Ord No 10-16-2243ORDINANCE NO.10-16-2243 An Ordinance amending Chapter 15 of the City of South Miami's Code of Ordinances,Article I,Section 15-66,titled "state misdemeanors"and to authorize the issuance of a civil citation in lieu of arrest for certain misdemeanors,establishing enforcement,penalties and procedures relating thereto WHEREAS,theCity of South Miami has been vested with home rule power to enact ordinances that do not conflict with state law;and WHEREAS,theCity of South Miami ("City")has previously enacted Section 15-66, which makes itunlawfultocommitanyactwhichisorshallberecognizedbythelawsoftheStateof Floridaasamisdemeanor when such act is committed withinthejurisdictionalboundaries of theCity,; and WHEREAS,several states and localities have modified their drug laws to create civil violations for possession of de minimis amounts of marijuana,which is enforceable bya monetary fineand does not subject that person to arrest or criminal prosecution;and WHEREAS,this proposed ordinance will provide the City's police department with an alternative to arrest for certain misdemeanors and it will create additional mechanism under the City's Code to enforce these violations;and WHEREAS,the Mayor and City Commission have an interest in enacting monetary civil penaltiesfor certain misdemeanor violations andsuchcivil penalties willactasan additional deterrent to such violations when encountered bythe officers of the South Miami Police Department;and WHEREAS,the South Miami Police Department should have the discretion to issue a civil citation pursuant tothisordinance,orarrestornotarresta person forthe commission of a misdemeanor under State law. WHEREAS,those individuals who are issued a civil citation in lieu of arrest should undergoanassessment,perform communityserviceandberequiredtobetreatedforunderlying causes of their crime;and WHEREAS,a similar planhassupportfromthe Miami-Dade Police Department. WHEREAS,"the issuance of acivil citation is appropriate for those individuals who haveno record,oronlya minor criminal history;and WHEREAS,police officers should stillhavethe authority to make an arrest or issue a civil citation,depending onthe crime andthe circumstances. Page 1 of 3 Ord.No.10-16-2243 NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1.Chapter15 of theCity of South Miami's Code of Ordinances,Section15-66, titled "state misdemeanors"isherebyamendedinpertinentparttoreadasfollows: Sec.15-66.-State misdemeanors. (1)Itshallbe unlawful to commit withinthelimits of thecity,anyact which isor shallbe recognized bythelaws of theState of Florida asa misdemeanor,andthe commission of such act is hereby forbidden. (2)Whosoever shallviolatetheprovisions of this section,upon conviction thereof, shallbe punished bythesamepenaltyasis provided bythelaws of thestate. (3)Notwithstanding subsection (2),thefollowing misdemeanors)areeligibleto receive a civil violation notice and are subject to the fine set forth in this section, atthe discretion of alaw enforcement officer and provided that such violations do not occur in conjunction with any charge that isa felony,or that involves driving under the influence,domestic violence,or a violent crime,as those terms are defined under State law: (a)Possession of Cannabis inan amount of 2010 grams orless,assetforthin section 893.13 (6)(b)of the Florida Statutes,as such may be amended from time to time;and/or (b)Possession of Drug Paraphernalia,assetforthin sections 893.146 and 893.147(1)(b)of the Florida Statutes as such may be amended from time to time. (4)Penalties.A person violating subsection s.15-66(3)(a)and/or (b)who has received a civil citation shallpayafine of $100.00 within ten(10)days of the issuance of the citation.If the person contests the citation orfailsto timely paythe fine and is thereafter found to have violated 15-66 (3)(a)and/or (b)by a court of competent jurisdiction,the violator maybe ordered topayafinenottoexceed $500,andtheviolatormayalsobesentencedtoadefiniteterm of imprisonment, not to exceed 60 days,or if thefindingisbya Special Master,the violator maybe ordered to pay afinenotto exceed $5,000. (5)Enforcement.TheSouthMiamiPolice Department shallhavetheprimary responsibility for enforcement of this section but other law enforcement agencies are not precluded,if authorized by general law,fromany action to assure compliance with thissectionandallapplicablelaws.If alaw enforcement officer finds a violation of (3)(a)and/or (b),the officer is hereby authorized to issue a citation in compliance with Section 2-4.9or Section 2-25. (6)Rights of violators: (a)A person who has been served with a citation fora violation of this section shall pay thecivilfineinthe manner indicated onthe citation within ten (10)days of theissuance of thecitation.Thefailuretopaythefinewithin ten (10)daysshallbetreatedasadenial of thechargeand,attheoption of the law enforcement officer who issued the citation,as a criminal matter to Page 2 of 3 Ord.No.10-16-2243 be adjudicated by the County Court or as a civil matter to be enforced by a Special Master. (b)A person whofailstoappearatthehearingtocontestthecitation,shallbe deemed to have waived the right to contest the citation and in such case a judgment may be entered against the person forthe maximum penalty. (c)If the citation istobeenforcedbyaSpecialMaster,theSpecialMaster shallnothavediscretiontoaltertheinitial penalty prescribed bythis Section but may increase the penalty tothe maximum authorized bylaw. Section 4.Codification.The significant provisions of this ordinance shall become and be made part of the Code of Ordinances of theCity of South Miami as amended;that the sections of this ordinance may be renumbered or re-lettered to accomplish such intention;and that the word "ordinance"may be changed to"section"or other appropriate word. Section 5.Severability.If any section,clause,sentence,or phrase of this ordinance is forany reason held invalid or unconstitutional bya court of competent jurisdiction,this holding shall not affect the validity of the remaining portions of this ordinance. Section 6.Ordinances in Conflict.All ordinances or parts of ordinances and all sections and parts of sections of ordinances in direct conflict herewith are hereby repealed. Section 7.Effective Date.This ordinance shall become effective upon enactment. PASSED AND ENACTED this 17thday of May,2016.
