RESOLUTION NO.096-16-14651 A Resolution approving a request foran extension of time for issuance of permits fora Special Use that was previously approved by Resolution No.199-15-14538,to locate a general restaurant at5840 SW 71 Street (Commercial Space -101). Background: On November 17,2015,the CityCommission granted special use approval to the applicant, Grouper SOMI,LLC,via Resolution No.199-15-14538 in order to open a general restaurant at 5840 SW71 Street,Commercial Space -101.Since being approved,the applicant has undertaken significant infrastructure improvements,including utility upgrades in the area. While these upgrades willbebeneficial to the community once completed,they have significantly delayed the issuance ofbuilding permits for the project.Inan abundance of caution,the applicant is requesting that the specialuse approval be extended an additional six (6)months. Request: The applicant is requesting that the City Commission grant asix(6)month extension to the specialuse approval granted inResolutionNo.199-15-14538.This request is consistent with Section 20-5.8(D)of the Land Development Code (LDC),which states: Four (4)affirmativevotes of thecity commission maygrantanextensionfora previously approvedspecialuseifaproperandtimelyrequestismadebythe applicantpriortothe expiration of the approval period. Analysis: Section 20-5.8(C)of the LDC provides the followingprovisions regarding SpecialUse expirations: Anapprovedspecialuseshalllapseaftersix(6)monthsifno master building permit which implementsthespecialuseor certificate of occupancyhasbeen issuedforsuchuseandifthecity commission hasnotspecifiedalonger approval period for good cause. The Applicant1s proposed development is illustrated on the attached plans,does not increase the square footage of the existing building,offers compatible and complimentary uses that will operate harmoniously with the other retail uses that operate in the vicinity,and will not overburden roadways or other City services.The outdoor seating for the Applicant1s proposed development would not be in the public- right-of-way. The developer at this time is seeking Special Exception approval from the City Commission to reduce theamountof required parking from 17 to0,and fee waiver for the $17,000 into the Hometown Improvement Trust Fund. Surrounded by restaurant uses,the proposed project would be compatible with the surrounding land uses and development intensities prescribed. 3.The proposed development must possess integrity of design compatible with the design criteria established for the Hometown District andwiththe overall image of thecity. Utilizing an existing one (1)story building,the proposed project will besetback approximately forty-six (46)feet from SW 71"Street,whichwill allow for the incorporation ofsix (6)on-site parking spaces as well asan outdoor seating area that willbe located within private property;that will allow for an effective management of traffic.As part of the project,a new refuse enclosure is being proposed along the eastern perimeter of the property that will be enclosed in order to accommodate the waste generated bythe development. 5.The proposed development does not expand the permitted uses within the Hometown District.
