Background: The applicant,Luigi Vitalini,is proposing to construct a new outbuilding at the rear of the property located at 5800 Sunset Drive.Once constructed,the proposed outbuilding will contain both retail space and a mezzanine.As part of the construction,the applicant is proposing to reposition the existing staircase that leads to the second floor rear entrance of the historically designated building.As part of the review process,the item was scheduled to appear before the Historic Preservation Board at its December 2,2015 meeting.However,due to alack of quorum,the item was approved administratively and allowed to proceed to the Planning Board for its review. Location of Proposed Outbuilding Special Exception -5800 Sunset Drive May 3,2016 Page2of6 Request: The applicant is requesting that the CityCommissionwaive strict compliance with the provisions of the Hometown DistrictOverlay Ordinance via the special exception process found in Section 20-7.51(A)of the Land Development Code (LDC). Pursuant to Section 20-7.51(A)of the LDC,the applicant is requesting that strict compliance for the following LDC sections be waived at this time: •Section 20-7.9 of the LDC:Outbuildings shall havea maximum frontage of thirty (30)feet Theapplicantisrequestingaspecialexceptiontoconstructa building witha street frontage of forty-two (42)feet Although theproposedoutbuildingfrontageexceeds the maximum frontage allowedby the LDC,the proposed larger frontage wouldfollow the intent of the Hometown District Overlay by increasing street frontage.Theincreasein frontage would provide an attractive visual barrier that blocks pedestrian's viewof the existing rear tenant parking spaces and trash enclosures. •Section 20-7.11 of the LDC:Outbuildings shallbelocatedinat least onerearlotcorner andshallbeplacedzero(0)feet fromthe property line. While the proposedoutbuilding will beplacedattherearof the propertyin the southeast corner,the applicantisrequestinga special exceptiontohaveafive(5)footsetbackas evidencedin the attached siteplan.This setbackisbeing requested in order toprovide turning visibility to vehiclesandservicetrucksexiting the alleyway. Theapplicantis requesting the specialexceptionfor the following reasons: •Locating the new outbuilding in the mannerdefinedby the code would restrict vehicular access to the alley •The proposed larger frontage would follow theintentofthe Hometown District Overlay by increasing street frontage,andatthesametime respecting the existing historic buildingbynot connecting toit. Analysis: As shownon the attached siteplan,theapplicantisproposingtoconstruct the new2,699 squarefoot building that will include 1,962squarefeetof retail spaceas well a737squarefoot mezzanine with the entrance along SW 58th Avenue.Considered tobean outbuilding,Section 20-7.5 ofthe LDC defines outbuildings asaseparate building detachedfromthe primary building onalot.As partoftheproject,theapplicantisproposingto install newattached planters along the sidesof the outbuilding that will create newgreenareason the site.When reviewing the projectagainstthedimensionalguidelineslistedin the HometownOrdinance,it shouldbenoted that the projectmeetstheopenyardspace requirement of 5%.Furthermore, because the building isconsideredtobean outbuilding,the definitionforlotcoveragelistedin Section20-7.5of the LDC states that the additional square footage producedbythenew outbuilding will not count towards the lotcoveragefor the site. Special Exception -S800 Sunset Drive May 3,2016 Page3of6 Aspart of the review of the proposed project,the following items of concern have been identified in the siteplanprocess: 1.Parking Analysis: In order to accommodate the placement of the proposed 2,669square foot outbuilding,a total of fourteen (14)off-street parking spaces willbe removed from the parkinglot behind the historically designated building.Once removed,the proposed outbuilding will accommodate future retail tenant space. Retail Use Parking Space Requirement 2,669 StFt 1 Parking Space 300 SrF, =8.99 Parking Spaces *9 Parking Spaces A total of nine(9)parking spaces willberequired to meet the minimum off-street parking requirements for the outbuilding. Total amount of Required Parking Spaces 14 Parking Spates +9 Parking Spaces =23 Parking Spaces Oncetallied,a total of twenty-three (23)off-street parkingspaceswillberequiredfor the construction of the building. The applicant submitted to staff a settlement agreement dated May9,2008 between the City of South Miamiand property owner (DabbyProperties).In Section I of the agreement, the property owner is granted aparkingspace credit foran additional 30 parking spaces whichare not required to support the existingretailland uses along the 5800 block of Sunset Drive.The parking space credit canbeutilized to meet any tenant or increased parking requirements required by the redevelopment of the existing property only.The applicanthas elected to use the parking space credit to cover the deficit generated by the construction of the proposed outbuilding. Remaining Parking Space Credit 30 Parking Spaces -23 Parking Spaces =7 Parking Spaces Once the credithas been applied,the property owner will have aremainingparkingcredit balance of seven (7)parking spaces. Special Exception -5800 Sunset Drive May 3,2016 Page4 of 6 2.Historic Analysis: Therepositioning of the existingrearstaircaselocatedat the rear of the historically designated building that leads to the secondfloorentranceanddecreasing the dimensions of the utility meter roomlocatedalong the rearwall of thehistoriccontributivebuilding. In orderto accommodate theproposedoutbuilding,theapplicantisproposingto realign the existing staircaselocatedat the rear of the historically designated buildingandalsoreduce the dimensions of the rearwall meter room,whichappears to beanaddition.The Historic PreservationBoardwascanceledin November 2015duetoalack of quorum andwasunable to provide a recommendation on the item.However,staff was able to reach out to Scott Kurtzman,Chairman of the Historic Preservation Board.In the attached email from Mr. Kurtzman dated December 7,2016, "Regarding therearstairs at 5800 Sunset,thereistheadditional factor of them beingintherear of the building.Generally,thestandards of theNationalTrust for Preservation focusonthefrontfacadeandsidefacades which areclearly visiblefromthefront of theproperty.Rearfacades,unlesstheirdesign elements arehistoricallysignificant and/or clearlyvisible,areusuallygiven more leeway formodification.In general,itisencouragedtohaveanymodificationbein keepingwiththeoriginalstructure'sformanddesign style and be period appropriate." The realignment of the stairsandreduction of the meter roomare not asignificantdesign element change because the meter roomisan addition that will just be reduced insize,and the staircase will not be removed,but repositioned;relocating ground level access to the east instead of to the south.Pedestrians will continue to access the staircase from the existing rear parking lot areaas well asfromSW 58th Avenue viaa new landscaped area with a hinged gate. 3.Right-of-way Analysis: Theutility infrastructure within the publicright-of-way (ROW),street trees andlightingalong the sidewalk would have to be either relocated or removed. An analysis to understand pedestrian movement isvital to the Hometown District Overlay. The adjacent sidewalk atthe proposed site along SW 58th Avenue will need to accommodate pedestrian andADA requirements.Theutility infrastructure,street trees andlightingalong the sidewalk would have to be either relocated or removed.This includes two (2)street trees,one (1)fire hydrant,one (1)street lightpole,and one (1)FPSiL pole.The applicant has met with the City'sPublic Works Department to discuss the proposed changes to the ROW andbasedon that meeting,the applicant must complywithall requirements that they state so that the public infrastructure isproperlyaddressed.Furthermore,the applicantwillalso need to submit a tree removal permit applicationfor the removal and/or relocation of any trees along the property line. Special Exception -5800 Sunset Drive May 3,2016 Page5of6 4.Special Exception Analysis: Pursuant to Section 20-7.51(A)of the LDC,the city commission may,by special exception, waive strict compliance with the provisions of the Hometown District Overlay Ordinance.In granting a special exception,the city commission must findby substantial competent evidence that: 1.The proposed development contributes to,promotes and encourages the improvement of the Hometown District and catalyzes other development as envisioned in the Hometown District regulations. The addition of the outbuilding would further stabilize the economy of the Hometown Districtby introducing an avenue for additional retail space in the area.The new retail space would then encourage more patrons to visit the Hometown Districtwhichwould in turn further stimulate the growth of the Hometown District from a development standpoint. 2.The proposed development is compatible with the land uses and development intensities prescribed by all applicable city regulations. The proposed retail outbuilding isa permitted use in the Hometown District and is compatible to the surrounding uses in the area. 3.The proposed development must possess integrity of design compatible with the design criteria established for the Hometown District and with the overall image of the city. The proposed outbuilding possesses integrityofdesign that is compatible with the design criteria established for the Hometown District.Furthermore,its design isin keeping with the overall image of the city. 4.The proposed development shall be designed ina manner that provides for effective management of traffic (vehicular and pedestrian),parking,lighting,noise and waste generated by the development,and management of the impacts of the development on public facilities and services. Due to its centralized location within the Hometown area;lighting,noise,and waste generated by the development will nothinder the standard of living for residents who live nearby.Furthermore,both vehicular and pedestrian traffic will continue to be managed in the area and will not be interrupted. 5.The proposed development does not expand the permitted uses within the Hometown District. The proposed project will not expand the permitted uses within the Hometown District. Theproposedoutbuildingwillnothaveanunfavorable effect on the economyof the City of South Miami.Infactitwill contribute to the economy byallowingforanewlocal businessto enter the Hometowncommunityandgrow,attracting moreresidentsand visitors to the area. 7.The proposed development,when considered cumulatively with other development, both present and future,within the Hometown District,will not create excessive overcrowding or concentration of people or population. The proposed outbuilding,when considered cumulativelywith other developments,both present and future,within the Hometown District is determined tobeofa compatible and complementary nature with the existingandfuture planned surrounding uses.
