Res No 104-16-14659RESOLUTION NO.:104-16-14659 A Resolution authorizing a temporary change in the permitted hours of construction operations of MiamiDade County Water &Sewer Department to perform work onSW71 Street,between SW58 Court and US 1. WHEREAS,Pursuant to Section 7-16(g)of Code of the Ordinances,as amended by Ordinance No.5-15- 2212,all construction sites shall comply with the city'snoise code andit provides in pertinent part asfollows: All construction sites shall comply with the city's noise code.Construction activity is limited to the hours of7:00 a.m.through-6:00 p.m.on the weekdays of Monday thru through Friday;and between the hours of9:00a.m. through 5:00 p.m.on Saturday.No construction activity is permitted on Sunday.Notwithstanding the above,no construction activities shall take place in,or within 500 feet of,residentially zoned districts,other than those in the Hometown District,on either Saturday or Sunday and,as to construction activities in non-residentially zoned districts and in the Hometown District,all days of the week and hours of the day may be changed by resolution of the City Commission upon a finding of extraordinary circumstances. WHEREAS,Miami Dade County Water &Sewer Department wishes to minimize impact to local business along SW 71 Street due to water service interruption to transfer services;and WHEREAS,allowing construction activities at night may be changed by resolution of the City Commission upon its finding of extraordinary circumstances;and WHEREAS,Miami Dade County Water &Sewer Department is requesting authority to conduct transfer services during night hours to minimize the impact to businesses due to water service interruption;and WHEREAS,approval of this request will not be detrimental or harmful to the surrounding area of the community at large. NOW,THEREFORE,BEIT RESOLVED BYTHE MAYOR AND CITY COMMISSION OFTHECITYOF SOUTH MIAMI,FLORIDA THAT: Section 1;Therecitalssetforthabovehavebeenfoundtobe true and they are hereby incorporated by referenceasiffullysetforthherein.Theconstructionhoursareherebychangedtemporarilyforthecurrent construction activitiesofMiamiDadeCounty Water &Sewer Department untilJuly1,2016oruntilsuchtimeas the City Commission or the City Managerrevokes these extendedhoursof operation.The temporary hoursof construction operations are limitedto the hoursof10:00PMto6:00AM.The contractor shallhire,at their own expense,anoffdutyCityofSouthMiamiPoliceofficerfor these daysandduring these hourstoinsure that the MiamiDadeCounty Water &Sewer Department complieswith the City's ordinances andthis resolution.The extendedhoursforconstruction activity authorizedbythis Resolution mayalsobereducedor revoked upon determinationofthe City Managerinhissoleandabsolutediscretionthata violation ofanyofthe City's ordinance or this Resolution has occurred and has not been resolved to his satisfaction or that the noise level is otherwise excessive.Thisresolutionmayberevokedat anytime inthesoleandabsolutediscretionofthe City Commission. Section2.Severability.Ifanysectionclause,sentence,orphraseofthisresolutionisforanyreasonheld invalid orunconstitutionalbyacourtofcompetent jurisdiction,the holding shallnotaffectthe validity ofthe remaining portions of this resolution.
