OrdinanceNo.14-16-2247 An Ordinance amending the Land Development Code,Article III,"Zoning Regulations,"Section20-3.6,"Supplemental Regulations,"to amend and clarify the height limitations onfences,walls,hedgesand similar featuresin residential zoning districts. WHEREAS,thedevelopmentofcornerlotswithrespecttowhicharethefrontorsidestreets of thelotare sometimes confusing;and WHEREAS,theLandDevelopmentCodeprovidesinSection20-3.6(F)(4)that "In determiningwhichstreetsarethefrontageandsidestreets,thedirector of buildingandzoningshall be guided bythe existing development patternf;]"and WHEREAS,theremaybealine of housesalongablockfacewithuniformfenceheights alongfrontpropertylinesthataredisrupteduponreachingacornerlot,whichapplicableregulations wouldtreatthatsameportion of theblockfaceasasidesetbackareaandsidepropertyline;and WHEREAS,itisimportantforcompatibility of urbandesignthatthenonconformityof fencesonthesidesetbackareasandsidepropertylines of cornerlotsbemadetoconformtothe uniformity of height of the remainder of theblockface,andnotbea disruptive design element;and WHEREAS,attheMay 10,2016publichearing of the Planning Board,the Boards motion to recommend approval of the proposed text amendment failedwithavote of 2to5;and WHEREAS,theCity Commission desirestoadoptthis ordinance to accomplish theabove objectives. NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1.Article III,"Zoning Regulations,"Section 20-3.6,"Supplemental Regulations,"of the Land Development Code,City of South Miami,Florida,is hereby amended andshallreadas follows: 20-3.6 -Supplemental regulations. (H)Physical Barriers. (1)Allfences,walls,trellises andhedgesmaybe erected onoralonga property line,but shallnotextendintoofficialpublic rights-of-way or project onoroveradjacent properties. (2)Height limit. Residential: (a)Chain linkfenceswillnotbe permitted on required yards adjacent toaright- of-way. Page 1 Qrd.No 14-16-2247 (b)Inall yards,fences,walls,and trellises (excluding arbors)shallnotexceedsix (6)feetinheightabovegrade,unless further restricted exeep^as providedin(c)below. (c)Inthe required front setback areas adjacent toa right-of-way,and along that portion ofarear setback areathatis adjacent tothe front yard ofan aioining property,fences, walls,trellises,gatesand hedges shall not exceed four(4)feetinheight above gradewiththe following exceptions: (i)Woodenfences exceeding four(4)feetinheightadjacenttoaright- of-wayinrequiredfrontsetbackareasshallprovideforaminimumofsixty(60) percentopenareaforallportionsbetweenfour(4)andsix(6)feetinheightabove grade.Thegraphic"WoodenFence Types"includesanexampleofbothan unacceptable and acceptable prototype. Section 2.Codification.Theprovisionsofthisordinanceshallbecomeandbemadepart of the Land Development Code of theCity of SouthMiamiasamended. Section 3.Severability.If anysection,clause,sentence,or phrase of this ordinance isforany reasonheldinvalidor unconstitutional byacourt of competent jurisdiction,thisholdingshallnot affectthe validity of the remaining portions of thisordinanceorthe Guidelines adopted hereunder. Section 4.Ordinances inConflict.All ordinances orparts of ordinances andallsectionsand parts of sections of ordinances in direct conflict herewith are hereby repealed. Background: Whenreviewing the City'sphysicalbarrier regulations,Section 20-3.6(H)of the Land Development Code (LDC),itwas found that,while the current provisions address the front setback area of properties that are considered interior lots,clarification was needed when determining the fence height for properties that are considered corner lots. Analysis: In order to properly address the heightoffencesfor properties that are considered tobe corner lots,an amendment toSection 20-3.6(H)isbeing proposed atthistime.Thesole amendment to the physical barrierssection identifies theareawherethefenceheightforcornerlotscannot exceed four (4)feet.Previously,the LDC only required thatthefront setback areaof any residential property have a maximum height offour (4)feet.When applied toacorner lot,the portion ofthe fence that fell within the front setback area was limited toa maximum height of four(4)feet.Any portion of the fence that was outside of the front setback area couldhavea maximum height ofsix(6)feet.Depending onthe orientation of the residential structure onthe property,there may bea line of houses along a block face with uniform fence heights along frontpropertylines that aredisruptedupon reaching acornerlot. Section 20-3.6(H)(2)(c)willbe amended to read: "In the required front setback areas adjacent toa right-of-way,and along that portion of a rear setback areathatisadjacenttothefrontyardofan aioining property,fences,walls,trellises,gates and hedges shall notexceedfour (4)feet in heightabovegrade with thefollowingexceptions/' Corner LotFence Height Text Amendment June 1,2016 Page 2of2 By making the proposed amendment listedabove,corner lots will be required to havea maximumheightoffour(4)feet,causing them toconformto the fence heights of the remainder of the blockface,and not bea disruptive design element. Planning Board Action: Afterthepublichearingheldon the itematthePlanningBoard'sMay10,2016meeting,the Board's motion to recommend approval of PB-16-012 failedwitha vote of2 to 5.
