A Resolutionauthorizing a temporary change in the permitted hours of construction
operations of Florida Lemark Corporation to perform work for South Miami Hospital.
WHEREAS,Pursuant to Section 7-16(g)of Code of the Ordinance,as amended by Ordinance
No.5-15-2212,all construction sites shall comply with the city's noise code and it provides in pertinent
part as follows:
All construction sites shall comply with the city's noise code.Construction activity is limited to
the hours of 7:00 a.m.through-6:00 p.m.on the weekdays of Monday thru through Friday;and
between the hours of 9:00 a.m.through 5:00 p.m.on Saturday.No construction activity is
permitted on Sunday.Notwithstanding the above,no construction activities shall take place in,
or within 500 feet of,residentially zoned districts,other than those in the Hometown District,on
either Saturday or Sunday and,as to construction activities in non-residentially zoned districts
and in the Hometown District,all days of the week and hours of the day may be changed by
resolution of the City Commission upon afinding of extraordinary circumstances.
WHEREAS,South Miami Hospital is located within Public and Institutional zoning district;and
WHEREAS,the property is located within 500 feet ofa residential zoning district,however the
property is not located within 500 feet of a residential property;and
WHEREAS,allowing construction activities in non-residentially zoned districts,maybe changed
by resolution of the City Commission upon itsfindingof extraordinary circumstances;and
WHEREAS,South Miami Hospital ishaving construction performed,but the construction is
hampered by the high volume of traffic during the week,witha significant decrease on the weekends;
and
WHEREAS,approval of this request will not be detrimental or harmful to the surrounding
area of the community at largeand the problems beingfacedby the construction company is
extraordinary.
NOW,THEREFORE,BEIT RESOLVED BYTHE MAYOR AND CITY COMMISSION OFTHECITYOF
SOUTH MIAMI,FLORIDA THAT:
Section 1:The recitals set forth above have been found to be true and they are hereby
incorporated by reference asiffully set forthherein.The construction hoursare hereby changed
temporarily for the current construction activitiesof Florida Lemark Corporation untilJuly31,2016or
untilsuchtimeas the CityCommissionor the City Managerrevokes these extended hoursof operation.
The temporary hoursof construction operations arelimitedto the hoursof7:00a.m.to5:00p.m.on
Saturdays.The contractor,shallhire,atitsown expense,anoff duty CityofSouthMiamiPoliceofficer
for these daysandduring the hoursfrom7:00a.m.to5:00p.m.on Saturday atoinsure that the owner
andits contractor comply with the City's ordinances and this resolution.The extended hours for
construction activity authorized by this Resolutionmayalsobe reduced or revoked upon determination
ofthe City Managerinhissoleand absolute discretion that aviolationofanyof the City'sordinanceor
this Resolution has occurred and has not been resolved to his satisfaction or that the noise level is
otherwise excessive.This resolution mayberevokedatany time in the soleand absolute discretion of
the City Commission.

Section 2.Severability.If any section clause,sentence,or phrase of this resolution isforany
reason heldinvalid or unconstitutional bya court of competent jurisdiction,the holding shall not affect
the validity of the remaining portions of this resolution.
Section 3.Effective Date.This resolution shall become effective immediately upon adoption by
vote of the City Commission.

FloridaLemark Corporation previously requested authority to work on Saturdays,due to
the amount of traffic volume experienced during week days to perform maintenance on
the South Miami Hospital pedestrian bridge located over SW 62nd Avenue.The request
to waive the condition was approved by the commission via Resolution No.046-16-
14601.The resolution authorized the temporary hours of construction operations tobe
limitedto the hours of 7:00a.m.to5:00p.m.on Saturdays,foraperiod of 60days.
Dueto unforeseen circumstances that changed the scope of the work,andto inclement
weather,the permitted work was not completed within the authorized time frame.
Therefore,Florida Lemarkis requesting one additional Saturday to complete the work.

In the course of performing the approved repairs,the Engineerof record discovered that the joint sealant on the
exterior of the Bridge Segments was completely deteriorated,this addition to our scope ofwork increased the time
table on the project byafewdays(Saturday Work),alsowehavehad three Saturdays with inclement weather that
further delayed the completion,however,wehad made timeIn the original scope and were able to save some days
from the original schedule,the end result is one more dayto complete the additional scope andoriginal scope.Thework
would have been completed three weeks ahead with the original scope schedule,however,with the raindelaysand the
additional extra work,we ran out of the available time.
At this time we are requesting one additional Saturday to fully complete all functions and close out the permit.

Our Company,Florida Lemark Corporation wasawardeda project from Baptist Health System consistingon
the repairs/Maintenance ofthe62Ave Connecting Bridge,within thescope,wearetopressurewashthe
exterior of the structureandre-paint the underside and the metalframe.
Since 62 Avenue isa major thoroughfarewith heavy concentrationof vehicles,In conjunctionwith the Hospital,
itwas decided torequest,that,that portion oftheworktakingplaceovertheroad,numberone,havetheroad
closed (to protect the Vehicles)andagain,duetothetraffic during the week,suggest totemporary dose one
lane at the time during Saturdays,the lowest trafficflow,alsowewill be usingtwo off dutypoliceofficers from
the CityofSouth Miami in addition theproposed MOT,signageto control bothsides of thelaneclosure.
It isanticipatedthatifonlySaturdaysweareableto close onelane,theproject will requireeight (8)Saturdays
to complete,if Sundays are allowed,thenwecancutthe project to Four (4)weekends.
