREAS,Section 2-4.7 titled "Surplus city-owned property"of the City of South Miami Codeof Ordinances states that all personal property owned by the Cityshall not besoldunless anduntilitis declared tobe surplus property by resolution of the City Commission;and WHEREAS,the City Manager is recommending that the attached listof personal property items beclassifiedas "surplus"because said property serves nouseful function forany activity or in any location within the Cityand should besold to the highest bidder by way ofa City auction or as otherwise provided in section 2-4.7 of the City Code of Ordinances. NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITYOF SOUTH MIAMI,FLORIDA; Section 1.The personal property described in the attached list of City-owned property have no useful function for any activity or inany location within the City,are deemed to be "surplus"and City Manager is hereby authorized to dispose of the items in accordance with the procedure set forth in section 2-4.7 of the CityCodeof Ordinances,includingsale at public auction. Section 2.Severability.If any section,clause,sentence,or phrase of this resolution is forany reason heldinvalid or unconstitutional bya court of competent jurisdiction,this holding shall not affect the validity of the remaining portions of this resolution. Section 3.Effective Date:This resolution shall take effect immediately upon enactment.
