A Resolution authorizing a temporary changein the permitted hours of construction operations of
Florida Power &Light (FPL)to perform work on SW 62 Avenue,between SW 70th Street and South Dixie
Highway.
WHEREAS,Pursuant to Section 7-16(g)ofCodeof the Ordinances,as amended by Ordinance No.5-15-
2212,all construction sites shallcomplywith the city'snoise code andit provides in pertinent part asfollows:
All construction sites shallcomplywith the city'snoisecode.Construction activityislimitedto the hoursof7:00
a.m.through-6:00 p.m.on the weekdaysofMondaythruthroughFriday;and between the hoursof9:00a.m.
through5:00p.m.on Saturday.No construction activityis permitted onSunday.Notwithstanding the above,no
construction activitiesshall take placein,orwithin500feetof,residentiallyzoneddistricts,other than those in the
Hometown District,on either Saturday orSundayand,asto construction activitiesin non-residentially zoned
districtsandin the Hometown District,alldaysof the weekandhoursof the daymaybe changed by resolution of
the City Commission upon a finding of extraordinary circumstances.
WHEREAS,FPL wishes to perform workalongSW62Avenue,between SW 70th Street andSouth Dixie
Highwayto replace sixexisting transmission line concrete polesalong the east sideofSW62Avenue;and
WHEREAS,the transmission line clearances are only available during the night and the type of equipment
beingused will impacttrafficduetoarequiredlaneclosure.Inaddition,the FPL's operations atnight will cause
minimal traffic impact;and
WHEREAS,allowing construction activitiesatnightmaybe changed by resolution of the CityCommission
upon its finding of extraordinary circumstances;and
WHEREAS,FPL is requesting authority to conduct transfer services during night hours;and
WHEREAS,approvalofthis request will notbe detrimental orharmfulto the surrounding areaof the
community at large.
NOW,THEREFORE,BEITRESOLVEDBYTHE MAYOR ANDCITY COMMISSION OFTHECITYOFSOUTH
MIAMI,FLORIDA THAT:
Section 1:The recitals set forth above have been found tobe true and they are hereby incorporated by
reference asiffully set forth herein.The construction hoursare hereby changed temporarily for the current
construction activities of FPL untilJuly15,2016oruntilsuch time as the City Commission or the City Manager
revokes these extended hours of operation.The temporary hoursof construction operations are limitedto the
hours of 9:00 PM to 6:00 AM.The contractor shallhire,at their own expense,an off duty Cityof South Miami
Policeofficerfor these daysandduring these hourstoinsure that the FPL complies with the City's ordinances and
this resolution.The extended hours for construction activity authorized by this Resolution mayalsobe reduced or
revokedupon determination of the City Manager inhissoleand absolute discretion that aviolationofanyof the
City's ordinance orthisResolutionhas occurred andhasnotbeenresolvedtohis satisfaction or that the noiselevel
is otherwise excessive.This resolution maybe revoked atany time in the sole and absolute discretion of the City
Commission.
Section 2.Severability.Ifany section clause,sentence,or phrase of this resolution isforany reason held
invalidor unconstitutional bya court of competent jurisdiction,the holdingshall not affect the validityof the
remaining portions of this resolution.
Section 3.Effective Date.This resolution shall become effective immediately upon adoption by vote of
the City Commission.

Background:Ordinance No.5-15-2212 prohibits construction activity to take place during
night hours from6:00PM though 7:00AM.FPL is transferring /replacing sixexisting
transmission line concrete poles along the east sideofSW62 Avenue as per the City's request
to comply with ADA requirements to allow safepassageof bicycles andpedestrians.
Due to Heavy traffic during daylight hours onSW62 Avenue,and because the electric
transmission lines require traffic clearances during movement between poles which are only
available during the night for this area,FPL is requesting to receive a waiver,so that they are
able to work during night hours.
Request:The Resolution attached is to waive the limitation on hours of construction,as
authorized by the Ordinance.The work is anticipated to be completed within
the next two weeks.

WHEREAS,theMayorandtheCity Commission desiretoprovideformoreflexibility

NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA:
Section 1.Section7-16.(g)of theCodeof Ordinance of the City of South Miami is
herebyamendedinpertinentparttoreadas follows:

activityis limited between tothehoursfrom of 7:00 a.m.through-6:00 p.m.r-on the
weekdays of Monday thru throughFriday:and between the hours of 9:00a.m.through
5:00 p.m.onSaturday .hours shallbefrom9:00a.m.to5:00p.m.Noconstructionactivity
is permitted onSunday.Notwithstanding the above,no construction activitiesshalltake
place in,or within 500feet of residentially zoned districts,other than those inthe
Hometown District on either Saturday or Sunday and,as to construction activities in
non-residentially zoned districts and in the Hometown District,all days of the week and
hours of theday may be changed byresolution of theCity Commission uponafinding of

Section 2.Codification.Theprovisionsofthisordinanceshall become andbemade
part of theCode of Ordinances of theCity of SouthMiamiasamended;that thesections of this
ordinancemayberenumberedorre-letteredtoaccomplishsuchintention;andthattheword
"ordinance"maybechangedto "section"orotherappropriateword.

foranyreasonheldinvalidor unconstitutional byacourtofcompetentjurisdiction,thisholding

Section4.OrdinancesinConflict.All ordinances orpartsof ordinances andall
sections andpartsof sections of ordinances in direct conflict herewitharehereby repealed.
However,itisnottheintentofthissectiontorepealentire ordinances,orparts of ordinances,
that givetheappearance of beinginconflictwhenthetwoordinances can beharmonizedor
whenonlyaportionofthe ordinance in conflict needs tobe repealed to harmonize the
ordinances.If the ordinance in conflict canbe harmonized by amending its terms,itis hereby
amended to harmonize the two ordinances.Therefore,only that portion that needs tobe repealed
to harmonize thetwo ordinances shallbe repealed.
