ORDINANCE NO.09-16-2242 An Ordinance of the City of South Miami establishing a moratorium on the subdivision of parcels of land pending the adoption of an amendment to the City's Land Development Code,Section 20-4.2,governing subdivision of land,and enactment of Section 20-5.17,governing buildable sites. WHEREAS,the City Commission has expressed concerns astothe manner and procedure through which property intheCity of South Miami is being subdivided;and WHEREAS,theCity Commission hasbeeninthe process of amending 20-4.2forovera year;and WHEREAS,on March 15,2016,theCity Commission passed,onfirst reading amendments to Sections20-5.17 and20-4.2,of the City's Land Development Code;and WHEREAS,onApril12,2016,the Planning Board reviewed the proposed ordinances and recommended that thelotsplit ordinance be adopted with amendments,andthe other ordinance not be enacted;and WHEREAS,itis anticipated that theCity Commission will address the ordinance on second reading on May 3rd,2016 and itis anticipated that the ordinances may need a third reading;and WHEREAS,the Mayor and Commission desireto maintain thestatusquountilthe ordinances canbe approved or rejected bytheCity Commission. NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1.TheCityherebyenactsatemporarymoratoriumontheacceptance of any applicationsforthe subdivision of landintheCity.The moratorium shallexpireon60daysor thedatethattheCity Commission enactsorrejectsan amendment tosection20-4.2 of theLand Development Codev,whichever occursfirst. Section 2.Determination of Vested Rights or Denial of All Economic Use. (A)Nothing inthis Ordinance shallbe construed or applied to abrogate the vested right of a property owner to complete subdivision of a parcel where the property ownercan demonstrate bysubstantial competent evidence each of thefollowing: 1.A governmental actionoccurredpriortotheeffectivedate of this Resolution uponwhichthepropertyownerhas detrimentally relied,ingoodfaith, by making substantial expenditures;and 2.It would behighly inequitable todenythe property owner the right to complete the subdivision of the owner's land. (B)Any property owner claiming vested rights or denial of alluse under this Resolution must filean application with theCity Commission fora determination within 90days after the effective date of this Resolution.The time limit for filing an application Page 1 of 2 Ord.No.09-16-2242 shallbejurisdictional.The application shallcontainaswornstatementastothebasis upon which the vested rights or denial ofalluseare asserted,together with documentation required bytheCityandanyother documentary desires to support the claim.Each document submitted shallhave,attached toitorbe accompanied by,asworn statementattesting,underpenaltyofperjury,tothetruthofthefactscontainedinthe documentandattestingthatthe document,ifacopy,isatrueandaccurateduplicateof the original.TheCity Commission shallholdapublichearingonthe application and, baseduponthe competent substantial evidence presented atthe hearing,shall make a determinationastowhetherthepropertyownerhasestablishedavestedright. Section 3.Judicial Review.Judicial review of final decisions bytheCity Commission underSection1aboveshallbebyfilinganactioninCircuitCourtandunderSection2ofthis Ordinance shallbebythefilingofa Petition forWritof Certiorari intheCircuitCourtofthe EleventhJudicialCircuitinandforMiami-DadeCountyinaccordancewiththeFloridaRulesof AppellateProcedureforthereviewofthe quasi-judicial decisionsof municipalities. Section 4.Exhaustion of Administrative Remedies.No property owner claiming that thisOrdinance,asapplied,constitutesorwouldconstituteatemporaryorpermanenttakingof privatepropertyoranabrogationofvestedrightsmaypursuesuchclaimincourt,unlessheorshe hasfirstexhaustedtheapplicable administrative remediesprovidedinSections2ofthis Ordinance. Section 5.Severability.If anysectionclause,sentence,orphrase of thisordinanceisfor anyreasonheldinvalidorunconstitutionalbyacourt of competent jurisdiction,theholdingshall notaffectthe validity of the remaining portions of this ordinance. Section 6.Effective Date.This Ordinance shallbe effective immediately upon adoption. PASSED AND ENACTED this 1 7thday of May 2016.
