Res No 125-16-14680RESOLUTION NO.:125-16-14680 A Resolutionauthorizing a temporary change in the permitted hours of construction operations of Florida Lemark Corporation to perform work for South Miami Hospital. WHEREAS,Pursuant to Section 7-16(g)of Code of the Ordinance,as amended by Ordinance No.5-15-2212,all construction sites shall comply with the city's noise code and it provides in pertinent part as follows: All construction sites shall comply with the city's noise code.Construction activity is limited to the hours of 7:00 a.m.through-6:00 p.m.on the weekdays of Monday thru through Friday;and between the hours of 9:00 a.m.through 5:00 p.m.on Saturday.No construction activity is permitted on Sunday.Notwithstanding the above,no construction activities shall take place in, or within 500 feet of,residentially zoned districts,other than those in the Hometown District,on either Saturday or Sunday and,as to construction activities in non-residentially zoned districts and in the Hometown District,all days of the week and hours of the day may be changed by resolution of the City Commission upon afinding of extraordinary circumstances. WHEREAS,South Miami Hospital is located within Public and Institutional zoning district;and WHEREAS,the property is located within 500 feet ofa residential zoning district,however the property is not located within 500 feet of a residential property;and WHEREAS,allowing construction activities in non-residentially zoned districts,maybe changed by resolution of the City Commission upon itsfindingof extraordinary circumstances;and WHEREAS,South Miami Hospital ishaving construction performed,but the construction is hampered by the high volume of traffic during the week,witha significant decrease on the weekends; and WHEREAS,approval of this request will not be detrimental or harmful to the surrounding area of the community at largeand the problems beingfacedby the construction company is extraordinary. NOW,THEREFORE,BEIT RESOLVED BYTHE MAYOR AND CITY COMMISSION OFTHECITYOF SOUTH MIAMI,FLORIDA THAT: Section 1:The recitals set forth above have been found to be true and they are hereby incorporated by reference asiffully set forthherein.The construction hoursare hereby changed temporarily for the current construction activitiesof Florida Lemark Corporation untilJuly31,2016or untilsuchtimeas the CityCommissionor the City Managerrevokes these extended hoursof operation. The temporary hoursof construction operations arelimitedto the hoursof7:00a.m.to5:00p.m.on Saturdays.The contractor,shallhire,atitsown expense,anoff duty CityofSouthMiamiPoliceofficer for these daysandduring the hoursfrom7:00a.m.to5:00p.m.on Saturday atoinsure that the owner andits contractor comply with the City's ordinances and this resolution.The extended hours for construction activity authorized by this Resolutionmayalsobe reduced or revoked upon determination ofthe City Managerinhissoleand absolute discretion that aviolationofanyof the City'sordinanceor this Resolution has occurred and has not been resolved to his satisfaction or that the noise level is otherwise excessive.This resolution mayberevokedatany time in the soleand absolute discretion of the City Commission.
