A Resolution approving a request for an extension of time for issuance of permits for a
Special Use that was previously approved by Resolution No.197-15-14536, to locate a general
restaurant at 5840 SW 71 Street (Commercial Space -102).
BACKGROUND:
On November 17, 2015, the City Commission granted special use approval to the applicant,
Grouper SOMI, llC, via Resolution No. 197-15-14536 in order to open a general restaurant at
5840 SW 71 Street, Commercial Space -102. Since being approved, the applicant has
undertaken significant infrastructure improvements, including utility upgrades in the area.
While these upgrades will be beneficial to the community once completed, they have
significantly delayed the issuance of building permits for the project. In an abundance of
caution, the applicant is requesting that the special use approval be extended an additional six
(6) months.
REQUEST:
The applicant is requesting that the City Commission grant a six (6) month extension to the
special use approval granted in Resolution No. 197-15-14536. This request is consistent with
Section 20-5.8(D) of the land Development Code (lDC), which states:
Four (4) affirmative votes of the city commission may gront an extension for a
previously approved special use if a proper and timely request is made by the
applicant prior to the expiration of the approval period.
ANALYSIS:
Section 20-5.8(C) of the lDC provides the following provisions regarding SpeCial Use
expirations:
An approved special use shall lapse after six (6) months if no master building
permit which implements the special use or certificate of occupancy has been
issued for such use and if the city commission has not specified a longer approval
period for good cause.

Based on the above referenced section, the applicant's special use approval would lapse on
May 17, 2016, approximately six months after the City Commission approval. While the
applicant has submitted the necessary permit application and plans required for a master
permit, it has not been issued yet. This is due to discrepancies in the plans, requiring
corrections to be made prior to being approved.
STAFF RECOMMENDATION:
After reviewing the request, staff recommends approval of a six (6) month extension of the
Special Use approval granted in Resolution No. 197-15-14536.

8 WHEREAS, pursuant to Section 20-3.4(B)(4)(b) of the Land Development Code (LDC),
9 the applicant, GROUPER SOMI, LLC, submitted to the Planning Board Application No. PB-15-
10 014, requesting a Special Use Approval to operate a general restaurant at 5840 SW 71 Street-
11 Commercial Space 102, within the Specialty Retail "SR", Hometown District Overlay "HD-OV"
12 zoning district; and

14 WHEREAS, at the November 17,2015 Commission meeting, and following a public
15 hearing, the Commission voted nnanimously to recommend approval of the special use request to
16 open a general restaurant at 5840 SW 71 Street -Commercial Space 102 via Resolution No.
17 197-15-14536; and

19 WHEREAS, pursuant to Section 20-5.8(C) of the Land Development Code, an approved
20 special use shall lapse after six (6) months if no master building permit which implements the
21 special use or certificate of occupancy has been issued for such use and if the City Commission
22 has not specified a longer approval period for good cause; and

24 WHEREAS, the applicant is working with the City to obtain a building permit for the
25 project and is requesting an extension of six (6) months pursuant to the requirements of Section
26 20-5.8(D) of the Land Development Code to facilitate the completion of permitting; and

28 WHEREAS, the applicant filed a request for an extension and four affirmative votes of
29 the City Commission is required for the granting of such an extension.

31 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
32 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT:

Dear Ms. Cabrera-Hernandez:
The purpose of this letter is to formally request, on behalf of the property owner,
Grouper SOMI, LLC, a six (6) month extension for the Special Use approvals for restaurants
at 5840 SW 71 Street granted pursuant to Resolution Nos. 197-15-14536 and 199-15-14538 to
. permit more time to obtain their Master Building Permits in conjunction with said Special Use
approvals. The Special Use Approvals, copies of which are attached, were granted by the City
Commission on November 17, 2015. The request for this extension is to cover the period from
the current expiration date of May 17, 2016 for a period of six (6) months to November 17, 2016.
I have also attached Resolution No. 198-15-14537 which granted an extension of time for
payments into the City's Hometown District Improvement Trust Fund.
This extension is being requested in accordance with Section 20-5.8 of the City's Code
and enclosed is a check for the extension request fees totaling $500.00 in accordance with the
City's Planning and Zoning Fee Schedule. The property owner has undertaken significant
infrastructure improvements, including utility upgrades, in the area that will be a community-wide
benefit but which have significantly delayed the building permit process. More specifically, our
tenants, who have permit applications submitted, but not yet issued, were delayed by both the
longer time frame for us, as the Landlord, to complete the infrastructure improvements, and by
the need to await our final connection approvals for utilities so they could finalize their designs.
Both tenants are far along in their permit process, but, in an abundance of caution, we would
request this extension, in case their permit approvals are delayed further or they need to await
work pending completion of the initial infrastructure by us.

A Resolution for special use approval to permit a general restaurant at 5840 SW 71 st
Street (Commercial Space -102)
. WHEREAS, GROUPER SOMI, LLC submitted Application No. PB-15-014 re~uesting
approval of a special use to establish two general restaurants located at 5840 SW 71 s Street
within the (HD-OV) zoning district; and
WHEREAS, the applicant proposes to lease the existing vacant space that will front on
SW 71 ST Street; and
WHEREAS, restaurants are permitted as a special use within the Specialty Retail "SR",
Hometown District Overlay "HD-OV" zoning district and is subject to meeting general
conditions specified in LDC Section 20-5.8 and subject to meeting special use requirements set
forth in LDC Section 20-3.4(B)(4)(b); and
WHEREAS, at the September 8, 2015 public hearing the Planning Board recommended
approval with a vote of 4 to 1 for the special use.
WHEREAS, there has been an affirmative finding as to each of the following criterion as
required by 20-3 .4(B)( 4)(b)
(l) All such establishments shall provide only inside or patio service on private property.
Public streets, rights-of-way, sidewalks and required setbacks may not be used for patio
or street-side services of any kind.
(2) No services of a drive-in or of a fast food nature shall be permitted.
(3)The city commission shall review and recommend approval, disapproval or
modification of all site plans and project specifications for this special use permit; and
WHEREAS, the Mayor and City Commission desire to approvetheSpecial.ExGeption. .
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1: The recitals set forth in this resolution are true, they are supported by
competent substantial evidence and they are incorporated into this resolution by reference.
Section 2: The subject application No. PB-15-014 that was submitted to the Planning
Board by the applicants GROUPER SOMI, LLC for a special use to establish twe l! general
restaurants located at 5840 SW 71 ST Street within the (HD-O V) zoning 'district; is hereby
approved.

BACKGROUNP:
located in the Specialty Retail"SR", Hometown District Overlay "HD-OV," the applicant
is proposing to open two (2) new general restaurant uses within the existing building
(Commercial Space-101 and Commercial Space -102). Each commercial space shall have
a separate business license and ·parking requirements. This report identifies the
requirements needed for Commercial Space 102.
Pursuant to the regulations listed in the Permitted Uses, Section 20-7.12(A) of the land
Development Code (LDCl, a special use permit is required for the operation of a general
restaurant. Currently the building is operating as a dry cleaner, the building will be
subdivided into two (2) general restaurant uses that will operate independent of each other
and wi II front SW 71" Street.

As shown in Figure 1, the existing one-story building will be divided into two (2)
restaurant spaces.

Pursuant to the Special Use Conditions, Section 20-3.4 of the LOC, a special use may be
approved and permitted by the city commission at a public hearing, after a
.. recommendation by the planning board and that such use complies with. the general
requirements, special requirements, and any other conditions that the city commission
may consider appropriate and necessary.
When reviewing the project, the following items are noted:
• The site is currently being operated by a dry cleaner and has a total square footage
of 5,357 square feet. CorlilVercial Space -1 02 will occupy 2,756 square feet which
is a separate application.a_nd'r$lsolution.
• The proposed location is near SImilar restaurant uses to the north, (Akashi and Rice:
House of Kabob) as well as to the south, (Old Lisbon, Station 5, and Temple).
As shown on the attached site'pl~n, the applicant is proposing a complete renovation of
the site that includes the installation of a new refuse enclosure, new outdoor patio area,

and new landscape areas. The applicant is also proposing to utilize outdoor seating areas
for patrons to both of the restaurants. Pursuant to Section 20-3.3(E)(2) of the LDC:
Sidewalk cafe or Outdoor seating/dining areas and uses of the public right-
of-way and/or any private property abutting a pub/k right-of-way may be
approved, denied, or approved with conditions, modifications, safeguards,
or stipulations appropriately and reasonably related to the intent, purposes,
standards, and requirements of the related regulations by the City Manager.
The requested special use does not conflict with the Comprehensive Plan and complies
with the LDC requirements set forth in Section 20-5.8 in that the use'.
a) Will not adversely affect the health or safety of persons residing or working in the
vicin ily of the proposed use,
b) Will not be detrimental to the public welfare or property or improvements in the
neighborhood; and,
c) Complies with all other applicable Code provisions.
PlANNING BOARD AcrION:
At the September 8, 2015 Planning Board meeting and following a public hearing, the
Board voted 4-1 to recommend approval of the special use application PB-15-014.
STAFf RECOMMENDATION:
Staff recommends approval for the Special Use application to operate a general restaurant
at 5840 SW 71 ST Street.

A Resolution approving a special exception waiving strict compliance with the
provisions of the Hometown District Overlay parking requirements, for a general
restaurants at 5840 SW 71 Street (Commercial Space -102).
WHEREAS, GROUPER SOMI, LLC submitted Application No. PB-15-015 requesting
approval of a special exception to the required number of parking spaces to establish two
restaurants located at 5840 SW 71 ST Street within the (IID-OV) zoning district; and
WHEREAS, the applicant is requesting a special exception waiving strict compliance
with the Hometown District Overlay parking requirements and payment to Hometown Parking
Fund; and
WHEREAS, Section 20-7.12 Restaurant, General or Walk Up requires 1 parking space
per 100 sf devoted to patron use and 1 parking space for 300 sf devoted to non-patron use; and
WHEREAS, Section 20-7.6 Parking (C) (2) (c) provides that the fee payment into the
Hometown District Improvement Trust Fund for each space required but not provided shall be
one thousand dollars ($1,000.00) per parking space per year payable at the time of issuance of
the occupational license and at the time of renewal of the occupational license. This fee may be
adjusted periodically by the City Commission as appropriate; and
WHEREAS, at the September 8, 2015 public hearing of the Planning Board the board
recommended approval with a vote of 3 to 2 for the special exception with a condition allowing
one year waived parking fees upon approval from the Commissioners; and
WHEREAS, the Mayor and City Commission desire to approve the Special Exception.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1: The recitals set forth in this resolution are true, they are supported by
competent substantial evidence and they are incorporated into this resolution by reference.
Section 2: The subject application No. PB-15-015 that was submitted by the applicant
GROUPER SOMI, LLC for a special exception to the required number of parking spaces to
establish twe l! restaurants located at 5840 SW 71 ST Street within the (IID-OV) zoning district, is
hereby approved under the following conditions: Full payment of the $17,000 as provided in
city's Land Development Code based on a deficit of 17 parking spaces,.is waived for the first
year and the second year shall be paid in full.

Section 3. Severability. If any section clause, sentence, or phrase of this resolution is for
any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall

A ResolutIon approving a special exception waiving strict compliance with the
provisions of the Hometown District Overlay parking requirements, for a general
restaurants at 5840 SW 71 Street (Commercial Space-101).
BACKGROUND:
located in the Specialty Retail"SR", Hometown District Overlay "HD-OV," the applicant
is proposing to open two (2) new general restaurant uses within the existing building
(Commercial Space-101 and Commercial Space -1 02). Each commercial space shall have
a separate business license and parking requirements. This report identifies the
requirements needed for Commercial Space 101.
Each of the general restaurants will operate independently of each other and will front SW
71'1 Street. The applicant has applied for a special exception waiving strict compliance to
the parking requirements and payment into the Hometown Parking Fund for business
located within the Hometown Overlay District.
Site Location;
ANALYSIS:
As shown in Figure 1, the existing one-story building will be divided into two (2)
restaurant spaces.

When reviewing the project, the following items are noted:
• The site is currently being operated by a dry cleaner and has a total square footage
of 5,357 square feet. Commercial Space -101 will occupy 2,601 square feet of the
building.
• The existing building abuts similar restaurant uses to the north (Akashi and Rice:
House of Kabob) as well as to the south (Old lisbon, Station 5, and Temple).
• The site currently has a total of ten (10) on-site parking spaces.
• The Floor Plan/Site Plan shows that the proposed RestaurantSpace 101 will utilize
2,601 square feet.
As shown on the attached site plan, the applicant is proposing a complete renovation of
the site that includes the installation of a new refuse enclosure, new outdoor patio area,
and new landscape areas. By creating these new areas 2 parking spaces will be eliminated
from the code required refuse enclosure and 2 additional parking spaces will be
eliminated from the installation of the patio and landscaping area, leaving six (6) on-site
parking spaces for use that will be divided equally between Commercial Space 101 and
102_ As a result Commercial Space 101 is required to provide a total of twenty (20)
parking spaces, but with a credit for 3 existing parking spaces the modified requirement
for provided parking spaces is 17.
USE TYPE 1 parking space per

WALKUP 300 SF for non-patron use
As listed in Section 20-7.6(0(2)(b) of the LOC, if there are fewer spaces provided than
required for existing buildings, the applicant may: obtain a special exception waiving the
number of additional parking· spaces requiredj or pay into the Hometown District
Improvement Trust Fund the amount of $17,000 annually with a 5% increase also
annually.
The developer at this time is seeking Special Exception approval from the City
Commission to reduce the amount of required parking from 17 to 0, and fee waiver for the
$17,000 into the Hometown Improvement Trust Fund.
Pursuant to Section 20-7.51(A) of the LOC, the city commission may, by special
exception, waive strict compliance with the provisions of the Hometown District Overlay
Ordinance. In granting a special exception, the city commission must find by substantial
competent evidence that:
1. The proposed development contributes to, promotes and encourages the
improvement of the Hometown District and catalyzes other development as
envisioned in the Hometown District regulations.
The addition of the new restaurant uses would encourage more patrons to visit the
Hometown District which would in turn further stimulate the growth of the
Hometown District from a development standpoint.
2. The proposed development is compatible with the land uses and development
intensities prescribed by all applicable city regulations.
Surrounded by restaurant uses, the proposed project would be compatible with
the surrounding land uses and development intensities prescribed.
3. The proposed development must possess integrity of design compatible with the
design criteria established for the Hometown District and with the overall image of
the city.
The proposed restaurant possesses integrity of design that is compatible with the
design criteria established for the Hometown District Furthermore, its design is
keeping with the overall image of the city.
4. The proposed development shall be designed in a manner that provides for effective
management of traffic (vehicular and pedestrian), parking, lighting, noise and waste
generated by the development, and management of the impacts of the development
on public facilities and services.
Utilizing an existing one (1) story building, the proposed project will be set back
approximately forty-six (46) feet from SW 71" Street, which will allow for the
incorporation of six (6) on-site parking spaces as well as an outdoor seating area that
will be located within private property; that will allow for an effective management
of traffic. As part of the project, a new refuse enclosure is being proposed along the
eastern perimeter of the property that will be enclosed in order to accommodate the
waste generated by the development.
5. The proposed development does not expand the permitted uses within the
Hometown District.
The proposed project will not expand the permitted uses within the Hometown
District. The proposal of two (2) new restaurants will be contained within the
existing one (1) story building, which will be renovated. It is important to note
that while the building will be renovated in order to accommodate the new
restaurants, no additional square footage will be added to the space. Furthermore,
the impervious surface for the site will be reduced in order to incorporate
landscaped areas at the front of the site.
6. The proposed development will not have an unfavorable effect on the economy
of the City of South Miami.
The proposed restaurant uses will not have an unfavorable effect on the economy of
the City of South Miami. In fact it will contribute by continuing the occupation of an
existing one-story building that will add to the downtown attraction for residents
and visitors.
7. The proposed development, when considered cumulatively with other
development, both present and future, within the Hometown District, will not
create excessive overcrowding or concentration of people or population.
The proposed restaurant uses, when considered cumulatively with other
development, both present and future, within the Hometown District is determined
to be of a compatible and complementary nature with the existing and future
planned surrounding uses.
It is important to note that the Hometown District urban design features provide for
connectivity to alternative modes of transportation via mass transit, bicycles and
pedestrian corridors; although the proposed restaurant uses by code will still generate the
need for additional dedicated parking spaces as some visitors will arrive via automobile,
there are nearby parking facilities that can accommodate the influx of new patrons to the
Hometown District.
PLANNING BOARD RECOMMENDATION:
At the September 8, 2015 public hearing the Planning Board recommended approval of
the Special Exception with a vote of 3 to 2.
STAFF RECOMMENDATION:
Approval of the ordinance as proposed, imposing the fee for deficit parking provisions.

WHEREAS, the applicant is requesting a special exception waiving strict compliance
with the Hometown District Overlay parking requirements and paymenno Hometown Parking
Fund; and
WHEREAS, Section 20-7.12 Restaurant, General or Walk Up requires 1 parking space

District.

(5) The proposed development will not have an W1favorable effect on the economy of the
City of South Miami.
(6) The proposed development, when considered cumulatively with other development,
both present and future, within the Hometown District. will not create excessive
overcrowding or concentration of people or popUlation; and
WHEREAS, the approval of a special exception requires a recommendation from the
Planning Board and the approval of the City Commission after a public hearing; and
WHEREAS, the City Planning Department's staff recommendations at the public
hearing informed the Planning Board that the applicant is required to provide 16 parking spaces.
The Planning Department also stated that the applicant will receive a parking credit for the two
parking spaces located in front of the establishment along Sunset Drive reducing his parking
requirement to 14. It was also mentioned by the Planning Department that reliefto the applicant
could be established by requiring the applicant to pay $7,000 into the Hometown Parking Fund
for 7 parking spaces and the balance of the remaining 7 parking spaces could be provided by the
public parking garage located within one block of proposed restaurant; and
WHEREAS, the Planning Board at its August 11, 2015 public hearing motioned to
modified the recommendation of the Planning Department for the applicant to limit the waiver to
only one year. This motion ended in deadlock vote 3-3; and
WHEREAS, the Planning Board at its August II, 2015 public hearing made a second
motion to support the Planning Department's recommendation as is; without a one year term and
the second motion also resulted in a deadlock vote 3-3; and
WHEREAS, the Planning Board at its August 11, 2015 public hearing made a motion,
and approved the motion to rehear the item; and
WHEREAS, the Planning Board at its August 11, 2015 public hearing made a third
motion to modified the recommendation of the Planning Department for the applicant to be
approved but for only three years. This motion died for lack of a seconded; and
WHEREAS, the Planning Board at its August 11. 2015 public hearing made a
recommendation to forward the special exception application PE-15-010 to the commissioners
for decision; and
WHEREAS, the City Commission desires to approve the Special Exception.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1: Special Exception Application (PB-IS·OIO) submitted by applicant
SPIRITCO, LLC, to reduce the number of parking spaces and the required fee payment into the

Dear Mr. Williams:
Please allow this letter to supersede the Letter of Intent daled August 5, 2015,
filed in connection with the above-referenced applications on behalf of Grouper SOMI,
LLC (the "Applicant"), fee simple owner of the property located at 5840 SW 71 Street in
South Miami (the "Property"). This firm serves as counsel for the Applicant.
The Property is located in the Specialty Retail ("SR") Zoning District and in the
Hometown District Overlay ("HD-ovn) Zoning District. The Property's current use is
retail (dry cleaners) and its Future Land Use Category is Mixed-Use Commercial
Residential.
Restaurants may be permitted in the SR and HD-OV districts by application for
Special Use and Special Exception pursuant to 20-3.4(8) (4) (b) and 20-7.51 and 20-
7.52 of the Land Development Code (nLOC"). The Applicant intends to renovate the
existing one-story building in order to operate two general restaurants with outdoor
seating on the Property and hereby requests Special Exception Approval for the
provision of six (6) on-site parking spaces in lieu of the 38 parking spaces required by

existing retail use on the Property. This Special Exception Application is a companion to
the Applicant's Special Use Application that is required to permit the operation of the
restaurants.
The Applicant's proposed development is illustrated on the attached plans, does
not increase the square footage of the existing building, offers compatible and
complimentary uses that will operate harmoniously with the other retail uses that
operate in the vicinity, and will not overburden roadways e>r other City services. The
outdoor seating for the Applicant's proposed development would not be in the public-
right-of-way.
Due to existing building use, layout, and lot coverage, it would be difficult to fully
comply with the on-site parking requirement of the LDC of one parking space per 100
feet of restaurant space devoted to patron use and one parking space per 300 square
feet of restaurant space devoted to non-patron use.
The Applicant will provide six parking spaces on the Property. The location of
the. Property will permit patrons to use the City-owned surface parking lot, located two
lots to the east of the Property, the Sunset Place parking garage located across SW
58th Avenue, and the South Miami Metrora\! Station which is less than 100 feet from the
Property.
The proposed development follows the spirit of the City's Hometown District
Overlay regulations and Comprehensive Plan requirements in the following manner:
(1) Enhancing the City's community identity and sense of place by incorporating
design features such as paving and plantings that recognize the importance of pedestrian
comfort and the pedestrian environment;
(2) Utilizing "genuine" materials presented in a straightforward and functional
manner that give the development integrity of design compatible with the deSign criteria
established for the Hometown District and with the overall image of the City; and
(3) Invigorating the economic and social vitality of South Miami.
(4) The restaurant use will replace a less desirable retail use, a dry cleaners.
(5) The existing dry cleaners generates a parking demand of 18 spaces on the
Property in accordance with today's LDC that should be considered when weighing the impact
of the proposed restaurants. Section 20-7.6 (C) (5) of the LDC requires the City to consider this
impact in determining the threshold of required parking spaces when there is a change of use.
(6) Perhaps most importantly, the proposed development of two (2) restaurants on
the Property advances the. policy of the City in the intent of the HD-OV District which treats
. parking as an element of public infrastructure to be shared by customers to the local bUSiness
community, and which encourages this consideration of shared parking, particularly in close
proximity to MetroraiL (Section 20-7.2(A), LOC}.
