Res No 097-16-14653RESOLUTION NO:097-16-14652 A Resolution declaring that the personal property,described in the attached list,is "surplus"and authorizing the City Manager to dispose of the "surplus" items. WHEREAS,Section 2-4.7 titled "Surplus city-owned property"of the City of South Miami Code of Ordinances states that all personal property owned by the City shall not be sold unless and untilitis declared to be surplus property by resolution of the City Commission;and WHEREAS,the City Manager is recommending that the attached list of personal property items be classified as "surplus"because said property serves no useful function for any activity or in any location within the City and should be sold to the highest bidder by way of a City auction or as otherwise provided in section 2-4.7 of the City Code of Ordinances. NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITYOF SOUTH MIAMI,FLORIDA; Section 1.The personal property described in the attached list of City-owned property have no useful function for any activity or in any location within the City,are deemed to be "surplus"and City Manager is hereby authorized to dispose of the items in accordance with the procedure set forth in section 2-4.7 of the CityCodeof Ordinances,including sale at public auction. Section 2.Severability.If any section,clause,sentence,or phrase of this resolution is forany reason heldinvalid or unconstitutional bya court of competent jurisdiction,thisholding shall not affect the validity of the remaining portions of this resolution. Section 3.Effective Date:This resolution shall take effect immediately upon enactment.
