Background: On November 17,2015,the CityCommission granted special use approval to the applicant, Grouper SOMI,LLC,via Resolution No.197-15-14536 in order to open a general restaurant at 5840 SW71 Street,Commercial Space -102.Since being approved,the applicant has undertaken significant infrastructure improvements,includingutility upgrades in the area. While these upgrades willbe beneficial to the community once completed,they have significantly delayed the issuance of building permits for the project.In an abundance of caution,the applicant is requesting that the special use approval be extended an additional six (6)months. Request: The applicant is requesting that the CityCommission grant asix (6)month extension to the special use approval granted in Resolution No.197-15-14536.This request is consistent with Section 20-5.8{D)of the Land Development Code (LDC),which states: Four(4)affirmativevotes of thecitycommissionmaygrantanextension for a previouslyapprovedspecialuseifaproperandtimelyrequestismadebythe applicantpriortothe expiration of theapprovalperiod. Utilizing an existing one (1)story building,the proposed project will beset back approximately forty-six (46)feet from SW 71st Street which will allow for the incorporation ofsix (6)on-site parking spaces aswellasan outdoor seating area that willbe located within private property;that will allow for an effective management of traffic.As part ofthe project,anew refuse enclosure is being proposed along the eastern perimeter ofthe property that will be enclosed in order to accommodate the waste generated bythedevelopment 5.The proposed development does not expand the permitted uses within the Hometown District The proposed project will not expand the permitted uses within the Hometown District The proposal oftwo (2)new restaurants will be contained withinthe existing one (1)story building,which will be renovated.Itis important tonote thatwhilethe building will be renovated in order to accommodate thenew restaurants,no additional square footage will be added tothe space.Furthermore, the impervious surface for the site will be reduced in order to incorporate landscaped areas atthe front ofthe site. 6.The proposed development will not have an unfavorable effect onthe economy ofthe City of South Miami.
