Resolution No.1 23-1 6-1 4678 A Resolution related toa request pursuant to Section 20-7.6(c)(2)(b),20-7.7, and 20-7.8 of the Land Development Code requesting a special exception waiving strict compliance with the lot coverage,parking,height,and setback provisions of the Hometown District Overlay Ordinance for a proposed addition located at 5875 Sunset Drive. WHEREAS,Ryan D.Bailine submitted Application No.PB-16-009 requesting approval of special exceptions tothelot coverage,parking,height,awning/arcade and setback provisions fora proposed building addition located at5875 Sunset Drive within the Hometown District Overlayzoning district andatthe Planning Boardmeetingthe applicant withdrew therequestfor a special exception asto awning/arcades;and WHEREAS,pursuant to Section 20-7.51(A)of the Land DevelopmentCode (LDC), the City Commission may,by special exception,waive strict compliance with the provisions of the Hometown District Overlay Ordinance;and WHEREAS,in granting approval of the special exceptions,theCity Commission has found substantial competent evidence that: 1.The proposed development contributes to,promotes and encourages the improvement of the Hometown District and catalyzes other development as envisioned inthe Hometown District regulations. 2.The proposed development is compatible with the land usesand development intensities prescribed byall applicable city regulations. 3.The proposed development possessesintegrity of designcompatiblewiththe design criteria established forthe Hometown District and with the overall image of the City. 4.The proposed development isdesignedina manner that provides foreffective management of traffic (vehicular and pedestrian),parking,lighting,noiseand waste generated bythe development,and management of the impacts of the development on public facilities and services. 5.The proposed developmentdoesnotexpandthe permitted useswithinthe Hometown District. 6.The proposed development willnothavean unfavorable effect ontheeconomy of the City of South Miami. 7.Theproposeddevelopment,whenconsideredcumulativelywithother development,both present and future,within the Hometown District,will not create excessive overcrowding or concentration of people or population;and Pg.2 of Res.No.123-16-14678 WHEREAS,atthe May 10,2016 public hearing of the Planning Board,the Board,bya 6-1vote,recommended approval of the special exceptions subject to certain conditions;and WHEREAS,the City Commission desires to accept the recommendation of the Planning Board and approve the Special Exception. NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1:The recitals set forth in this resolution are true,they are supported by competent substantial evidence and they are incorporated intothis resolution by reference. Background: The applicant,RyanD.Bailine,is proposing to construct an addition to the building located at 5875 Sunset Drive.The property is irregularly shaped and contains a commercial buildingwitha two(2)story section fronting Sunset Drive,a single-story section fronting US-1,anda surface parking area containing five(5)parking spaces accessed fromUS-1.Retail uses occupy the ground floor level and the second floor is occupied byamix of retail and office uses.The applicant is proposing a single-story addition of 998 square feet on the existing parking area alongwith facade improvements to the US-1 frontage and three (3)minor areas ofbuilding infill/additiononboth the Sunset Drive andthe US-1 frontage totaling lessthanninety-one(91) square feet. As the existing structure isa Contributive Building,the Historic Preservation Board reviewed and approved a Certificate of Appropriateness for the new improvements.Inadditionto requiring CityCommission approval of the SpecialExceptions,the Board approved Staffs recommended conditions and added several others as well.All of the recommended conditions of approval are listed in the Staff Recommendation section below. Request: The applicant is requesting that the City Commissionwaive strict compliance with the provisionsof the Hometown DistrictOverlayOrdinancevia the special exception process found in Section 20-7.51(A)of the Land Development Code (LDC). Pursuant to Section20-7.51(A)of the LDC,the applicant is requesting that strict compliance for the following LDC sections be waived at this time: •Section 20-7.7 of the LDC whichlimits Lot Coverage to sixty(60)percent.Theapplicantis requesting a special exception to construct an addition of 998 square feet on the existing parkingareaand three (3)minor areas ofbuildinginfill/addition totaling less than ninety- one(91)square feet.Thenewadditions will bring the totalLotCoveragetoseventy-six (76)percent. Special Exception -5875 Sunset Drive June 21,2016 Page2 of 6 •Section 20-7.6 of the LDC which requires a special exception when the parking requirements cannot be met for new construction and which prohibits the elimination of existing off-street parking for historic buildings.The proposed addition,whichwillbe built over the existing parking area,would require four (4)additional parking spaces.If the special exception is approved,the applicant will make payments into the Hometown District Improvement Trust Fundfor the four (4)spaces. •Section 20-7.8 of the LDC which requires buildings fronting onto US-1 to be a minimum of two-stories.The applicant is proposing a one-story addition in order to be compatible with the existing US-1 frontage and to protect the viewof the second story of the historic structure behind it. •Section 20-7.8 of the LDC to permit asix(6)foot setback from US-1 for the new addition where eight (8)feet is required.This would allow the addition to be aligned with the existing structure,thus creating a uniform appearance. The application initiallyincludeda request fora special exception to waive the awning/arcade provision.This request was withdrawn during the Planning Board meeting as the applicant has agreed to comply with the applicable code requirements. Analysis: Pursuant to Section20-7.51(A)of the LDC,the CityCommissionmay,by special exception, waive strict compliance with the provisions of the Hometown DistrictOverlay Ordinance.In granting a special exception,the CityCommission must findby substantial competent evidence that: 1.The proposed development contributes to,promotes and encourages the improvement of the Hometown District and catalyzes other development as envisioned in the Hometown District regulations. Analysis:The new construction and the renovation of theexisting facades will increase the amountofcommercialspaceavailable in the Hometown District andmakeforamore aesthetically pleasingenvironment,whichwillbe attractive toboth new patrons and businesses. 2.The proposed development is compatible with the land uses and development intensities prescribed by all applicable city regulations. Analysis:The proposed retail development isa permitted useinthe Hometown District. The proposed lotcoveragewillbehigherthanthatofpropertieswithsurface parking lots, but is not inconsistent with other properties inthearea.Further,it's typical of the intensity of development inatraditional downtown.The proposed addition willbe aligned withthe existing structure along US-1 to create auniform appearance,thusthesix(6)foot setback is appropriate.Limiting theadditiontoasingle story will create harmonywiththeexisting US-1 frontage aswellas protect theview of the second story of the historic structure behind it Special Exception -5875 Sunset Drive June 21,2016 Page3of6 3.The proposed development must possess integrity of design compatible with the design criteria established for the Hometown District and with the overall image of the city. Analysis:Thedesign of the proposed additionand fagade renovations is compatible with thecriteria established forthe Hometown Districtandthe overall image of the city. 4.The proposed development shall be designed ina manner that provides for effective management of traffic (vehicular and pedestrian),parking,lighting,noise and waste generated by the development,and management of the impacts of the development on public facilities and services. Analysis:The Hometown District Overlay provides that historic buildings are exempt from all parking requirements,but existing off-street parking shall not be removed.Additional spaces required for new construction can be addressed through the Special Exception process and payment into the Hometown District Improvement TrustFund for each space required but not provided. The site's existingparkingarea consists offive(5)angled spaces accessed fromadriveaisle off of US-1.Exitingthelot seems torequire either backing onto US-1 orturningaround within the driveaisle.Itis unclear how thisparkingarea was allowed to be developed. Removing these spaces will remove a potentially hazardous situation. Adequate lighting of the paseo will be provided and any additional noise and waste generated by the development should beminimaland neither anuisanceto nearby properties ora burden onpublic facilities and services. 5.The proposed development does not expand the permitted uses within the Hometown District. Analysis:The proposed project will not expand the permitted uses withinthe Hometown District. 6.The proposed development will not havean unfavorable effect on the economy of the City of South Miami. Analysis:The proposed development willnothaveanunfavorable effect ontheeconomy of theCityofSouth Miami.In fact,itmaycontributetotheeconomybyexpandingretail options and creating a more aesthetically pleasing environment Special Exception -5875 Sunset Drive June 21,2016 Page 4of6 7.Theproposed development,when considered cumulatively with other development, both present and future,within the Hometown District,will not create excessive overcrowding or concentration of people or population. Analysis:The proposedlanduse,whenconsidered cumulatively withotherdevelopment, bothpresentandfuture,within the Hometown District will beofa compatible and complementary naturewiththeexistingandfuture planned surroundinguses. Theadditionwillextendoverthe existing parkingarea;inotherwords,the five (5) existing parking spaceswillbe removed.Normally,parking maynotbe removed pursuanttothe City's District regulations,specifically Section 20-7.6(C)(4)which provides that"designated historic buildings areexemptfromall parking requirements,exceptthatexistingoff-street parking shall notbe removed".Arecent public recordsrequest confirmed theProperty'sparking areawasnotpermittedbytheCity.Furthermore,theProperty's Designation Reportdoesnot containanyreferencestotheexisting parking.Consequently,astheparkingwasnotpermitted, itcanberemoved.Additionally,fromalifesafetystandpoint,thesespacesshouldberemoved ascarsmustbacknpontoUS-1,whichisaninherently dangerous maneuverandshouldbe eliminated. III.Compliance with COA Criteria TheApplicationcomplieswiththecriteriaforissuance of aCOAinaccordancewith Section 20-11.4(E).Specifically,Section 20-11.4(E)(2)states"itshallbetheintent of theBoard to promote maintenance,restoration,adaptive reuses appropriate tothe property,and compatible contemporary designsthatare harmonious withthe exterior architecturalandlandscapefeatures of neighboring buildings,sites,and streetscapes".The proposed storefront addition is compatible with the surrounding properties.The abutting property totheEast contains asingle story commercial structure,andthe property totheWestcontainsatwo(2)storyretail structure, alsowithoutparking. Furthermore,the general design,scale and massing ofthe Project are appropriate tothe sizeand location of thelot.Thenew addition will continue the fa9ade ofthe northwestern side ofthe existing building along US-1;this change will allow tenant visibility and attract more individuals tothe District.Itwillalsoallowfora seamless transition between the new addition andthe existing US-I street presence of the historic building.Furthermore,from a historic" preservation perspective,the new addition will be compatible with the historic components and will not detract from the contributing building. The Property's location across the street from public transitandonthe perimeter ofthe District makes itan important feature for the District.The Project will draw pedestrians to the District with its large display windows,understated elegance and green pedestrian pathway. IV.Request for Special Exceptions The Applicant is requesting the following Special Exceptions: 1.A Special Exception to exceed by 16%the maximum permitted lotcoverage percentage of 60%inorderto construct anew storefront addition toanexisting contributing building. •SpecialExceptionrequestedfrom: Sees.20-7.7(B)and 20-7MB)-Buildings and Their Placement Diagram ForbuildingsfrontingUS-1andSunset Drive,lotcoverageis60%maximum,20,000 squarefeetmaximumperbuilding. TheApplicantisrequestinga Special Exception fromSection 20-7.7(B)and20-7.8(B)to permit76%lot coverage whereonly60%ispermitted.InordertoenhancetheUS-1street side presence ofthisProperty,the Applicant mustaddnew structures.TheApplicantdesignedthe newaddition's fa9ade tomatchthecontributing building's fa9ade frontingUS-1.The window anddoorconfigurationwillalignwiththecontributingstructure;thiswillallowthecontinuity of thepedestrianexperiencealongUS-1inaccordancewiththeintent of theDistrictandsatisfythe COAdesigncriteria. 2.ASpecialExceptiontoremove five (5)off-streetparkingspacesthatdonotmeetthe minimumstallsizerequirementsandareunsafe. •Special Exceptionrequestedfrom: Sec 20-7.6(0(4)-Parking Designatedhistoricbuildingsareexemptfromallparkingrequirements,exceptthat existingoff-streetparkingshallnotberemoved, The City doesnothavepermit records oftheProperty'sfive(5)existing parking spaces. Inotherwords,theparkingspaceswereneverlegallycreated.Accordingly,theparkingspaces shouldberemoved.However,assumingthatthe five (5)parkingspaceswerelegallypermitted, theApplicantisrequestingaSpecial Exception fromSection20-7.6(C)(4)toremovethem.As the parking spaces currently exist,they are undersized and donot meet theCity's dimensional designstandardsrequiredunderSection20-4.4(C)(l).Inaddition,thelocationoftheparking spaceson US-1 requiresvehiclesto reverse onto US-1 inthedirectionof on-coming traffic. The Applicant is requesting a Special Exception from Section 20-7.8(A)topermitthe newadditiontobeasinglestorystructurewithaheightof 14*fromfloortoceiling.Pursuantto Section 20-7.5,"story"is defined,asthe horizontal division ofabuildingbetweenthesurfaceof afloorandthesurfaceofthenextflooraboveorthenextceilingifthereisnofloorabove,with a vertical unit of 14'maximum.The existing frontagealongUS-1isonestoryandhasaheightof approximately 85-4"fromfloortoceilingand 1V totopofslab.Becausethenewadditionwill beanextension of thecontributingstructure,itsdesignmustbecomplementaryandpractical. Moreimportantly,itsdesignmustpreservetheintegrity of the contributing structure's fa£ade. The Applicant is requesting a Special Exception from Section 20-7.8(B)to permit asix (6)foot rear setback where a depth of eight (8)feet from the property line is required.The new addition aims tobea seamless extension ofthe contributing structure.To accomplish an aesthetically pleasing design and maintain the integrity ofthe historical design,the new addition must have a rear setback that mirrors the contributing structure's setback of six (6)feet. Section 20-7.51(a)ofthe City's Land Development Code ("Code")delineates the standards ofreviewfora Special Exception application.Specifically,a Special Exception shall be approved upondemonstrationofthe following: (1)Theproposed development contributes to,promotes and encourages the improvement of theHometownDistrictand catalyzes other development as envisioned intheHometown District Regulations. Satisfied;The proposed development will revitalize the existing contributing building and more appropriately utilize the Property's prime locationon US-1 and proximity tothe South Miami Metrorail Station tofoster pedestrian traffic. Satisfied;Other than therevisedSpecial Exceptions,the Projectfullycomplieswiththe City's regulations.Furthermore,the requested reliefis minor in nature and the Project generallysatisfiesthe intent ofthe Code.
