Res No 069-16-14624RESOLUTION NO.069-16-14624 A Resolution calling for staff to review the Affordable Housing Objectives and Policiesin the City's Comprehensive Plan and to draft ordinances that enact those and any recommended changes to the Plan or the Code. WHEREAS,TheCity of SouthMiamiComprehensive Plan,asamendedin 1999, andapprovedbytheFloridaDepartment of CommunityAffairs,callsforincentivesand bonusesthat encourage construction of affordableunitsin multi-unit development: "HOU OBJECTIVE 1.5 The Cityshallconsidertheadoption ofvoluntary or mandatory zoningregulationsas promulgatedbyMiami-Dade County toproduceadditionalaffordablehousingunits Citywide. HOUPolicy 1.5.1 When additionaldevelopmentpermissionsthatwillresultintheaddition often or moreunitsare granted,thenew development shoulddesignate20percent ofthe newunitsaslowandmoderatehousing units.For developments oflessthanten units,thedeveloper funding set-aside for lowandmoderateincome units. HOU Policy 1.5.2 Inconsideration ofadeveloper'sprovision ofaffordablehousing,theCity shall considergrantingadensityincreaseproportionaltothenumber ofunits provided butnotexceeding20%increase,totheextentthatsuchanincreaseiscompatible withsurroundingsitecharacteristics." and; WHEREAS,No language was ever incorporated intothe Land Development Code toenactthe affordable housing policies inthe Comprehensive Plan;and WHEREAS,Theneedfor affordable housing in South Miami hasnearly doubled sincetheaffordablehousingpolicieswereaddedtotheComprehensivePlan,with approximately2,200householdscurrentlyoverburdenedbyhousingcosts,accordingto recentfiguresreleasedbytheShimbergCenterforHousingStudiesattheUniversity of Florida;and WHEREAS,Every member of theCity Commission has expressed adesireto promote affordable housing;and NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,FLORIDA,THAT: Section 1.TheCityCommissionherebyexpressesitssupportforthe AffordableHousingObjectivesinthe City's ComprehensivePlananddirects staff to (a)takeorrecommendstepstodeterminewhethertheaffordablePoliciesinthe City's Res.No.069-16-14624 ComprehensivePlanremainappropriateandareconsideredbestpracticeinpromoting affordablehousing,and(b)tomakerecommendations,intheform of proposed ordinances,totheCity Commission should staff determinethat improvements inthe Comprehensive Plan are advisable,and(c)to recommend the adoption of voluntary or mandatoryzoning regulations to implement thecurrent policies andany recommended policies inthe Comprehensive Plantofacilitate,produce,and encourage additional affordable housing units citywide,as applicable. Section 2.If any section clause,sentence,or phrase of this resolution isfor any reason held invalid or unconstitutional byacourt of competent jurisdiction,the holdingshallnotaffectthe validity of the remaining portions of this resolution. Section 3,If any section clause,sentence,or phrase of this resolution isfor anyreasonheldinvalidorunconstitutionalbyacourt of competent jurisdiction,the holdingshallnotaffectthevalidity of theremainingportions of thisresolution.
