A Resolution declaring that the personal property,described in the attached
list,is "surplus"and authorizing the City Manager to dispose of the "surplus"
items.
WHEREAS,Section 2-4.7 titled "Surplus city-owned property"of the City of South Miami
Code of Ordinances states that all personal property owned by the City shall not be sold unless
and untilitis declared to be surplus property by resolution of the City Commission;and
WHEREAS,the City Manager is recommending that the attached list of personal
property items be classified as "surplus"because said property serves no useful function for any
activity or in any location within the City and should be sold to the highest bidder by way of a
City auction or as otherwise provided in section 2-4.7 of the City Code of Ordinances.
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE
CITYOF SOUTH MIAMI,FLORIDA;
Section 1.The personal property described in the attached list of City-owned property
have no useful function for any activity or in any location within the City,are deemed to be
"surplus"and City Manager is hereby authorized to dispose of the items in accordance with the
procedure set forth in section 2-4.7 of the CityCodeof Ordinances,including sale at public
auction.
Section 2.Severability.If any section,clause,sentence,or phrase of this resolution is
forany reason heldinvalid or unconstitutional bya court of competent jurisdiction,thisholding
shall not affect the validity of the remaining portions of this resolution.
Section 3.Effective Date:This resolution shall take effect immediately upon
enactment.

CityCommission per Section2-4.7of the Code of Ordinances.
Section 2-4.7 titled:"Surplus city-owned property"of the CityofSouth
Miami Code of Ordinances states that all personal property ownedby
the City shall not besoldunlessand until itisdeclared to besurplus
property byresolutionoftheCityCommission.TheCityManageris
recommending that theattachedlistof personal property items be
classified as"surplus."Whilesomeof the personal property items
declared surplus are ingood or fair condition,they serve no useful
functionforany activity or inanylocationwithintheCityandshouldbe
sold to the highestbidderbywayofaCity auction.

Sec.2-4.7.-Surplus city-owned property.
(a)Itemsofpersonalpropertyownedbythecityshallnotbesold unless anchuntilit isdeclaredtobesurplus
property by resolution of the city commission.
(b)Thecitycommissionshallnot consider declaringanyitemof personal propertytobesurplus unless the city
manager has affirmatively recommended such action thereon.
(c)Upondeterminationbyresolutionbythecitycommissionthatanitemof personal propertyissurplus,the city
manager ishereby authorized toselltothe highest bidderatpublic sale or,if approved bythe commission by
resolution,atpublicauction,saiditemof personal propertyafteradvertisingthe date,timeand place ofsaid
saleorauctiononceaweekforthree(3)consecutiveweeksina newspaper of general circulation in the city.
Thecity manager shallhavetherightto accept orrejectanyorallbids.Inthe event thepersonalpropertyshall
beofferedfor sale orauction,andnobidsshallbereceived therefor,itshallbe deemed thatsuch property has
no value and the city manager inhisdiscretionmayorderit destroyed or otherwise disposed of.
(d)This section shallnotapplytostolen,abandoned orconfiscated personal propertywhichhascomeintothe
city's possession.
