A Resolution authorizing the City Manager to execute the fiscal year 2016
Edward Byrne Memorial Justice Assistance Grant (JAG)Agreement for the
purchase of three tablet computers for South Miami Police Officers in the
amount of $4,540.00.
WHEREAS,the Mayor and City Commission desire to convert the South Miami Police
Department toa paperless system for criminal justice reporting;and
WHEREAS,the City of South Miami hasa grant award forthe purchase of three tablet
computers for Police Officers inthe amount of $4,540 fromthe Florida Department of Law
Enforcement from the Edward Byrne Memorial Justice Assistance Grant;and
WHEREAS,the Mayor and theCity Commission wish to accept the grant agreement with
the Florida Department of Law Enforcement forthe Edward Byrne Memorial Justice Assistance
Grant,referenced as contract number 2016-JAGD-DADE-7-H4-097,(attached as Exhibit Aand
incorporated herein by reference).
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA THAT:
Section 1:TheCity Manager is hereby authorized to execute thegrant agreement with the
Florida Department of Law Enforcement,Office of CriminalJusticeGrantsforthe Edward Byrne
MemorialJusticeAssistanceGrantforthepurchase of threetabletcomputersforSouthMiami
Police inthe amount of $4,540 The grant agreement is attached tothis resolution as "Exhibit A"
Section 2.Severability.If anysectionclause,sentence,orphrase of this resolution isfor
anyreasonheldinvalidorunconstitutionalbyacourt of competentjurisdiction,theholdingshall
notaffectthe validity of the remaining portions of thisresolution.
Section 3.Effective Date.Thisresolutionshallbecomeeffectiveimmediatelyupon
adoption byvote of the City Commission.

The Florida Department ofLaw Enforcement by and through its
Office of Criminal Justice Grants awarded the City of South Miami
$4,540 for the project entitled,Byrne Grant Vehicle Burglary.The
Cityof South Miami will be allocating the funds to reduce crime and
improve public safety by purchasing three (3)tablet computers for
Police Officers.
TheCity will purchase electronic tablets for use by detectives so
they have the abilityto access the OSSI crime reporting system.
Tablet computers will replace outdated laptops,to ensure that
detectives can manage theproblemof auto theftandautoburglary
bytracking occurrences and through the use of statistics.

Problem Identification
This project will be a continuation oflast year's grant and will assist the South Miami Police
Department isin the process of converting toa paperless system forcriminal justice reporting.
The department has been seeking funding to support the purchase of tablet computers for police
officers.Tablets will enable officers to work more efficiently and accurately when preparing
reports.Although the department has been able to secure some funding for the conversion,the
police officers are stillin need of updated computer equipment fordaily operations.Current
computing units are out of warranty,in need of expensive replacement parts,and no functioning
properly.Because the Police Department has not had the funds for updating much needed
computing units,grant funds have been identifiedto purchase the equipment.
Project Summary (Scope of Work)
The South Miami Police Department willutilize FY 2016 JAG funds to purchase three(3)tablet
computers forpolice officers.The equipment will make it possible to access necessary data ata
higher speed,therefore increasing productivity.Funding will allow the South Miami Police
Department to continue its efforts to upgrade equipment used to manage criminal justice data,
while increasing efficiency and effectiveness.In addition,the tablets will allow the officers to
reduce the time needed to store data and record keeping.Moreover,the department can share
informationwith other locallaw enforcement agencies.In an efforttoimprove the management
and maintenance ofcriminal justice data,the department will use this year's JAGfundingto
purchase three(3)tablet computers to be installedinpolice vehicles.Deliverables will be tracked
with invoices and proof of payment.
Thisproject requests federal grant fundingforalaw enforcement orcriminaljustice technology
related project andmaybe subject toreviewand approval bythe State Information Technology
(IT)PointofContact.By utilizing fundsforthis project,thesubrecipientand implementing agency
agree toconformtoall state andnational standards for technology andinformation sharing
systems that connect to,and/or interface with state and national systems,and/or reside on the

Edward Byrne Memorial Justice Assistance Grant (JAG)Program
STANDARD CONDITIONS
The State ofFlorida,Department ofLaw Enforcement (FDLE)isarecipientof federal JAG funds.FDLE,as the non
federal pass-through entity and StateAdministeringAgency(SAA)forthisprogram,subawards JAGfundstoeligible
unitsof government.All subawards made byFDLEtounitsof government under thisprogram require compliance
with the agreement and Standard Conditions upon signed acceptance ofthe subaward.
Upon approval of the application,or subaward,the following terms and conditions will become binding.Asaunit of
government,the subrecipient will maintain required state and Federal registrations and certifications for eligibility
under this program.For JAG-Countywide subawards,the designated County Coordinator forlocalunitsof
government will submit documentation in accordance with Florida Administrative Code 11D-9 supporting the strategic
planningforallocationof these funds.The subrecipient agrees to submit required programmatic and financial reports
supporting eligible activities were completed in accordance with the grantand program requirements.
The Department will only reimburse subrecipients for authorized activities The Department will not reimburse for
costs incurred forany purpose other than those specified in the agreement.Failure tocomplywithprovisionsofthis
agreement,orfailureto perform grant activities as specified in the agreement,will result in required corrective action
upto and including financial consequences.A financial consequence may be imposed for non-compliance in
accordance with2C.F.R.§200and these Standard Conditions,includingbutnotlimitedto project costs being
disallowed,withholdingof federal funds and/or termination of the project.

Disallowed costs meansthosechargestoa Federal award thattheFederal awarding agencyor pass-through entity
determines tobeunallowable,in accordance with theapplicableFederal statutes,regulations,ortheterms and
conditions of the Federal award.
Equipment means tangiblepersonalproperty (including information technologysystems)havingausefullifeofmore
than one year andaper-unitacquisition cost which equals or exceeds the lesser ofthecapitalizationlevel

Grantagreement meansa legal instrument of financial assistance between a Federal awarding agencyorpass-

relationship the principal purposeof which istotransfer anything ofvalue from theFederalawardingagencyorpass-

Improper payment means any payment that should not have been made or that was made in an incorrect amount

requirements and;Improper payment includes any payment toan ineligible party,any payment foran ineligible good
orservice,any duplicate payment,anypaymentforagoodorservicenotreceived(exceptforsuchpaymentswhere
authorizedby law),anypaymentthatdoesnotaccountforcreditforapplicable discounts,andanypaymentwhere
insufficient orlackof documentation preventsareviewerfrom discerning whetherapaymentwas proper.
Micro-purchase meansapurchaseofsuppliesorservicesusing simplified acquisition procedures,theaggregate
amountofwhichdoesnotexceedthemicro-purchasethreshold.Thenon-Federalentityuses such proceduresin
ordertoexpeditethecompletionofits lowest-dollar smallpurchasetransactionsand minimize the associated
administrative burdenandcost.The micro-purchase threshold issetbytheFederal Acquisition Regulation at48
C.F.R.Subpart2.1."Definitions",itis$3,000exceptasotherwisediscussedinSubpart2.1ofthat regulation,butthis
threshold isperiodicallyadjustedfor inflation.
ModifiedTotalDirect Cost (MTDC)meansalldirectsalariesandwages,applicable fringe benefits,materialsand
supplies;services,travel,and upto thefirst $25,000 ofeachsubaward(regardlessoftheperiodofperformanceof
thesubawardsunderthe award).MTDC excludes equipment,capital expenditures,chargesforpatientcare,rental
costs,tuitionremission,scholarshipsand fellowships,participantsupport costs andtheportionofeachsubawardin
excessof $25,000.Otheritemsmay only be excluded whennecessarytoavoidaserious inequity inthe distribution

Non-Federal eni\iy isastate,local government,Indian tribe,institution ofhighereducation (IHE),or nonprofit
organizationthat carries outaFederalawardasa recipient orsubrecipient.
Non-federal pass-throughentity isa non-Federal entity that provides asubawardtoa subrecipient to carry outpart
ofa Federal program;the Florida Department of Law Enforcement (FDLE)isthe non-federal pass-through entity for
thisagreement,also referred toastheState Administering Agency (SAA).
Performancegoal meansatarget level of performance expressedasa tangible,measurable objective,against
whichactualachievementcanbecompared,including agoal expressed asaquantitativestandard,value,orrate.In
some instances (e.g.,discretionaryresearchawards),thismaybe limited totherequirementtosubmittechnical
performancereports(tobeevaluatedinaccordance with agency policy).
Period of performance meansthe time during which the non-Federal entity may incur new obligations to carry out
theworkauthorizedundertheFederal award.TheFederal awarding agencyorpass-throughentitymust include start
andenddatesofthe period of performance intheFederalaward(see§§200.210 Information containedinaFederal
awardparagraph(a)(5)and200.331Requirementsforpass-throughentities,paragraph (a)(1)(iv)).

Protected Personally Identifiable Information (PII)means an individuals first name or firstinitialand last name in
combination with any one or more of types of information,including,butnotlimitedto social security numbers;
passport numbers;credit card numbers;clearances;bank numbers;biometrics;date and place ofbirth;mother's
maiden name;criminal,medical,and financial records;and educational transcripts.This does notinclude PI 1 that is
requiredbylawtobe disclosed.(See also§200.79 Personally IdentifiableInformation (Pll)).
Questioned cost means a cost that is questioned bytheauditor because ofanauditfinding1)that resulted froma
violationor possible violationofa statute,regulation,ortheterms and conditions ofa Federal award,includingfor
funds used to match Federal funds;2)where the costs,atthetimeof the audit,are not supported by adequate
documentation;or3)where the costs incurred appear unreasonable and donotreflect the actions a prudent person
would take in the circumstances.
Simplified acquisition threshold meansthedollaramountbelowwhichanon-Federalentitymay purchase property
or services using small purchase methods.Non-Federal entities adopt small purchase procedures in order to
expedite the purchase ofitems costing less than the simplified acquisition threshold.The simplified acquisition
threshold is set by the FederalAcquisitionRegulationat48C.F.R.Subpart 2.1(Definitions)andin accordance with
41 U.S.C.§1908.Asofthepublicationofthispart,the simplified acquisition threshold is$150,000,but this threshold
isperiodically adjusted forinflation.(Also see definitionof§200.67Micro-purchase.)
Subaward/Subgrant means an award providedbya pass-through entitytoa subrecipient forthe subrecipient to
carryoutpartofa Federal award received bythe pass-through entity.It does notinclude payments toa contractor or
payments toanindividualthatisabeneficiaryofa Federal program.A subaward maybeprovidedthrough any form
oflegal agreement,includingan agreement thatthe pass-through entity considers a contract.
Subrecipient means a non-Federal entitythat receives asubawardfroma pass-through entitytocarryoutpartofa
Federal program,but does notincludean individual thatisabeneficiaryofsuchprogram.Asubrecipient may alsobe
arecipientof other Federal awards directlyfroma Federal awarding agency.
Supplies means all tangible personal property other than those described in2C.F.R.§200.33,"Equipment".A
computingdeviceisasupplyifthe acquisition costislessthanthe lesser ofthe capitalization levelestablishedbythe
non-Federalentityfor financial statement purposesor $5r000,regardless ofthelengthofitsuseful life.See also§§
200.20,"Computingdevices"and 200.33,"Equipment".
The subrecipient agrees tobeboundbythe following standard conditions:
1.0 Payment Contingent onAppropriationandAvailableFunds -TheStateof Florida's performance and
obligation topayunderthisagreementiscontingent upon anannual appropriation bythe Florida Legislature.
Furthermore,the obligation oftheStateof Florida to reimburse subrecipientsfor incurred costsissubjectto
available federal funds.
2.0 System forAward Management (SAM)-The subrecipient must maintain current information in SAM until it
submitsthe final financial reportrequiredunderthisawardorreceivesthe final payment,whicheverislater.
Thisrequiresthatthesubrecipient review andupdatethe information atleastannuallyafterthe initial
registration,and morefrequentlyifrequiredby changes initsinformationor another awardterm.
3.0 Commencement ofProject -Ifaprojectisnot operational within 60daysofthe original startdateofthe
award period,thesubrecipientmustreportbylettertotheDepartmentthestepstakento initiate the project,
the reasons fordelay,and the expected start date.
3.1Ifaprojectisnotoperational within 90daysofthe original startdateoftheaward period,the
subrecipientmustsubmitasecondstatementtotheDepartment explaining the implementation delay.
3.2 Upon receiptoftheninety (90)dayletter,the Department shall determine ifthereasonfordelayis
justified or shall,atits discretion,unilaterally terminate thisagreementand re-obligate subawardfunds
tootherDepartmentapprovedprojects.TheDepartment,wherewarrantedbyextenuating
circumstances,mayextendthestartingdateoftheprojectpasttheninety(90)day period,butonlyby
formal written adjustment tothis agreement.
4.0 Supplanting -Thesubrecipientagreesthatfunds received underthisaward will notbeusedtosupplantstate

orlocalfunds,butwillbe used to increase the amounts of such funds that would,inthe absence of federal
funds,be made available for law enforcement activities.
5.0 Personnel Changes -Uponimplementationoftheproject,intheeventthereisachangeinChief Officials for
theSubrecipientor Implementing Agencyoranycontact information toinclude mailing address,phone
number,emailortitlechange,projectstaffmust notify the SIMON helpdesktoupdatetheorganizational
information in SIMON.Projectdirectorchangesrequireagrantadjustmentin SIMON.
6.0 Non-Procurement,Debarment and Suspension -Thesubrecipient agrees tocomplywithExecutiveOrder
12549,Debarmentand Suspension and2C.F.R.§180,"OMB GuidelinesToAgenciesOnGovernmentwide
Debarment And Suspension (Non-procurement)".These procedures requirethe subrecipient tocertifythatit
shallnot enter intoanylowertieredcovered transaction with apersonwhoisdebarred,suspended,declared
ineligibleorisvoluntarily excluded fromparticipatinginthis covered transaction,unless authorized by the
Department.
7.0 Federal Restrictions on Lobbying -Each subrecipient agrees tocomplywith28C.F.R.§69,"New
Restrictions onLobbying"and shallfile the most current editionoftheCertificationAnd Disclosure Form,if
applicable,with each submission that initiates consideration ofsuch subrecipient forawardoffederalcontract,
grant,or cooperative agreement.
6.0 State Restrictions on Lobbying -Inadditionto the provisionscontained above,the expenditure offundsfor
the purpose oflobbying the legislatureora state agency isprohibitedunderthis agreement.
9.0 Additional Restrictions on Lobbying -Thesubrecipientunderstandsand agrees thatitcannotuseany
federalfunds,eitherdirectlyor indirectly,insupportoftheenactment,repeal,modification oradoptionofany
law,regulationorpolicy,at anylevelof government,withoutthe express priorwritten approval oftheOfficeof
Justice Programs.
10.0 "Pay-to-Stay"-Fundsfromthisawardmaynotbeusedtooperatea "pay-to-stay"programinanylocaljail.
Furthermore,nofundsmaybegiventolocaljailsthat operate Mpay-to-stay"programs."Local jail",as
referenced in Jhis condition,means anadult facility ordetention center ownedand/or operated bycity,county,
ormunicipality.It does notincludejuveniledetention centers."Pay-to-stay"programs as referenced inthis
condition,means a program bywhich extraordinary services,amenities and/or accommodations,not otherwise
available to the general inmate population,maybeprovided,based uponan offender's apparent abilitytopay,
such that disparate conditionsof confinement are created forthe same orsimilar offenders withinajurisdiction.
11.0 The Coastal Barrier Resources Act -Thesubrecipient will complyand assure thecomplianceofail
contractors withtheprovisionsoftheCoastalBarrier Resources Act (Pub..L.No.97-348)dated October19,
1982 (16U.S,C.§§3501 etseq.)whichprohibitstheexpenditureofmostnewfederalfunds within theunitsof
the Coastal Barrier Resources System.
12.0 Enhancement of Security -If funds are usedfor enhancing security,the subrecipient agrees to:
12.1 Have an adequate process to assess the impact ofany enhancement ofaschool security measure that
is undertaken onthe incidence of crime in the geographic area where the enhancement is undertaken.
12.2 Conduct such an assessment with respect to each such enhancement;and submit to the Department
the aforementioned assessment initsFinal Program Report.
13.0 Background Check -Whenever abackground screening foremploymentora background securitycheckis
required bylawfor employment,unless otherwise providedbylaw,theprovisionsof§435 Fla.Stat,shall
apply.
13.1 All positions in programs providing care to children,the developmentally disabled,or vulnerable adults
for 15 hours ormore per week;all permanent and temporary employee positions of the central abuse
hotline;and all persons working under contract who have access to abuse records are deemed tobe
persons and positionsof special trustorresponsibility and require employment screening pursuant to§
435,Fla.Stat,usingthelevel2 standards set forthin that chapter.
13.2 All employees in positions designated by law as positions oftrustor responsibility shallbe required to j
undergo security background investigations as aconditionof employment and continued employment.
Forthe purposes ofthe subsection,security background investigationsshallinclude,butnotbelimited

to,employmenthistory checks,fingerprinting forall purposes and checks inthissubsection,statewide
criminalandjuvenilerecord checks throughtheFlorida Department ofLawEnforcement,and federal
criminalrecord checks throughtheFederalBureauofInvestigation,andmayincludelocalcriminal
record checks throughlocallaw enforcement agencies.
13.2.1Any person whoisrequiredto undergo suchasecurity background investigation and who
refuses to cooperate in such investigation or refuses to submit fingerprints shallbe disqualified
for employment in such positionor,if employed,shallbe dismissed.
13.2.2 Suchbackgroundinvestigationsshallbeconductedatthe expense oftheemploying agency or
employee.Whenfingerprintingisrequired,thefingerprintsof the employee or applicant for
employment shall be takenbytheemploying agency orbyanauthorizedlaw enforcement
officerandsubmittedtothe Department ofLaw Enforcement for processing andforwarding,
when requested by the employing agency,to the United States Department of Justice for
processing.Theemployingagencyshallreimbursethe Department of LawEnforcementfor
any costs incurredbyitinthe processing ofthefingerprints.
14.0 Privacy Certification -The subrecipient agrees tocomplywithallconfidentiality requirements of42 U.S.C.§
3789g and 28C.F.R.§22that are applicable tocollection,use,and revelation ofdataorinformation.
Subrecipient further agrees,as aconditionofgrant approval,to submit aPrivacyCertificatethatisin accord
with requirements of28C.F.R.§§22and,inparticular,section 22.23.PrivacyCertificationforms must be
signed bythe subrecipient orimplementing agency chief official oranindividualwithformal,written signature
authority for the chief official.
15.0 Conferences and Inspection of Work -Conferences maybeheldatthe request ofanypartytothis
agreement.At any time,a representative of the Department,of the U.S.Department of Justice,or the Auditor
General ofthe State ofFlorida,have therightofvisitingtheprojectsitetomonitor,inspectand assess work
performed under this agreement.
16.0 Insurance for Real Property and Equipment -The subrecipient must,ataminimum,provide the equivalent
insurance coverage forrealpropertyand equipment acquiredorimprovedwith Federal funds asprovidedto
property owned bythe non-Federal entity.
1.0 Federal lawsprohibit recipients offinancial assistance from discriminating on the basis of race,color,national
origin,religion,sex,disability,or age infunded programs oractivities.All subrecipients,implementing
agencies,and contractors must comply withany applicable statutorily-imposed nondiscrimination

Department of Justice for approval.Acopyofthe Department of Justice approval lettermustbe
submitted toFDLE.Theapprovalletterexpirestwo years fromthe date oftheletter.
4.3 A subrecipient orimplementing agency is exempt fromtheEEOPlan requirement ifitis has fewer than
50 employees orifit does not receive any single award of $25,000 or more from the Department of
Justice or ifitisanonprofit organization,a medical or educational institution,oranIndian Tribe.If an
organization is exempt from the EEOPlan requirement,itmust submit anEEOCertificationtoFDLE.
4.4 Thesubrecipientandimplementing agency acknowledgethatfailuretocomplywithEEOrequirements
within 60 days of the project start date mayresultin suspension or termination offunding,until such
time as itisin compliance.
5.0 In theeventafederalor state courtorfederalor state administrative agency makes a finding ofdiscrimination
afteradue process hearingonthegroundsofrace,color,religion,national origin,sex,ordisabilityagainst a
recipientoffunds,therecipient will forwardacopyofthe finding to FDLE andtothe Office for Civil Rights,
Officeof Justice Programs.
6.0 In accordance with federal civil rights laws,thesubrecipientshallnotretaliateagainst individuals fortaking
actionorparticipatinginactionto secure rightsprotectedby these laws.
7.0Subrecipientsmustincludecomprehensive Civil Rights/Nondiscrimination Provisions inallcontractsfundedby

16.0 Equal Treatment forFaith Based Organizations -The subrecipient agrees tocomplywiththe applicable
requirements of28C.F.R.§38,the Department of Justice regulation governing "Equal Treatment forFaith
Based Organizations"(the"Equal Treatment Regulation").The Equal Treatment Regulation provides inpart
that Department of Justice grant awards ofdirectfundingmaynotbe used tofundany inherently religious
activities,such as worship,religious instruction,or proselytization.Recipients ofdirect grants maystill engage
in inherently religious activities,but such activitiesmustbe separate intimeor place from the Department of
Justice funded program,and participation in such activitiesbyindividuals receiving services from the recipient
ora subrecipient must be voluntary.TheEqual Treatment Regulationalso makes clear that organizations
participatingin programs directly funded bythe Department of Justice are notpermittedtodiscriminateinthe
provision of services on the basis ofa beneficiary's religion.The subrecipient also understands and agrees
thatawardfundsmaynotbe used todiscriminate against or denigrate thereligiousormoralbeliefsof students
who participate in programs forwhichfinancial assistance isprovidedfrom the award,or the parent orlegal
guardianofsuchstudents.Notwithstanding anyotherspecial condition ofthisaward,faith-basedorganizations

17.0 Immigration and Nationality Act -Nopublicfundswillintentionally be awarded toany contractor who
knowingly employs unauthorized alienworkers,constitutingaviolationofthe employment provisions contained
in8 U.S.C.§1324a(e),Section274A(e)ofthe Immigration and Nationality Act ("INA").TheDepartmentshall
consider the employment byany contractor of unauthorized aliens aviolationof Section 274A(e)of the INA.
Suchviolationbythe subrecipient ofthe employment provisions contained in Section 274A(e)ofthe INA shall
be grounds for unilateral cancellation of this contract by the Department.
1.0 Fiscal Control and Fund Accounting Procedures
1.1 All expenditures and cost accounting offundsshallconformtotheOfficeof Justice Programs Financial
Guide,theCommonRule,andOMB Uniform Grant Guidance (2C.F.R§200)asapplicable,intheir
entirety.
1.2 Subrecipients must have written procedures for procurement transactions.Procedures must ensure
that all solicitations follow2 C.F.R.§200.319 Competition.
1.3The subrecipient isrequiredtoestablishandmaintain adequate accounting systems and financial
records and to accurately account forfunds awarded to them.Asa subrecipient,you musthavea
financial management system in place that isableto record and reportonthe receipt,obligation,and

expenditure of grant funds.An adequate accounting system fora subrecipient mustbe able to
accommodate afundand account structureto separately trackreceipts,expenditures,assets,and
liabilitiesfor awards,programs,and subrecipients.
1.4 All funds spent onthisprojectshallbe disbursed accordingto provisions oftheproject budget as
approved by the Department.
1.5 All fundsnotspentin accordance withthis agreement shallbe subject torepaymentbythesubrecipient.
1.0 Obligation of Subrecipient Funds -Subawardfundsshallnotunderanycircumstancesbeobligatedpriorto
theeffectivedate,or subsequent tothe termination date,oftheperiodofperformance.Onlyprojectcosts
incurredonoraftertheeffectivedate,andonorpriortothe termination date ofthe subrecipienfs projectare
eligiblefor reimbursement.All paymentsmustbecompleted within thirty(30)daysoftheendofthesubaward
period of performance.
2.0 Advance Funding -Advancefundingmaybeprovidedtoasubrecipientupona written request tothe
Department.The request mustbeelectronicallysignedbythesubrecipientorimplementing agency's Chief
FinancialOfficerortheChiefFinancialOfficerdesignee.
3.0 Trust Funds
3.1 The unit oflocalgovernmentmustestablishatrustfundin which todepositJAGfunds.Thetrust fund
mayormaynotbean interest bearing account.
3.2Theaccountmayearninterest,butanyearnedinterestmustbeusedfor program purposesand
expended beforethefederalgrantperiodenddate.Any unexpended interestremainingattheendof
the federal grant period must be submitted totheOfficeofCriminal Justice Grants for transmittal to the
Bureau of Justice Assistance.
4.0 Performance
4.1 Subaward Performance -Thesubrecipientmustcomplywith state andfederalrequirementsfor
subawardperformanceunder2C.F.R.§§200.76and200.77.Thesubawardshalldescribethe timing
and scope of expected performance as relatedtothe outcomes intended tobe achieved bythe
program.Whereappropriate,thesubawardshouldprovidespecificperformancegoals,indicators,
milestones,orexpectedoutcomes(suchas outputs,orservices performed or public impacts ofanyof
these)with an expected timeline for accomplishment.Submitted programmatic reports mustclearly
articulate,whereappropriate,performanceduringthe execution oftheawardhasmetastandard
againstwhich thesubrecipient's performance canbe measured.These requirements should be aligned
with agencystrategicgoals,strategic objectives,or performance goalsthatare relevant tothe program.
4.2Performanceof Agreement Provisions -In theeventof default;non-compliance;or violation ofany
provision ofthisagreementbythesubrecipient,thesubrecipient'sconsultantsandsuppliers,orboth,
theDepartmentshallimposesanctionsItdeemsappropriate including withholding paymentsand
cancellation,termination,or suspension ofthe agreement inwholeorinpart.In such event,the
Departmentshall notify thesubrecipientofitsdecision thirty (30)daysinadvanceofthe effective date
ofsuchsanction.Thesubrecipientshallbepaidonlyforthoseservices satisfactorily performed prior to
the effective date of such sanction.
5.0Grant Adjustments -Subrecipientsmustsubmitagrantadjustmentthrough SIMON formajorsubstantive
changes suchas:scope modificationsor changes toprojectactivities,target populations,service providers,
implementationschedules,projectdirector,designsorresearchplans set forthintheapprovedagreement,
and foranybudget changes thataffectacostcategorythatwasnotincludedintheoriginalbudget.
Adjustmentsarealsorequiredwhenthere will beatransferof 10%ormoreofthetotalbudgetbetweenbudget
categories,orthereisan indirect costratecategorychange.
5.1Subrecipientsmaytransferupto10%ofthetotalbudgetbetweencurrent,approvedbudgetcategories
withoutpriorapproval as long as thefundsare transferred toanexistinglineitem.

5.2 Under no circumstances can transfers of funds increase the total budgeted award.
5.3 Requests for changes tothe subaward agreement must be electronically signed by the subrecipient or
implementing agency's chiefofficialorthechiefofficial's designee.
5.4All requests for changes must be submitted inSIMONnolaterthanthirty(30)dayspriortogrant
expiration date.
6.0 Required Reports -Allreports must relate financial datatoperformance accomplishments.Subrecipients
must submitbothreportsohthe same reporting cycle.
6.1 Financial Expenditure Reports
6.1.2 The subrecipientshall have achoiceofsubmittingeitheraMonthlyoraQuarterlyProject
ExpenditureReporttotheDepartment.ProjectExpenditureReportsareduethirty(30)days
after the end ofthereportingperiod.In addition,ifthe subaward periodis extended,additional
ProjectExpenditure Reports shallbe submitted.
6.1.3All project expenditures for reimbursement of subrecipient costs shallbe submitted on the
ProjectExpenditure Report FormsprescribedandprovidedbytheOffice of Criminal Justice
Grants(OCJG)throughtheSIMON(SubgrantInformation Management Online).
6.1.4AllProject Expenditure Reports shallbe submitted in sufficient detailfor proper pre-auditand
post-audit.
6.1.5 Before the "final"ProjectExpenditure Report willbe processed,the subrecipient must submit
to the Departmentall outstanding projectreportsand must have satisfiedallspecialconditions.
Failureto comply withthe above provisionsshallresultinforfeitureof reimbursement..
6.1.6 Reports aretobe submitted even when no reimbursement is being requested.
6.1.7 The report must beelectronically signed bythe subrecipient or implementing agency's Chief
Financial Officer or the Chief Financial Officer's designee.
6.2 Project Performance Reports
6.2.1ReportingTimeFrames:Thesubrecipientshall submit MonthlyorQuarterlyProject
PerformanceReportsin SIMON,hereafterknownasthe Department,within fifteen (15)days
afterthe end ofthereporting period.In addition,ifthesubaward period is extended beyond
the "original"projectperiod,additional QuarterlyProjectPerformanceReportsshallbe ,

6.2.2 Failure tosubmit Quarterly Performance Reportsthatarecomplete,accurate,andtimelymay \

the Bureau of Justice Assistance.
64 Other Reports -The subrecipient shallreporttothe Uniform CrimeReportandotherreports as maybe
reasonably required bythe Department.
1.0 Access to Records -TheFlorida Department ofLawEnforcement,the AuditorGeneralofthe State ofFlorida,
theU.S.DepartmentofJustice,theU.S.ComptrollerGeneraloranyoftheirdulyauthorizedrepresentatives,
shallhave access tobooks,documents,papersandrecordsofthesubrecipient,implementing agencyand
contractorsforthe purpose ofaudit and examinationaccordingtotheFinancialGuideand the CommonRule.
TheDepartment reserves the right to unilaterally terminatethis agreement ifthesubrecipient,implementing
agency,or contractor refuses toallowpublic access toall documents,papers,letters,or other materials
subject to provisions of§119,Fla.Stat.,unless specifically exempted and/or made confidentialby operation of
§119,Fla.Stat.,andmadeorreceivedbythesubrecipientoritscontractorinconjunctionwiththis agreement.
The subrecipient will givetheawarding agency ortheGeneralAccountingOffice,throughanyauthorized
representative,access toandtherightto examine all paper or electronic records relatedto the financial
assistance.
2.0 Monitoring -Therecipient agrees tocomplywithFDLE'sgrant monitoring guidelines,protocols,and
procedures;andtocooperatewithFDLEonallgrant monitoring requests,including requestsrelatedtodesk
reviews,enhanced programmatic desk reviews,sitevisits,and/orFloridaDepartmentofFinancialServices
contract reviewsandExpandedAuditsofPayment(EAP).Therecipient agrees toprovideFDLEall
documentation necessary tocomplete monitoring oftheawardand verify expendituresinaccordance with §
215.971,Fla.Stat.Further,therecipient agrees toabideby reasonable deadlines setbyFDLEfor providing
requesteddocuments.Failure to cooperate with grant monitoring activities mayresultin sanctions affecting the
recipient'saward,including,butnot limited to:withholding and/orother restrictions ontherecipients access to
funds,referralto the Officeofthe.Inspector Generalforaudit review,designation oftherecipientasa FDLE
High Riskgrantee,or termination ofaward(s).
3.0Property Management -Thesubrecipientshallestablishandadminister a systemtoprotect,preserve,use,
maintain,anddisposeofany property furnished toitbythe Department or purchased pursuantto this
agreement accordingtofederalproperty management standards setforthinthe Office of Justice Programs
Financial Guide,U.S.Department ofJustice Common RuleforStateand Local Governments,or2 C.F.R.§
200,as applicable.This obligation continuesaslongasthesubrecipientretainstheproperty,notwithstanding
expiration ofthis agreement.
3.1 Property Use -Thesubrecipientmustuseequipmentacquired under a Federalawardforthe
authorized purposes oftheprojectduringtheperiodofperformance,oruntilthepropertyisnolonger
needed Subrecipients mustuse,manage,and dispose ofequipmentacquiredunderaFederalawardin
accordance with§274,Fla.Stat,and 2C.F.R.§200.313,"Equipment".
4.0 Subaward Closeout -AFinancial Closeout AuditshallbesubmittedtotheDepartmentwithin forty-five (45)
days oftheend date of the performance period.
4.1TheFinancialCloseoutAuditmustbe electronically signedbythesubrecipientor implementing
agency's ChiefFinancialOfficerortheChiefFinancialOfficer's designee.

510 HighRisk Subrecipients -Thesubrecipientagreestocomplywithany additional requirementsthatmaybe
imposed duringthegrant performance periodif FDLE's pre-awardrisk assessment ortheU.S.Department of

6.0 Reporting,Data Collection and Evaluation -Thesubrecipientagreestocomplywith all reporting,data
collectionandevaluationrequirements,asprescribedbytheBureauofJustice Assistance intheprogram
guidancefortheJustice Assistance Grant (JAG).Compliancewith these requirements will bemonitoredby
FDLE.
7.0 Retention of Records -Thesubrecipientshall maintain all recordsanddocuments for aminimumoffive(5)
years from the dateof the finalfinancial statement and be availableforauditandpublic disclosure upon
request ofdulyauthorizedpersons.Thesubrecipientshallcomplywith State of Florida General Records

8.0 Disputes and Appeals -The Department shall make its decision inwriting when responding toany disputes,
disagreements,or questions offactarisingunderthis agreement andshalldistributeits response toall
concerned parties.The subrecipient shallproceeddiligentlywiththe performance ofthis agreement according
to the Department's decision.If the subrecipient appeals the Department's decision,the appeal also shallbe
made inwritingwithin twenty-one (21)calendar daystothe Department's clerk (agency clerk).The
subrecipient's rightto appeal the Department's decision is contained in§120,Fla.Stat.,and in procedures set
forthinRule 28-106.104,Florida Administrative Code.Failureto appeal withinthistimeframe constitutes a
waiver of proceedings under §120,Fla.Stat.
9.0 Single Annual Audit
9.1 Subrecipients that expend $750,000 ormoreinayearinfederal awards shallhaveasingleauditor
program-specific audit conducted forthatyear.The auditshall be performed in accordance with2
C.F.R.§200(F)Audit Requirements andotherapplicablefederallaw.Thecontractforthis agreement
shall be identified in the Schedule of FederalFinancial Assistance in the subject audit.The contract
shall be identifiedasfederalfunds passed throughthe Florida Department ofLaw Enforcement and
include the contract number,CFDA number,award amount,contract period,funds received,and funds
disbursed.When applicable,the subrecipient shall submit an annual financialaudit that meets the
requirements ofFlorida Statutes 11.45,"Definitions;duties;authorities;reports;rules.";215.97,"Florida
SingleAuditAct";Rules oftheAuditorGeneral;Chapter 10.550,"Local Governmental EntityAudits";
and Chapter 10.650,"Florida Single AuditAct Audits NonprofitandFor-ProfitOrganizations.1'
9.2A complete auditreportthat covers anyportionofthe effective dates ofthis agreement must be
submitted within 30 days afterits completion,butnolaterthan nine (9)months after the auditperiod.In
ordertobe complete,the submitted reportshallinclude any management letters issued separately and
management's written response toall findings,includingauditreportand management letter fmaings.
Incompleteauditreportswillnotbe accepted bythe Department.
9.3Auditsshall be completed byan Independent Public Accountant (IPA)andaccordingtoGenerally
Accepted Government Auditing Standards (GAGAS).The IPA shallbeeitheraCertifiedPublic
Accountant ora Licensed Public Accountant.Subrecipients shall procure audit services accordingto§
200.509,and include clear objectives and scope of the auditinadditiontopeer review reportsto
strengthen auditqualityand ensure effective use ofaudit resources.
9.4The subrecipient shallpromptlyfollow-upandtakeappropriatecorrectiveactionfor any Findings onthe
auditreportin instances of noncompliance withfederallaws and regulations,includingbutnotlimitedto
preparation of a summary schedule ofpriorauditfindingsanda corrective actionplan.Subrecipient
follow-uptoauditfindings must abide by requirements in2 C.F.R.§200.511.
9.5 Auditees must make copies availableforpublic inspection and ensure respective partsofthereporting
package donotinclude protected personallyidentifiableinformation.Records shall be made available
upon request foraperiod of three (3)yearsfromthedatetheauditreportis issued,unless extended in
writingby the Department.
9.6 Subrecipients that expend less than $750,000 infederal awards duringafiscalyearare exempt from
theaudit requirements of2C.F.R.§200(F)forthatfiscalyear.Inthis case,written notification,which
can be in the formofthe"CertificationofAuditExemption"form,shallbeprovidedto the Departmentby

the Chief FinancialOfficer,or designee,that the subrecipient is exempt.Thisnoticeshallbe provided

8.0 Unmanned Aerial Vehicles -The recipient agrees that awarded funds may notbe expended on unmanned
aircraft,unmanned aircraft systems,oraerial vehicles (US,UAS,orUAV)unless theBJADirectorcertifies that
extraordinary and exigent circumstances exist,makingthem essential tothe maintenance ofpublicsafety and
good order.Additionally,anyfunding approved forthis purpose wouldbe subject toadditionalreporting,which

9.0 Personal Services -Subrecipients may use grant funds foreligible personal services (salaries/benefits and

9.1 Timesheets -Timesheets mustbekeptforall project staff whose hours will be charged totheproject.

9.5 Employees Working Solely on a Single Federal Award -For any positionthat works 100%ofits time !

during the lifeof the award,or once every fouryearsifmultipleawardsincludethis requirement.Thistraining
addresses task force effectiveness aswellasother key issues includingprivacyandcivilliberties/rights,task

3.3Foranyofasubrecipient'sexistingprogramsoractivitiesthatwillbefundedby these subawards,the
subrecipient,uponspecificrequest from theDepartmentandtheU.S.Department ofJustice,agrees to
cooperate withthe Department of Justice inanypreparationby the Department of Justice ofa national
or program environmental assessment ofthat funded programoractivity.
4.0 Methamphetamine Plans:MitigationofHealth,Safety and Environmental risks dealing with
Clandestine Methamphetamine Laboratories -Ifanawardismadetosupport methamphetamine laboratory
operations the subrecipient mustcomplywiththiscondition,which provides for individual site environmental
assessment/impact statements asrequiredunderthe National Environmental Policy Act.
4.1 GeneralRequirement:Thesubrecipient agrees tocomplywithfederal,state,andlocalenvironmental,
health and safety lawsandregulationsapplicabletotheinvestigationandclosureof clandestine
methamphetamine laboratories andtheremovalanddisposalofthechemicals,equipment,and wastes
usedinorresultingfromtheoperationoftheselaboratories.Thesubrecipientalso agrees tocomplete
a Methamphetamine MitigationPlan (MMP)that includesthenineprotective measures or components
required byBJA and submit the planto FDLE's OfficeofCriminal Justice Grants.
4.2 SpecificRequirements:Thesubrecipient understands and agrees thatanyprogramor initiative
involving the identification,seizure,orclosureofclandestine methamphetamine laboratoriescanresult
inadverse health,safetyand environmental impactsto(1)thelaw enforcement andother governmental
personnel involved;(2)any residents,occupants,users,and neighbors ofthesiteofa seized
clandestinelaboratory;(3)theseizedlaboratorysite'simmediateandsurroundingenvironmentofthe
site(s)where anyremainingchemicals,equipment,andwastefromaseizedlaboratory'soperations are
placedorcometorest.Therefore,thesubrecipientfurtheragrees thatinordertoavoidormitigatethe
possible adverse health,safety andenvironmentalimpactsfromanyof clandestine methamphetamine
operationsfundedunderthisaward,it will (1)includethenine,belowlistedprotective measures or
components;(2)providefortheiradequatefundingtoincludefunding,as necessary,beyondthat
providedbythisaward;and(3)implementthese protective measures directly throughoutthe life of the
•subaward.In sodoing,the subrecipient understands thatitmayimplement these protective measures
directlythroughtheuseofitsownresourcesandstafformay secure the qualified services ofother
agencies,contractororother qualified thirdparty.
4.2.1 Provide medical screeningofpersonnelassignedortobeassignedbythesubrecipienttothe
seizure or closure of clandestine methamphetamine laboratories;
4.2.2 Provide Occupational SafetyandHealthAdministration(OSHA)requiredinitialand refresher
trainingforlaw enforcement officialsand other personnel assigned by the subrecipient to either
the seizure or closure of clandestine methamphetamine laboratories;
4.2.3 Asdeterminedbytheirspecificduties,equippersonnel assigned totheproject with OSHA
requiredprotective wear andotherrequiredsafety equipment;
.4.2.4 Assign properly trained personnelto prepare a comprehensive contamination reporton each
closed laboratory;
4.2.5 Employqualifieddisposalcontractorstoremoveall chemicals and associated glassware,
equipment,and contaminated materialsand wastes fromthesite(s)of each seized clandestine
laboratory;
4.2.6 Dispose ofthe chemicals,equipment,and contaminated materials and wastes removedfrom
the sitesof seized laboratoriesatproperlylicensed disposal facilities or,when allowable,
properly licensed recycling facilities;
4.2.7Monitorthe transport,disposal,andrecycling components of subparagraphs 4.4.5and4.4.6
immediately above in order to ensure proper compliance;

4.2.8 Have in place and implement an inter-agency agreement or other formof commitment witha
responsible State environmental agency that providesfor that agency's 1)timely evaluation of
the environmental conditions atand around thesiteofa closed clandestine laboratoryand2)
coordination with the responsible party,property owner,or others to ensure that any residual
contamination is remediated,if necessary,and in accordance with existing federal and state
requirements;and
4.2.9 Haveinplaceand implement awritten agreement with the responsible state orlocal service
agencies toproperly respond toanyminor,as definedby state law,atthesite.This
agreement must ensure immediate response byqualified personnel who can t)respond to the
potential health needs ofanyminor at thesite;2)take that minorinto protective custody unless
the minoriscriminallyinvolvedin the meth labactivitiesoris subject to arrest for other criminal
violations,3)ensure immediatemedicaltestingfor methamphetamine toxicity;and4)arrange
for any follow-up medical tests,examinations,orhealth care made necessary as aresultof
methamphetamine toxicity
5.0 National Historic Preservation Act -TheAct wilt assist theDepartment(if necessary)in assuring
compliance with section 106 of.the NationalHistoric Preservation Actof 1966 (16 U.S.C.§470),Ex.Order
11593 (identificationandprotectionofhistoricproperties),theArcheological and Historical Preservation Actof
1974(16 U.S.C.§469 a-1 et seq.j,andthe National Environmental Policy Act of 1969 (42 U.S.C.§4321).
6.0 Human Research Subjects -Subrecipient agrees tocomplywiththe requirements of28C.F.R.§46andall
OfficeofJustice Programs policies and proceduresregardingtheprotectionofhuman research subjects,
including obtainment of Institutional ReviewBoardapproval,ifappropriate,andsubjectinformedconsent.
7.0 Global Standards Package -In order topromoteinformation sharing and enable interoperabilityamong
disparate systems across the justice and public safety community,OJP requires therecipienttocomplywith
DOJ'sGlobal Justice Information Sharing Initiative (DOJ's Global)guidelinesandrecommendationsforthis
particular grant.RecipientshallconformtotheGlobal Standards Package (GSP)andall constituent elements,
where applicable,as described at:www.it.oip.gov/qspqrantcondition.Recipient shall document planned
approaches toinformationsharingand describe compliance totheGSPand appropriate privacypolicythat
protects shared information,orprovide detailed justificationforwhyan alternative approach is recommended.
8.0 Disclosures
8.1 Conflict of Interest -The subrecipient andimplementing agency will establish safeguards toprohibit
employees fromusingtheir positions fora purpose that constitutes or presents the appearance of
personal ororganizationalconflictofinterest,or personal gain.Subrecipients mustdisclosein writing
any potentialconflictof interest to FDLE (thenon-federal pass-through entity).
8.2 Violations of CriminalLaw -Thesubrecipientandimplementing agency must disclose allviolationsof
stateorfederal criminal law involving fraud,briberyor gratuity violations potentially affectingthesub
award.
9.0Uniform Relocation Assistance andRealProperty Acquisitions Act -Thesubgrantrecipient will comply
withtherequirementsofthe Uniform Relocation Assistance andRealPropertyAcquisitionsActof1970(42
U.S.C.§4601etseq.),whichgovernsthetreatmentofpersonsdisplacedasaresultoffederaland federally-
assisted programs.
10.0Limitationson Government Employees FinancedbyFederal Assistance -Thesubrecipientwill comply
with requirements of5 U.S.C.§§1501-08 and 7324-28,which limit certainpoliticalactivitiesof State orlocal
government employees whose principalemploymentisinconnectionwithanactivityfinancedinwholeorin
part by federal assistance.
11.0ReportingPotential Fraud,Waste,Abuse,andSimilarMisconduct -The subrecipient must promptly refer
toDOJ Office ofInspectorGeneral (OIG)andtheFloridaDepartmentofLawEnforcement,Officeof Criminal
Justice Grantsany credible evidence thataprincipal,employee,agent,contractor,subcontractor,orother
person has either 1)submitted aclaimforgrantfundsthatviolatesthe False ClaimsAct,or2)committeda
criminalor civil violationoflawspertainingto fraud,conflict ofinterest,bribery,gratuity,orsimilarmisconduct
involving grant funds.

MessagingWhile Driving,"74Fed.Reg.51225(October 1,2009),and§316.305,Fla.Stat..,the subrecipient
is encouraged to adopt andenforcepoliciesbanning employees fromtext messaging whiledriving any vehicle
duringthe course of performing workfundedbythissubawardandto establish workplacesafetypoliciesand
conduct education,awareness,andotheroutreachto decrease crashes caused by distracted drivers.
15.0 DNA Testing of Evidentiary Materials and UploadofDNAProfilestoa Database -If JAGprogram funds
will beusedfor DNA testingof evidentiary materials,any resulting eligible DNA profiles mustbeuploadedto
the CombinedDNA Index System(CODIS),bya government DNAlabwith access to CODIS.Noprofiles
generated withJAGfundingmaybeenteredintoanyothernon-governmental DNA database withoutprior
express written approval fromBJA.Formoreinformation,refertotheNUFY 2012 DNA BacklogReduction
Program,available athttps://www.ncirs.aov/pdffiles1/nii/sl001062.pdf.Inaddition,fundsmaynotbe used for

16.0 Environmental Requirements and Energy -For subawards in excess of $100,000,the subrecipient must
