No. 26-80-1085ORDINANCE NO.26-80-1085 AN ORDINANCE OF THE CITY OF SOUTH MIAMI, FLORIDA,GRANTING VARIANCES TO MR.AND MRS.JOSE J.BASULTO AND TO MRS.MARGARET W.SHAW TO PERMIT THE CONSTRUCTION OF TWO SINGLE FAMILY RESIDENCES,EACH RESIDENCE TO BE ON A LOT 60 FEET WIDE INSTEAD OF THE REQUIRED 75 FEET AS TO CERTAIN DESCRIBED PROPERTY LOCATED AT THE SOUTHEAST CORNER OF SOUTHWEST 84TH STREET AND SOUTHWEST 58TH AVENUE,SOUTH MIAMI,FLORIDA,SAID VARIANCES TO BE PERMANENT AND NOT SUBJECT TO BEING LAPSED. WHEREAS,the Courts of the State of Florida have heretofore issuedan Order permitting the construction of a single family residence on: Lot 16,Block 2,AMENDED PLAT OF SEA VIEW PARK,according to the Plat thereof,as recorded in Plat Book 17,Page 80,of the Public Records of Dade County,Florida, and WHEREAS,the present owners of said property,Mr. and Mrs.Jose J.Basulto,have entered into an agreement with Mrs.Margaret W.Shaw tosellsaidLot16tothe said Mrs. Margaret W.Shaw in exchange forthe transfer of title toMr. and Mrs.Jose J.Basulto of: Lot 18,and the West 20 feet of Lot 17, Block 2,AMENDED PLAT OF SEA VIEW PARK, according to the Plat thereof,as recorded in Plat Book 17,Page 80,of the Public Records of Dade County,Florida, and WHEREAS,the City of South Miami considers ittobe totheCity'sbenefitforasinglefamilyresidencetobebuilt on a lot 60 feet wide rather than a lot 40 feet wide,and WHEREAS,the parties who have entered into this contract have agreed to consummate the agreement provided the City grants each of the parties a variance permitting them or their heirs in title to build a single family residence on the respective lots tobe owned bythem,with only a60 foot width instead of the 75 foot width required by law,and WHEREAS,theCityofSouthMiamiconsidersittobetheir best interests for these variances tobe granted,and WHEREAS,thePlanningAdvisoryBoardoftheCityofSouth Miamihas recommneded thatthe variances requested begranted. NOW,THEREFORE,BEIT ORDAINED BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA: Section 1.That Mr.&Mrs.Jose J.Basulto,their heirs and assigns,be,andtheyare hereby granted a variance permitting theconstruc tionofa single family residence onthe property described as: LOT 18,and the West 20 feet of Lot 17,Block 2, AMENDED PLAT OF SEA VIEW PARK,according tothe Platthereof,as recorded inPlatBook17,Page80, ofthe Public Records of Dade County,Florida. Section 2.ThatMrs.Margaret W.Shaw,herheirsandassigns, be,andshe is herebygrantedavariancepermittingtheconstructionof a single family residence onthe property described as: LOT 16,and the East 20 feet of Lot 17,Block 2, AMENDED PLAT OF SEA VIEW PARK,according tothe Plat thereof,as recorded in Plat Book 17.Page 80, ofthe Public Records of Dade County,Florida. Section 3.Allofthe above described property is located at the Southeast corner of Southwest 84th Street and Southwest 58th Avenue, South Miami,Florida. Section 4.Notwithstanding anything tothe contrary contained in Section 13-4 of Article XIII of Ordinance No.70-21-724,heretofore adopted asthe Official Zoning Ordinance ofthe City of South Miami,itis the intention thatthe variances herein granted shall be permanent.
