A Resolution declaring that the personal property,described in the attached
list,is "surplus"and authorizing the City Manager to dispose of the "surplus"
items.
WHEREAS,Section 2-4.7 titled "Surplus city-owned property"of the City of South Miami
Codeof Ordinances states that all personal property owned by the Cityshall not besoldunless
anduntilitis declared tobe surplus property by resolution of the City Commission;and
WHEREAS,the City Manager is recommending that the attached listof personal
property items beclassifiedas "surplus"because said property serves nouseful function forany
activity or in any location within the Cityand should besold to the highest bidder by way ofa
City auction or as otherwise provided in section 2-4.7 of the City Code of Ordinances.
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE
CITYOF SOUTH MIAMI,FLORIDA;
Section 1.The personal property described in the attached list of City-owned property
have no useful function for any activity or inany location within the City,are deemed to be
"surplus"and City Manager is hereby authorized to dispose of the items in accordance with the
procedure set forth in section 2-4.7 of the CityCodeof Ordinances,includingsale at public
auction.
Section 2.Severability.If any section,clause,sentence,or phrase of this resolution is
forany reason heldinvalid or unconstitutional bya court of competent jurisdiction,this holding
shall not affect the validity of the remaining portions of this resolution.
Section 3.Effective Date:This resolution shall take effect immediately upon
enactment.

personal property that is classified obsolete,or no longer economical or
efficient to keep,or that serves nousefulfunction for anyactivity or in
anylocationwithintheCity,needs to bedeclaredas "surplus"bythe
City Commission per Section2-4.7of the Code of Ordinances.

Sec.2-4.7.-Surplus city-owned property.
(a)Items ofpersonal property ownedbythe city shallnotbesoldunlessand until itisdeclaredtobesurplus
property by resolution ofthecity commission.
(b)Thecitycommissionshallnot consider declaringanyitemofpersonalpropertytobesurplusunlessthecity
manager has affirmatively recommended suchaction thereon.
(c)Upondeterminationbyresolutionbythecitycommissionthatanitemof personal propertyissurplus,thecity
manager is hereby authorized toselltothehighest bidder atpublic sale or,if approved bythe commission by
resolution,atpublicauction,said itemof personal propertyafter advertising the date,time and place of said
sale orauction once aweekfor three (3)consecutive weeks ina newspaper ofgeneralcirculationinthecity.
The city manager shall have the rightto accept or reject any orallbids.In the event the personal property shall
beofferedfor sale orauction,andnobidsshallbereceivedtherefor,itshallbe deemed that such property has
no value andthecity manager inhisdiscretionmay order it destroyed or otherwise disposed of.
(d)This section shallnotapplyto stolen,abandoned or confiscated personal propertywhich has come into the
city's possession.
